other groups, other panels, other judges to go after a former president for his decisions taken while in office. >> right. this was the point that trump's lawyer returns to again and again early in his argument. he kept throwing up examples of actions democratic presidents had taken. for instance, barack obama signing off on drone strikes where civilians were killed or issues that occurred while bill clinton was in office as though he were threatening, if this is the new rule going forward, then every democratic president can expect to be prosecuted after they leave office. jose, the response to that -- it's one that the government offered -- is that presidents don't direct the criminal justice system. in fact, we live in a real rule of law world where there are a lot of procedural steps required before someone is indicted.

de-escalate it. we're not seeing that from our leadership right now. >> as a former member of the house, it seems as though threats to public officials, to elected officials are on the increase. how do you as a former congressman deal with something like that, but how do we as a society help deal with this? >> this is new territory, jose. the threat has always been there. it wasn't until i was a public official that you are the subject of some of these increased risks. this idea of swatting is new. in part because new technology allows the people who are doing it to remain anonymous. they're able to complicate the originating phone number, the voices, whatever it might be, so we haven't seen an accountability. you can argue on swatting, we need some arrests and accountability and we need to put a face to it, maybe that will reduce it. but we also need leadership to say, enough is enough. look, the vitriol and hatred

dead political horse. jose, has he got a point? >> i disagree. i think what happened on january 6th three years ago is something that people still -- they don't forget. should never be forgotten. the biggest democracy in the world and if we let somebody like donald trump come back to power we might not have a democracy. i think it's very important. at the same time i do agree that things are looking better. eight or nine months from an election. if the trend continues, inflation continues to go down, gas prices continue to go down joe biden will have a very good election night. i will say i don't think the polls today are a true reflection where voters are. we remember 2016 hillary clinton every single poll in america that hillary clinton was going to be president. they were wrong. i file this they continue to push biden is doing bad. we shouldn't worry about polls. let's run the campaign and biden should be more aggressive. i agree with obama 100%.
