built, but they voted for it. all of a sudden trump is president, we don't want a wall. >> all right. break that down. >> well, that's not exactly what happened. many democrats, not all such as not nancy pelosi, many of them voted in 2006 under george w. bush for something called the secure fence act. as the name suggests it was for fencing, 700 miles of fencing. trump came along proposing a giant 30 or 50 or 70-foot, giant concrete barrier. so whether you think democrats are hypocrites or not i think depends on whether you see an equivalence between the secure fence act and the giant monstrosity of a wall. many democrats would say they're very different. there was one other time democrats voted for fencing, and that was during the 2013 comprehensive immigration reform debate. in that case they voted for fencing because it was part of a package that included a path to citizenship for illegal immigrants. so they were trading it off, not expressing their support for it in and of itself.

he was on the sidelines. >> although there were also some lawmakers, of course, who were relieved he was not necessarily involved in these negotiations. first of all, because he let mitch mcconnell and chuck schumer and the other senators do their work, and you know, maybe the president could have become engaged if this had gone on a little longer. but remember what chuck schumer said also, in the context of this shutdown, in the context of the immigration reform debate. negotiating with the president is like negotiating with jell-o. so i think over the past few days, we have seen sort of a shift in this narrative from the president being this great deal maker as he so effectively cast himself during the course of the campaign to this narrative that actually, he oftentimes gets in his own way in the course of trying to make these deals and in the way of republicans getting the deals they want. >> jeffrey toobin, how do you see it? >> i see this a little differently. i see the big loser here is the 800,000 people, human beings, who have lived their entire life as americans who are weeks away

that he can kind of overcome this. even if he's wrong on the substance with regards to the vast majority of latinos, who by very large margin favor comprehensive reform. what do you think of that argument? >> you know, there was some point during 2013, during the immigration reform debate, that marco rubio was saying the right thing. but he has completely shifted from those statements, including most recently being caught on video saying that he would repeal the doca and the dopa, that he would go against these things protecting these dreamers and the parents of u.s.-born kids. he has moved a very long way from where he was in june of 2013 when the u.s. senate was working together. now he is moving farther to the right. that seems to be the trump effect. that trump is moving these candidates further to the right. and even someone like rubio who might have a compelling story is going to have a very, very hard time explaining himself to latino voters on this issue that he has now abandoned. >> but does as a political

we're looking at an increase in hispanic targeted violence. the bureau of justice statistics reports hate crimes against hispanics more than tripled from 2011 to 2012 and in part, because of increased tensions around the immigration reform debate and immigration in general. that i think is probably one of the most disturbing aspects, the way this debate, which is fundamentally -- i'll be honest, emotional debate and brings people into different camps but that it would have a violent it race for a lot of americans is deep lly distressing. >> it is. we have seen this play out in different cycles before throughout this immigration debate. and when it intensifies, there's a direct correlation between the vit treeal and the appeal that some of those extremists make to the fears and to the unconscious
