i'm rob nelson. >> i'm vinita nair. a year and a half after michael jackson's death the criminal case against his doctor has finally begun. >> on the first day of a preliminary hearing, witnesses gave some chilling details of the pop star's final minutes. diana alvear is in los angeles with the latest. hi, diana. >> reporter: vinita and rob, good morning. based on what we heard in court so far, it seems that prosecutors are going to show michael jackson should never have been given propofol. a year and a half after the death of michael jackson, his mother katherine, brother jermaine, and sister la toya arrived at the los angeles county courthouse. that's where a judge will decide whether the superstar's personal physician, dr. conrad murray, should stand trial for involuntary manslaughter. in their opening statement, prosecutors said murray incorrectly performed cpr, ordered the singer's personal assistant to round up medication and other items, and waited at least 21 minutes to call 911. they said jackson was already dead by the time paramedics arrived. faheem muhammad, head of the security detail, testified the singer's children were aware things were seriously wrong. he said son prince was in the doorway to the bedroom. daughter paris was on her hands and knees, crying. earlier the director of jackson's last tour, kenny ortega, told the court six days before the pop star died he sent jackson home because he was in no condition to rehearse. ortega said, "he appeared really lost. it was scary." the next day ortega says murray told him to butt out, that jackson was physically and emotionally fine. prosecutors have alluded to what they think the defense is going to argue, that it wasn't the doctor who administered that fatal dose of propofol, it was the king of pop himself. regardless of what evidence is presented, like much of jackson's family, they are convinced of murray's guilt. >> i want conrad murray to go to jail, period. >> reporter: murray has pleaded not guilty. the court also heard from jackson's personal assistant. he was describing the hours at the hospital following jackson's death during which he said murray seemed to want to leave, at one point saying he wanted to retrieve the singer's favorite ice cream. at another saying he was hungry, and then disappearing. vinita, rob? the 112th congress convenes today on capitol hill with republicans in control of the house. gop leaders say they will move quickly to cut government spending. the first vote on that issue is scheduled for tomorrow and republicans are also challenging the president on health care. outgoing house speaker nancy pelosi warned people will suffer if health care reform is overturned. >> in order to have a patient's bill of rights, though, it's important to have comprehensive health care reform. >> we think that obama care will ruin the best health care system in the country. we believe it will bankrupt our nation. we believe it needs to be repealed and replaced with commonsense reforms to bring down the cost of health insurance. >> republicans now have the votes to pass the health care repeal bill in the house but the action is largely symbolic since democratic leaders have already pronounced it's dead on arrival in the senate. delaware detectives baffled by the murder of a former pentagon official now say he was last seen alive a day before his body turned up in a landfill. but they still don't know who exactly killed john wheeler. a former aide to president reagan and both president bushes. here now is pierre thomas. >> reporter: by all accounts, john p. wheeler iii was a man of stature. west point grad. military man. vietnam veteran who helped spearhead efforts to build the memorial wall in washington. the nature of his recent untimely death feels completely at odds with his life. wheeler was murdered, his body discovered dumped at a landfill. not far from his newcastle, delaware, home. >> very prominent gentleman. and why anyone would kill him would be beyond me. >> reporter: monday, police were back at the landfill desperately hunting for leads. >> there are no suspects. again, we are still looking to determine where the crime scene actually occurred. >> reporter: wheeler has homes in delaware, washington, and new york city. he was believed to have been in washington prior to being found dead on new year's eve. he was a white house aide to president reagan and worked in the administrations of both bush presidencies. his passion, soldiers. he pushed hard as chair of fund-raising for the vietnam veterans patriotism and service. we've lost a great friend and a great engine in efforts to help the country. >> reporter: friends say so sad that a man so concerned about giving honor to fallen comrades apparently was afforded so little dignity in his own death. pierre thomas, abc news, washington. former vice president dick cheney could now be facing a critical medical choice. he has had heart trouble for decades and recently had a device implanted to help it keep pumping. now the "new york times" is reporting that "mr. cheney now faces a crucial decision, whether to seek a full heart transplant." it is a decision he will most likely be forced to make within months. no comment yet from the cheney family. the navy captain who taped those controversial videos has now been reassigned to an onshore desk job. >> owen honors was fired as commander of the "uss enterprise" as a result of the scandal. karen travers is joining us from washington with the latest. good morning, karen. >> reporter: good morning, rob and vinita. those raunchy videos have sunk the career of navy captain owen honors. the navy said yesterday that honors exhibited poor judgment and is no longer fit to serve as the commander. in two weeks the "uss enterprise" sets sail for a middle east deployment but honors will not be at the helm. he's been permanently relieved of his duties because of these raunchy videos. he not only showed them to his crew of 6,000 sailors, he also starred in them. >> his profound lack of good judgment and professionalism calls into question his character and undermines his credibility to continue to serve effectively in command. >> reporter: two new video clips that were leaked to "the virginian pilot" newspaper this week showed more crude behavior and offensive language. these videos were taped during the ship's weekly movie night in 2006 and 2007. the videos are full of gay slurs, sexual innuendo and profanity. they were shown to crew members on active duty in iraq and afghanistan. the navy is crystal clear on the behavior it expects from its officers. the code of conduct said they must abide by an uncompromising code of integrity and exhibit the highest degree of moral character. the navy brass is now saying officers are held to a higher standard and honors is being held accountable for his poor judgment. honors will remain in the navy but by being stripped of his command his career is effectively over. the navy says it will continue to investigate these videos to find out what other officers on the aircraft carrier knew and when they knew it. rob and vinita? another day, another story about dead animals. first we had those thousands of dead birds, now an outbreak of dead fish. thousands of them were found floating in spruce creek, that's in orlando, florida. days ago large numbers of dead fish were also found in an arkansas river. but in central florida, though, experts there say sudden temperature changes can cause these large-scale fish kills. and temperatures there fell into the 30s for days over the holidays. pleasant footage there. >> unbelievable to think there's so many, you could see it from overhead like that. >> i think three weeks. we should point out disney is the parent company of abc news. we'll be right back. a crazy story here. we turn now to argentina where bank robbers there pulled off a new year's eve heist that even hollywood would be jealous of. >> these robbers methodically scoped out the bank and spent half a year tunnelling into the vault. and then they made off with 140 safe deposit boxes. david muir has more. >> reporter: as revelers partied above-ground on new year's eve, thieves were quietly at work underground. just like that scene in the movie "the bank job." real-life thieves had dug their own tunnel. authorities in buenos aires say thieves had rented a building right near the bank last june, and for six months they've been digging. a 100-foot-long tunnel. it was ventilated, it had lights, it even had reinforced walls. that tunnel led them straight to the vault in the bank where the safety deposit boxes are kept. outside the bank a line of angry customers waiting to hear how much they'd lost. this man motions, they showed me my safety deposit box, there was nothing inside. investigators hovered over the hole dug in the ground at the building next door. the width of the hole wide enough to fit the thieves. authorities say the thieves spent the entire weekend prying open and emptying about 140 safety deposit boxes. but police had no idea until the bank opened on monday. they do have this image now. what appears to be one of the thieves carrying bags to the car. one prosecutor admitted it was a really impressive job, so impressive they're not ruling out inside help from the bank. so far, they're not saying just how much the thieves got away with, but it was likely a huge amount. because after the banking crisis in argentina, many customers took their money out of bank accounts and put them into safe deposit boxes. thinking it was the safer route. unaware of the other route being built secretly underground. david muir, abc news, new york. >> this has happened before, too. in 2005, 68 million bucks taken from a bank in brazil using a tunnel. unbelievable. >> the amount of dedication to that, half a year. officials are saying one of the hardest of the past as both parties appear to be drawing a line in the sand. the washington president obama came back to is about to look a whole lot different than the one he left less than two weeks ago. >> my job this year is to make sure we continue the recovery. we started making progress on that during the lame duck. i expect to build on that progress when i get back. >> reporter: there will be 85 new house republicans sworn in wednesday. >> we're here to represent and reflect the values of the country. and the country has said very directly, stop the spending. >> reporter: speaker-in-waiting john boehner. boehner and fellow republicans will try to repeal president obama's health care law. the vote is scheduled for next wednesday. >> we think that obama care will ruin the best health care system in the country. we believe it will bankrupt our nation. we believe it needs to be repealed and replaced with commonsense reforms to bring down the cost of health insurance. >> reporter: while it will likely pass the house, it won't get far in the senate where democrats still hold the majority. >> in order to have a patient's bill of rights, though, it's important to have comprehensive health care reform. >> reporter: boehner has pledged to cut $100 billion from domestic spending this year. the real spending fight will come in february when the parties will do battle over the debt ceiling. increasing the debt limit is essential to funding government. the tea party members like senator-elect rand paul are dead set against it. the president has white house staffing decisions to make, including who should fill the role of white house chief of staff and chairman of the national economic council. >> on top of that the president is also going to be looking for a new press secretary. robert gibbs will be leaving the white house fairly soon. he's expected to assume a more senior counselor role, or he may serve as an outside adviser for the white house to help in the president's re-election campaign. police in delaware may have a new clue this morning in the mysterious murder of a former presidential aide. john wheeler, a prominent defense consultant who worked in both bush administrations, was found dead in a landfill on friday. police say wheeler was seen alive 24 hours earlier, not far from his attorney's office in wilmington. they hope this tip might lead to more leads in the case. the navy has now fired that aircraft carrier commander just two days after his controversial videotapes went public. now though there are new questions over whether his bosses knew and why they took no action when the tapes were made years ago. martha raddatz has more. >> reporter: the navy came down on captain owen honors with a hammer. with words so harsh, it is clear the decorated top gun pilot's ship command is not only over but his entire career. >> his profound lack of good judgment and professionalism, while previously serving as executive officer in "enterprise," calls into question his character and undermines his credibility to continue to serve effectively in command. >> reporter: the exceptionally poor judgment was on display aboard the "uss enterprise" from 2006 through 2007, showing sexually suggestive scenes, extreme toilet humor, and anti-gay jokes. >> i got a great idea, let's ask checkmates about being gay. that's not a very good idea, is it? >> reporter: honors' boss now says he has seen all the videos. >> as naval officers we are held, indeed we must be held, to higher standards of performance and conduct. >> reporter: captain honors, who seemed to love the camera on board ship -- >> hi, there -- >> oh, don't, come on. >> reporter: closed the door on a local station seeking comment. but the navy's biggest challenge now may be morale. thousands of sailors on the "enterprise" will now have a new captain as they head for combat operations. many who have publicly come out in support of captain honors. >> he's been nothing but great. to everybody on that ship. >> you bond in that environment, and no doubt a lot of people like that sort of edgy humor. but the fact of the matter is commanders have to set an example to lead with integrity and lead the entire crew. not just those who like your particular brand of humor. >> reporter: the admiral knows about humor. he was in a profanity-free spoof on comedy central years ago with comedian stephen colbert. >> a sense of humor can be very effective as a leadership tool. the key is knowing how far you can go. >> reporter: clearly captain honors crossed way over that line. he is not the only one who may face the end of his career. the navy said they are looking at the actions of other senior officers who knew of the video and what they did or did not do in response. martha raddatz, abc news, washington. a preliminary hearing for michael jackson's doctor continues in los angeles today. jackson's mother and brother jackie were there as the case against dr. conrad murray got under way yesterday. he's been charged with involuntary manslaughter. jackson's bodyguard testified that murray didn't seem to know cpr. and the star's personal assistant testified murray phoned him for help, never called 911. a texas man has been cleared of wrongdoing after spending 30 years behind bars. cornelius dupree's conviction on rape and robbery charges was set aside by a judge in dallas. new dna evidence proved he did not commit those crimes after all. it predictably was an emotional scene when the 51-year-old dupree learned about his freedom. >> words really won't make up for what i have lost. i lost both my parents. i just feel that, you know, the system needs to be fixed. by whatever means. so this won't happen to anyone else. >> texas has freed 41 wrongfully convicted prisoners through dna evidence since 2001, more than any other state. federal prosecutors are looking into allegations that new york city sanitation workers sabotaged the cleanup efforts after last week's blizzard. a city councilman says a number of sanitation supervisors instigated a slowdown to protest budget cuts. some workers allegedly drove with their plows up to >> i see myself as male and female. >> reporter: norrie, who goes by one name, happy to be called he or she, is the first person in the world ever to be issued with identity papers that state "sex, not specified." >> i say to you, norrie, what gender are you? and what's your answer? >> what are the options? i'm not specifically m or f. you can't specify me as being male, you can't specify me being female. >> reporter: two doctors examined norrie and couldn't say she was one sex or the other. physically or psychologically. hence, sex not specified. >> there are men, women, most of us fall into one of those categories. but then there's a minority who falls in between. >> reporter: and that's where norrie falls. in between. she's that way in life as well. part shy and bookish, part wildly confident and outgoing. norrie was born anatomically a totally normal boy in small-town scotland 49 years ago. the family, religious and hard-working, soon emigrated to australia for a better life. where norrie grew from a slightly awkward teen into a glamorous gay man. >> at that stage i was very androgynous. this was the 1980s. boy george was allowed to do that but don't you do it in real life. >> reporter: discriminated against at work by day in a government office, at night, norrie socialized with transsexuals and became a drag queen. how did your parents deal with this? >> i think my dad put it in the too hard box. my mother seemed fairly accepting. she decided if i was going to be female i should stop being a trampy slut and here's some nice clothes she's throwing out that i can have. >> reporter: gradually, norrie came to believe she was a woman in a man's body. >> i knew that i couldn't do the role of man. so the role of woman seemed to be one i was getting approval for. it felt natural for me. >> reporter: age 27, norrie had sex change surgery, penis and testes removed, vagina created. here she is in her first days as a woman. >> for a couple of years afterwards i was absolutely ecstatic about it. >> and felt female? totally? >> i thought so, yes. until i then got involved with straight guys who when they found out i was a tranny told me i wasn't female. they felt they'd been lied to. i was threatened with violence. >> reporter: and two years after surgery, norrie felt like neither. and stopped taking the hormones that had softened her skin, produced breast tissue, and broadened her hips. she stopped taking the hormones that made her look female. >> i've had to challenge the idea that i had to take my identity from a bottle. i had to open a cupboard every day and take these pills because i'm a woman and they make me a woman. what? why can't i just be me, why can't i be a human being? a long journey getting there, once i realized i was comfortable being androgynous and realized that i had a right to assert that, things are pretty good. >> reporter: so what does norrie call herself? that power to challenge the president on spending and health care. here's jonathan karl. >> reporter: four years after he handed the speaker's gavel to nancy pelosi, john boehner is about to get it for himself. already the republicans have outlined a plan of attack. first, a simple two-page bill that would scrap the entire obama health care law. the law may not be popular, but repeal means doing away with parts of it that are. including a new subsidy seniors are getting this year of up to $850 to buy prescription drugs. and a provision already in effect guaranteeing coverage to children with pre-existing conditions. in her last press conference as speaker, nancy pelosi warned people will suffer if health care reform is overturned. >> if you're going to have a patient's bill of rights, you have to have comprehensive health care reform. >> reporter: the next line of republican attack, spending cuts. republicans are promising $100 billion of cuts over the next eight months. but so far the only specific they've offered is a $35 million cut in congress' own budget, which means a slight reduction in things like staff salaries and office supplies. they've got a long way to go. that's less than .04% of the $100 billion cut they've promised. behind the scenes, much of the talk is about an issue they'd much rather avoid. in the coming months the government hits the limit on the amount of money it can legally borrow. if it's not raised, the united states effectively starts bouncing its checks and faces a government shutdown or worse. some tea party republicans are saying they'll refuse to allow the government to borrow more money. >> i could not be more serious when i say i'm not going to vote to increase the national debt limit. >> jonathan karl, abc news, capitol hill. a key member of the president's staff will soon be leaving the white house. press secretary robert gibbs is taking a new role as an outside adviser. he'll likely be devising strategy for the president's re-election campaign. the president is also looking for a new white house chief of staff and top economic adviser. navy captain owen honors has officially been fired, stripped of his command and assigned to a desk job after those controversial videos shot aboard the "uss enterprise." >> now the navy is trying to figure out what other top military leaders might have known about those videos. karen travers has the latest in washington. good morning, karen. >> reporter: good morning, rob and vinita. those raunchy videos have sunk the career of captain owen honors. the navy said yesterday that he showed poor judgment and he's no longer fit to serve as the commander. in two weeks the "uss enterprise" sets sail for a middle east deployment. but its commander, captain owen honors, will not be at the helm. >> his profound lack of good judgment and professionalism calls into question his character and undermines his credibility to continue to serve effectively in command. >> reporter: honors has been permanently relieved of his navy duty as a result of these raunchy videos that he not only showed to his crew of 6,000 sailors, but also starred in. two new video clips leaked to "the virginian pilot" newspaper show more crude behavior and offensive language, taped during the ship's weekly movie night in 2006 and 2007. >> let's ask about being gay. that's not a very good idea, is it? >> i don't think that's legal. >> reporter: the videos are full of gay slurs, sexual innuendo, and profanity, and were shown to crew members on active duty in iraq and afghanistan. >> we are getting ready for combat operations. it's hot. [ bleep ] it's hot. we're getting close to hell. >> reporter: the navy is crystal clear on the behavior it expects from its officers. "abide by an uncompromising code of integrity," and "exhibit the highest degree of moral character." the navy brass says that officers are held to a higher standard and honors is being held accountable for his own poor judgment. honors remains in the navy but by being stripped of his command his career is effectively over. >> after personally reviewing the videos captain honors created while serving as executive officer, i have lost confidence in his ability to lead effectively. >> reporter: the navy said it will continue to investigate these videos to find out what other officers on the aircraft carrier knew and when. rob and vinita? in other news now, a texas man has been officially cleared after serving 30 years in prison for a crime he did not commit. a judge in dallas dismissed cornelius dupree's rape and robbery charges. new dna evidence proved that he did not commit those crimes after all. under texas law, dupree could get $80,000 for each year that he was wrongfully behind bars. a federal appeals court has ruled that a giant cross in a san diego park is unconstitutional. the 29-foot cross was erected a half century ago to honor korean war veterans. but because it is on public land the court ruled that it conveys a message of government endorsement of religion. the lawsuit began 22 years ago and is likely to continue all the way to the supreme court. a new hampshire man will be in court tomorrow to plead not guilty to an expensive speeding ticket. he doesn't dispute that he was driving too fast but says he had a very good reason. wmur's jean mackin reports. >> reporter: baby kyle coughlin will have quite a birthday tale to tell. on september 18th, his mom went into labor around 3:00 a.m. dad was driving from their londonderry home to catholic medical center in manchester when suddenly, kyle wanted to come into the world right away. >> we hit the 293 split and my water broke and he was coming out. >> reporter: john coughlin said he didn't realize how fast he was going when a trooper tried to pull him over. john called 911. >> i'm being pulled over by a cop but my wife's in labor, her water just broke, i'm just on my way to the hospital. >> reporter: you can hear angela screaming in the background. >> you can hear her screaming, i've got to get her -- >> reporter: the dispatcher told the trooper angela was in labor. the trooper turned the pursuit into an escort to the hospital. >> the baby has not been born at all yet, correct?
