consult the police. i am always advising the police are working with them. as soon as they hear that they disqualify me. there needs to be that kind of scrutiny. to emily's point, you cannot just allow anyone to waltz on them to a jury. that simple idea working with the police gets me dismissed. secondly, to dagen mcdowell's point, the lead witness is a convicted felon. everyone knew about the stormy daniels situation. so what is new year? >> harris: that is interesting as well. the porn star. >> dr. marc: yes that is not new information. the question would be new information for maybe the president wanted to protect his family. >> harris: something you said this week, the way it was logged into the financial records of his documents, the person who was accused of paying the porn star. they wrote in legal advice. what else would you write in?

a a juror that's been empaneled on the initial 12 experiences and while the alternative experience. >> so the alternate, i mean, really they should experience the same thing in terms of receiving all of the evidence and observing all of the proceedings because the purpose of the alternatives is that in any circumstance that a sitting juror can't continue to serve, and there could be a whole variety of reasons. there could be something that actually comes up like we've seen earlier in this week where someone has then dismissed that indicates the judge decides that person can't sit on the jury anymore, and you know, it could be someone talks to the media. i mean, there's a whole range of issues or it could be something personal of nature. somebody gets sick or it has a family issue, and so they just can't continue to serve. so those alternatives, particularly in this case given the scrutiny that both the prosecutors and the defense are going to give the jurors on an ongoing basis. i think these alternates are so important they might wind up getting called a fairly quickly care record arrow. thanks so much for the analysis. appreciate it. jessica.

>> i mean, this is multiple violations i think a judge, the magic number in manhattan is probably two or three at a judge will kind of let someone get along the line, but this has multiple multiple violations. and i don't think donald trump would really care if he was fine. what's the difference? it's worth its weight in gold then publicity just to get these statements out, to get a couple of thousand dollars a hit f9 from the judge. judges have put people in jail for contempt of course. but that's not going to happen here. it's unlikely. i mean, that would just bring extra scrutiny onto the judge in the middle of the trial. i don't think that's really let's stick. but there has to be some way to stop donald trump from doing this and respect the process the trial process and if any judge is capable of coming up with a formula for that, i believe it's judged more, sean, he is such a no-nonsense judge who

out of some that underscores that these aren't just kind of random unnamed individuals. these are real people and this is something that you can't even fathom unless you're one of those jurors, how does that affect this case here it's it's really problematic and i've said multiple times there's the donald trump who was the innocent until proven guilty. >> and if proven guilty beyond reasonable doubt in that courtroom. and deserves the same due process and the same presumption of innocence at any one of us have. and then there's a donald trump outside that courtroom who says a lot of very vitriolic and frightening and aggressive things that gives pause. be very gentle and nice. the potential jurors. we know that about the judge we know that about prosecutors and witnesses, and it has a really negative and frightening impact on those potential jurors who are scared potentially to say, i don't want to be a part of this problem i says, i don't want to be subject to scrutiny. i don't want the media talking about me and my family. i don't want people showing up at my house or saying things about me online. so it's very again, i use the term frightening repeatedly because it has a way to taint the jury. it's not good for the jury to

thought it would take longer to pick a jury in state court, but i admire the way he handled it. >> he's moved it along quickly, which is probably the right thing to do in this particular case. the longer it takes, the longer people are going to have second thoughts. it's good to get the jury is seated and sworn. i think he did it fairly in every way and i don't think it was overly fast. i think it was thorough, it carefully planned. a good questionnaire. the lawyers had time to ask their questions. so while it was faster than i expected, i don't think he was railroaded and i don't think it's too fast. >> as you know, judge, there's been a lot of scrutiny over juror number 11, who said she doesn't like trump's persona, that she thinks he seems very selfish and self-serving direct quotes. were you surprised that judge merchan didn't dismiss her? would you have done so in his shoes? >> i probably would have dismissed or i think there was

commentator jim schult. jim, great to have you here with us. i just want to get your reaction first two now to jurors having been excused and this what what should we make of that? >> look, this is part of the process, right? there's going to be tremendous scrutiny by both sides looking at these potential jurors. and there are gonna be issues that come up and the judge and the lawyers are dealing with it in the normal course, like they do. right? you heard that there was a little bit of a chuckle at at the at the bench with the potential juror and the lawyers related to it there was an issue years ago was stealing yard signs that only that only brings in political implications and maybe where that person stands politically and what they're politically political views are. but also potential crime that or accused of a crime at that point in time. so i think these are all normal issues we're going to see. they could blow through these pretty quickly today, just like they did the other day. get to that magic number 18, but they have a little more work to do. there's a shoeless yours. >> yeah, it's just going to take it's just going to take some time. i'm also curious
