announce a special election to replace george santos in the next couple of days. it is because santos was expelled in a historic vote on friday. he joins i believe, several confederates confederate and two convicted felons. >> the only members to be kicked out, expelled from congress. c5 one of the problems, will, this expulsion is now the republicans have an even slower majority in the house. here is a breakdown of those numbers 434 members total in-house 221 republicans. 213 democrats, one vacancy. pete: the majority's to 18 are down to three if going to pass anything some really critical stuff coming on the pica. where the speaker of the house with us last hour along with the product. we asked about the border wall hrhor two they passed an impeachment inquiry. and also the vote on santos. there has been criticism this guy votes of the republican majority he is not convicted where the due process? here is what the speaker and the representative had to say earlier in the program. >> it was a regrettable day. prior to yester only five people ever been expelled from congress. three working federate's comment to her convicted of federal charges in george santos has not been convicted in a court. our party believes in the rule of law, due process and we are deeply concerned about preserving those things. ed maybe he will be convicted by a jury of his peers but that did not happen yet and that's all we had reservations about it. >> made for collins at the ethics committee report had concerns this is not befitting of a member of congress but again my concern was the lack of due process and it is a very slippery slope with this type of president is set. however the house worked we are committed to making sure we hold the seats we are very optimistic will have a strong candidate to join a republican majority in february or march. rachel: a lot good morning not just about due process but what is the priority of the house like? and to their credit both of these of control. trying to figure out there's a picture of t him with the weddig ring is trying to figure office wedding ring is leopard prints. everything is a cartoon to your point, pete. will: you do not have the defend the individual for due process that's what the speaker said this is not whether or not you expel someone from congress based on accusations and not convictions. it is not just due process. you are thwarting the will of the voter. whatever you think of santos it does not matter the voters elected him. if you're going to tell the voters you are not allowed to have your choice, then you better have a really high standard in the standard should be the rule of law. and due process. she said long island will vote for another republican, we will see if they will. that is the whole point here. you are supposed to reflect the will of the voter. rachel: i see it differently. all those points are well taken the will of the voter in his district, they voted for him. the rule of law he has not been convicted of anything but i am so frustrated by the two-tier system. i see it in the way our protesters are treated the republican protesters are treated versus liberal protesters to you see the way te fbi goes after parents and school boards and catholics and pro-lifers. and yes it all the way up to donald trump to tears of justice. and you see it in the house where you see menendez and others who do things it being protected by their party who says we are going to protect them and then republicans throwing their own guy under the bus with all of this and she brought up. i just think there are two tears of justice. they are playing into that. will: democrats in a better closing ranks appeared one of the criticisms you could have of the speaker is they did not whip on this votes. they did not try to press the members to vote to keep santos you heard them say in our interview we left it at being a conscious vote. that must've been a calculation of members to bail if you went for it and lose it looks like you do not control your caucus and you open it up. but that is the problem if you have a set of principles that you believe in as a republicans up against a power machine on the other side this issue will vote together as a block when ever we need to do what you go up against the wall. >> the speaker said they believe they have the votes to formalize the impeachment process and inquiry of joe biden. let's say that actually happens. rachel: think it will. israel hamas trading rocket fire overnight as idf continues its
