the 3003 to house is on fire. it went to three alarms, 48 firefighters fought it for 35 minutes or so. what they learned is the first cows 47 that house was vacant and under construction. the second house was occupied by two people inside. those two occupants were able to get out with no injuries. investigation turning to the cause, they're looking at the vacant house obviously investigators need to get in and take a look at it. to make sure what caused the fire. the one house is completely destroyed, the second one has major damage. the good news is no fire fighters, in no occupants of the county superior court tuesday afternoon. gregory elarms, 58, has been charged with first- degree murder in the killing of activist david lewis, who was gunned down near his car in the parking lot of the hillsdale shopping center on june 9. elarms was arrested on dec. 20, two days after he contacted san mateo police with a tip in the case. elarms is scheduled to reappear in court for a preliminary hearing on feb. 18 at 1:30 p.m. >> and it man whose daughter died in oakland last week will now have this deportation postponed. he was arrested in july while trying to cross the border from mexico into the united states. he will be allowed to attend funeral services for his family, three year-old daughter died thursday morning along with the girl's mother, and a family friend. immigration authorities are making arrangements to escort him to attend the private service for the family members. deportation is postponed indefinitely until custody regarding his surviving daughter can be we've had a reporter on the scene all morning. >> could morning mark. san rafael fire officials are still on the scene. probably will be for a couple more hours. they got the call at one minute after 3:00 a.m., 47 may ward way. they discovered there were two houses on fire, and then this one to three alarms. 40 firefighters fought it for 30 minutes when they got it under control. the fire actually started at 47 may what way. it was a house under construction. the next door house was occupied by two residences side. those residents were able to get out, they did not have injuries. the fire department's turning in investigation to the on occupied home. they say they don't know what caused the fire. they will look at that house as the ignition source. i can say the white house is completely destroyed. the other house has major damage. it probably will be able to be reoccupied any time soon. they will be out here on fire watch making sure no hot spots pop up. >> another
