months to come. there is hope on the horizon. cautious and fragile. but there is hope. it is my hope president biden will do what leaders should do, which is deflect any perceived credit and shoulder at least his share of the responsibility. that is what leaders do. the reality is we are most hopeful because of the medicine. the vaccines, treatment and the therapies. that gives us both physical resistance to the virus and some measure of emotional security. the credit for the medicine goes to the women and the men who dedicated their lives to creating, studying and testing the vaccines in therapies. credit goes to those bold enough to believe this could be done and could be done in record time. some of those bold enough to believe were in the previous administration. i harbor no illusion that president biden will give credit to the previous administration and the women and men who help us get where we are today. but he should. it's been an american tragedy. an american response and this should be an emergency recovery. we'll see if president biden speaks to that. because he is addressing the nation tonight there is a temptation to issue a report card of sorts on the first two months of the administration. you know we give president four-year terms for a reason. a big job. takes time to get your cabinet in place. to do the hiring and turn campaign promises to real legislation. i have always tried to resist when the media used to ask me to give presidents a letter grade. i mean the grade comes at the end of class. not after two months. after two months of class when i was in school, i hadn't even gotten the syllabus. i hadn't even purchased a textbook yet. i was pacing myself. because the grade comes at the end. and the end for the class for presidents is at the end of their term. the grade is called "re-election." that said, we do give progress reports. we give interim grades. we give midterms. we even schedule parent-teacher conferences. it's good to get a sense of how things are going, even early on. if you think things start off poorly, we need a plan to get them back on track. i resisted the media's request to give president obama or president trump letter grades because the course wasn't over when the media was asking me. but it's always the right time to take a look at the map to see if we have veered offcourse. it's always the right time to see whether elected officials are keeping their word and doing what they pledge to do. i reread president biden's speech when he was sworn in. i re-read it today. the dominant theme of the speech was unity. far and away that was the dominant thing. he said his whole soul was dedicated to unity. bringing americans together. uniting our people. uniting our nation. for those who weren't paying close enough attention, he repeated it. he said, "unity, unity!" he said, "without unity, there is no peace. only bitterness." we are two months in on this journey to unity he laid out. do you think we are on track tom reach that destination? i mean, the senate is passing massive bills with no republican votes. the house is passing culture changing bills with no republican votes. they are using a process called "reconciliation" to skirt around the rules. you have some cabinet-level nominees with the most rad cat cat -- radical relief. one of the first acts shut down the pipeline jobs. the immigration plan is the most radical i have ever seen. that is not unity. that is the same old power politics we have seen in the past. there ain't nothing new about that. he said his goal for this class if you will was to write a beautiful term paper on unity. that is his word. not my word. that was his. class isn't over yet. but so far, i haven't seen it. i don't know what was in his soul when he said his whole soul was dedicated to unity. i just know what i see. and so far, it doesn't look much different. jorning me now karl rove. and katie pavlich. both fox news contributors. welcome. >> good evening. >> hey, trey. great to see you. >> trey: i'll start with you, katie. he is talking tonight but i still think he is not going to answer questions. will we ever get to see him answer questions? >> well, based on the answers from his press secretary and the fact we haven't been given a real timeline when he will do the first press conference, i think the answer is no. you know, he had, he was going to have a signing ceremony tomorrow at the white house for the $1.9 trillion bill. they moved it up to today. he essentially slammed the pen on the table and walked out without taking press questions as the staff is trying to shoo them out of the room before questions can be asked. he is jumping on the campaign trail tomorrow to do a two-week trip to tout the process they say is the massive stimulus "relief" bill mostly full of the democratic pet projects. in terms of the media asking questions, you don't think he has any interest in answering them. it works for them on them campaign trail in 2020. so they think it's working for them now. >> trey: karl, when you talk about the politics or polling, i stop what i'm doing and i pay attention. so you are the perfect person for me to ask. he gave an inaugural speech about unity. but i mean, does unity poll well? do people want it or do they just want us to talk about it? >> no, no. they want it. he is not delivering it. you are reluctant to grade him. i'm not so reluctant to grade him. his progress to push his agenda, he's an "a." it's a left wing agenda. he is getting a lot through. he put a bunch of stuff in the bill that has nothing whatsoever to do with covid. give him an "a." rewarding allies. gave him an a-plus. $86 billion bailout for the teamster pension funds that for 20 years people in congress have been wrangling how do we settle this? bam, it's done. $100 billion for the teachers. not needed for reopening the schools. i mean this thing is jammed with the lots of rewards for every democratic interest group. if is call responsibility, an "f." he is taking all that money and dumping it in to the things that have nothing whatsoever to do with covid. "d" on bipartisanship. they talk a good game. their definition of "bipartisanship" is if they look at a poll and if they say are you in favor of apple pie as defined by joe biden and covid in the covid relief bill and people say yes, and you're republican, they say yes, that is bipartisanship. we do things in a poll that poll well with the republicans but when the republicans get to know what is in the bill, they ain't going to like it at all. he made no effort. no committee hearing. they had one meeting with the ten republican senators. he dismissed them. he took none of their suggestions. this is not an attempt to be bipartisan. it's an attempt to stuff a partisan bill down the throat of the country and claim it's bipartisan because it "polls well." it ain't going to poll well in three months as it is today. finally, elocution. we have seen it this week. he is sitting there in the east room introducing a couple of the combat commanders who happen to be women. he cannot remember the name of his secretary of defense who is standing five feet or six feet to his side. so, elocution ain't no good so far. >> trey: katie, karl put up a whiteboard -- >> another thing -- >> trey: go ahead. i mean, that scared me. that looked like one of my report cards from college. you go ahead. >> it was a very good report card. but i add border security to the list. because this administration now has a catastrophic on its hands and it seems not interested in actually acknowledging the issue. it's not just a border security issue and illegal immigration issue. it's a public health crisis given the fact that they aren't necessarily testing all of the illegal immigrants who are pouring in the country and getting on buss to go to other part of the country. that deserves an "f-"minus in my opinion. >> i agree with katie. they are testing them but it's not the federal government. the city of brownsville testing the people that d.h.s. drops off at the bus station and the c.e.o. of greyhound said don't put people on my buses unless they have been tested. 6% of the people tested turned out to be covid. those people are getting on a bus and endangering the health of the fellow passengers and the crews of the buses as they head off and they are distribute around the country. quarter of a million single adults have come across the border since last october. that is well above the pace last year. like six times the pace of last year, of last fiscal year. those people coming across to the border. think about that. if only 6% of them are covid, we are talking about 20,000, nearly 20,000 people coming across the border to get on the buses and distributing themselves around the country. that is not a good, that is not going to become a good picture at all. >> trey: watch tonight and i'll have you back on at some point and we can assign letter grades to the speech tonight. thank you tonight for helping us prepare for what is coming at 8:00. thank you, both. >> you bet. >> thank you. >> trey: coming up, national guard troops will now remain at the capitol until late may. despite the head of the guard objecting. how he was overruled by the biden administration after democrats called for the troops to stay put. senator tom cotton a u.s. army vet himself is up next. i had saved up some money and then found the home of my dreams. but my home of my dreams needed some work sofi was the first lender that even offered a personal loan. i didn't even know that was an option. the personal loan let us renovate our single family house into a multi-unit home. and i get to live in this beautiful house with this beautiful kitchen and it's all thanks to sofi. everyone's crunching! what's crunching? >> senator: i'm good, trey. good to be on with you again. >> trey: thank you for being on. you are on judiciary and you understand immigration. what is going on at the southern border and what grade would you give president biden so far? >> senator: well, joe biden's grade on immigration depends on the perspective. if you're a human trafficker or a drug dealer, you would give him a-plus-plus. but the american people would give him an "f." the crisis at the border was entirely predictable and predicted. i predicted it last year saying if you campaign for amnesty for illegals you will get migrants at the border. that is what has happened every month since the election. principle is simple. if you let them in, more will come. that is what we see with joe biden's administration calling illegal aliens customers and changing the name of the detention center to reception centers and giving them tickets for the bus ride or plane rides and anywhere they want to go inside the country. as you said, even mexico has grown alarmed about this. mexico knows if central americans show up at the mexican southern border, that, they may seek asylum there. if they make the journey across mexico to our border they are seeking better job, better healthcare and better communities. it's understandable. but it's not what the immigration law is designed for and it's not what the american people should be asked to shoulder. >> trey: senator, when we were in the house together, you were one of the cleanings i had when i didn't understand things. i'll come to you on something i don't understand. how can you be opposed to border security? i read biden's immigration proposal, i see no border security. what is the argument against the secure border? >> senator: well, trey, us shows you how far to left joe biden and the democratic party moved. in 2013 we stopped a terrible amnesty bill that came to the house from the senate. that bill had a pretension of the border security and the workforce enforcement. joe biden's legislation doesn't have a pretension of any border security. any kind of the workforce enforcement against illegal aliens or unscrupulous employers. it's all mass migration and open borders. we shouldn't be surprised we have an unprecedented border crisis. joe biden and his administration say it's not a border crisis. maybe that is because they don't believe in border. if they don't believe in borders by definition they don't believe there could be a border crisis. >> trey: tom, it looks like there is not a ton of security at the border but there is a ton of security on capitol hill. you were a soldier. you wore the uniform. how long are we going to have a military presence on capitol hill? >> senator: yeah, joe biden and the democrats stopped to build a wall on the southern border and they put up a wall around the capitol. they care more about the own personal safety than the safety of the american people. look what happened on january 6 was a simple failure to account for the threat environment with appropriate security measures. now the reverse is happening. there are not any specific credible threats to the capitol. not that i'm aware of. i have asked repeatedly. we still have the razor wire fencing around the capitol and thousand of the national guard troops there. the director of the national guard does not believe they can continue to support that mission. the senior democrat and the republican on the armed services committee in the house said they want to see the deploy. drawn down. we need sound practices and the sound threat assessments to secure the capitol with the appropriate level of the personnel and barriers. they shouldn't permanent. if joe biden is going to give a speech to the joint session of congress in the future it would be appropriate to have security in place then. until then we don't need to turn the people's capitol to an armed fortress. >> trey: tom, you are on the senate judiciary committee. you are married to a former federal prosecutor. we have 30 seconds. are you concerned with the nominees you see coming to your committee for the d.o.j.?
