of it, santa, of course, flying on the tower. when i set up my trains as a child and even currently, one by one, i'd put them together. and at first, the first four times they'd go across and then, of course, there would be a problem with the track, i'd fix the track. the problem with the train, i'd fix the train and then we'd kick into the track and by christmas day, no one cares about the trains anymore. >> that's how you learned how to problem solve in life. >> yes. i quit! >> speaking of having to know how to take on big tasks and issues, how about the candidates last night during the debate? >> ok, that's good. you can turn it down a little bit. >> right. >> as i'm screaming. here it was in sioux city, iowa, the last debate, now before we can go back to our golf voices. before the voting takes place early january in iowa and did mitt romney go after newt gingrich as he has done recently with his pundits and himself calling him zany, calling him unelectable? nope, he took on a different guy. >> 2008, the american public were convinced by barack obama that they needed someone to believe in that they could believe in. we now understand that what we need is some president who believes in them. >> if there's ever been a greater example of on-the-job training, this is it. >> we are getting screwed as americans. our president thinks america is in decline. it is if he's president. it's not if i'm president. this is going to be an american history. >> when you have a president who is too busy running for re-election, the constitution can't work oochlt . >> the whole way this thing went down, there was so little confrontati confrontation. we'll see bachmann and gingrich, i understand that. january 3rd is upon us and newt gingrich who had a double digit lead a week ago in three polls are in a dead heat with mitt romney or dead even with ron paul. he had to come in here with a different strategy. he's staying here with the strategy with not attacking. not only is he staying with it, he apologized on an iowa morning show for going at mitt romney, i give round one to mitt. i shouldn't have said that. >> that's so smart. why did you see mitt romney last night not attacking? a lot of pundits said maybe that wasn't the right thing to do. rudy giuliani said it was wrong to call newt gingrich zany. did he listen to that? then you saw a tamer mitt romney on the stage last night. >> i think that the -- if the idea was on team romney's side to make mitt romney look presidential, then they should give themselves a christmas bonus because they certainly did achieve that but then at the same time, you have newt gingrich who was much tamer, much calmer and much complimentary as he'd been in earlier debates. people like that. there was, however, confrontation in the second tier people, in particular, michelle bachmann acted as prosecutor and took newt to task over fannie and freddie and abortion. if you missed it, here it is. >> we know he cashed paychecks from freddie mac. over $1.6 million and frankly, i am shocked listening to the former speaker of the house because he's defending the continuing practice of freddie mac and fannie mae. >> what she just said is factually not true. i never lobbied under any circumstance. i never went in and suggested in any way that we do this. >> one of the concerns that i had is when speaker gingrich was speaker of the house, he had an opportunity to defund planned parenthood and he chose not to take it. that's a big issue and i think also more troubling when he was in washington, d.c., he made an affirmative statement that he would not only support but he would campaign for republicans who were in support of the barbaric procedure known as partial birth abortion. i could never do that. >> sometimes congresswoman bachmann doesn't get her facts very accurate. i had a 98.5% right to life voting record in 20 years. >> i think it's outrageous to continue to say over and over through the debates that i don't have my facts right when as a matter of fact i do. i'm a serious candidate for president of the united states and my facts are accurate. >> strong debate performance. >> she did. >> a lot of analysts agreed with that and then they went toe to toe on this. she needs the conservative vote in iowa. she needs it! this is almost everything for michelle bachmann in iowa. >> sure, she was talking about getting her facts straight. according to politifact, they did some fact checking and regarding what she was talking about with newt gingrich on abortion, bachmann was right regarding planned parenthood and partial birth abortion. however, when she said we didn't play this snippet of it, that she said everything i said at the last debate about newt and fannie and freddie was true. politifact came out and said she was not completely accurate in the previous debate and had not said that on december 10th in des moines so she deemed that false. we were looking at the fact check earlier regarding newt gingrich and fannie and freddie, whether or not he had taken money and lobbied. we just heard him say he had never lobbied for anybody but according to the washington examiner, his firm was a paid consultant to astra zeneca so they say that claim is false. >> paid consultant as opposed to a lobbyist. what i thought last night overall is that michelle bachmann was extremely strong when she had to be. if her campaign ends tomorrow, you'll have a hard time sidelining her as an also candidate. she knows conservative thought whether you agree with her or not, she knows where she's going on all these issues. she's taking on the best of the best in foreign policy with her own opinion and was taking on -- took santorum's place taking on ron paul. >> for so long, we've called john mccain the maverick. this is something her campaign should have thought about for her. she has stuck to her ground as i look at all the candidates, you don't hear much flip-flopping about michelle bachmann. you may not agree with her position. she's a maverick in many ways because she's kind of out there on her own defending her positions and i think she did a great job last night. >> and you know what? >> didn't go rowing. -- rogue. >> she could take maverick. >> that's right. already taken. and when it comes to newt gingrich, when he was talking about out of control judges and the courts, he was historical. he was accurate. he was brilliant. the crowd there in sioux city really ate it up. now that we're doing the post-game show, who do you think won? >> thank you very much. she is the highest ranking african-american woman in the u.s. army. and she's the first african-american woman to serve as major general of the u.s. army reserve. i'm joined this morning by major general marsha anderson. so great to have you. thank you so much. >> thank you for having me and congratulations. >> thank you. >> it's interesting if you look back on your personal story, you were a shy, young woman. what was it about that part of your personality that changed by joining the military? >> the military puts you in leadership roles very, very early. and they provide you with the tools so you can be successful. so i wasn't really -- i was very shy. but i think they gave me the tools to overcome that. and they also made me accountable very early on so i really wanted -- i was motivated to excel and to make the people that had put me in those positions, to make them feel as though they were right for making that decision. >> so interesting, too, because you got into the military by chance. it wasn't something that you always dreamed of doing even though your father serveed in the military. how did it happen? >> that's very true. very serendipitous. i was registering for college classes back in the old days when you had to go to a gym and stand in line. and i needed a science credit and i was casting around looking for something that would fit into my schedule and i saw a sign that said "reserve officer training corps military science department." and i went over and asked, is this really a science credit? the gentleman at the table, i later found out he was a sergeant said absolutely and it was four credits. i said sign me up on the spot. >> that was rotc. >> if you look at our young people and what you can learn from our generation, some people look at the military and say it's a little bit lost and there's a high unemployment rate. is this a career you'd advise for young people? >> it's a great career. what it brings for young people, it encourages them to excel and teaches them about team work. if you're motivated in any way, you'll find something in the military to do. too often people think of the military of people who are in combat. we have individuals in the medical field, in the logistics field, in science and technology, military intelligence, communications, so there are a wide array of areas that people can explore. >> this week, we've been talking about the end of the war in iraq. after nine years, those troops will be home for christmas. as a member of the military yourself, what types of emotions do you go through this week watching this? >> like everybody else, i'm glad they're coming home and i think it's important they honor their sacrifice by ensuring they have employment opportunities and educational opportunities when they return. one of the initiatives that the army reserve leader, chief of the army reserve started several years ago was an employer partnership initiative and that is employers who commit to hiring a veteran. over 2600, many of them fortune 500 employers have committed to hire veterans. i would encourage your viewers to check out that information on our web site. >> and we have had many of those employers here on this show trying to get veterans jobs. i know, i'm just very sad to see this latest stat for female veterans. the unemployment rate is so much higher, it's 18.7%. why? >> well, about 30% of the army reserve is between the ages of 18 and 24. so that's the demographic that we know has a high unemployment rate. so as i referred to earlier, it's really important as those individuals return that thank those individuals for their service but also hire a vet. >> you're a great role model. major general marsha anderson, thank you very much for being here. she's from wisconsin so i'll say she's a green bay packers fan. >> i'll say yes to that. >> it was a little hesitant. good to know, i'm a vikings fan and the packers are doing way better this year. major general, great to see you. >> thank you very much. >> coming up on the show, rick perry channelling tim tebow? >> the cops showed up but let him go. >> i don't do that flume ride anymore. >> you don't do that? >> the log flume? >> the log flume is too scary for me. i can't imagine that thing. >> that's why i'm doing that tuesday. they told me just to go over the edge. >> i'm doing it this afternoon. >> fantastic. hey, forget about running in the hallways. two high school athletes in new york were suspended for tebowing. it started out with just a few students striking the quarterback's iconic prayer pose after a big play or touchdown. it grew to 25 students tebowing in the hallway over in riverhead, long island, when the group's ring leaders tyler and connor were sent to the principal's office and given a one-day suspension each. they're now appealing the punishment. >> just did it to honor tim tebow. seemed like a cool thing to do. he's a leader on every aspect on the field. i don't think that we did anything that warranted a suspension. >> all the things 17-year-olds can be doing, this is not something to be concerned about. school officials say the suspensions were warranted because the boys were warned several times not to block traffic in the hallways so they got 40 guys together and they all did that, most of the guys on the football team. that's a quick look at what's happening in the tebow and high school world. let's talk about the rest of the sports world. a two month investigation found there was no sole cause that led to the death of two time indy 500 winner dan wheldon. indy officials say the 15 car pile-up was a perfect storm of events. however, wheldon ultimately died from a head injury apparently days before the accident, wheldon and other drivers expressed safety concerns about the las vegas tracks because of its oval shape. >> football now, they're playing on thursday nights. the atlanta falcons one step closer to securing the nfc west wild card spotted after last night's big win over the jaguars. quarterback matt ryan starting things off right. julio jones open drive. jones goes for 29 yards and the score. second quarter now. ryan again. this time to roddie white into the back of the end zone. we're up 27-0 at the half. third quarter, you'll see ryan and roddie white again. jags never recovered. the falcons go on to win 41-14. coming up a little later on radio, we'll have geraldo rivera joining us in those three hours. we're talking about the debate like we are right now. let's go over to steve. steve is with? >> the company started in 1900. a guy by the name of joshua lionel cowan right here in the city invented electric trains so what happened is as christmas went along, people wanted to add animation to the tree. so they took their lionel train set and put it around the bottom of the tree and created animation. it became an american tradition to do that. so now christmas and lionel go together. >> that makes perfect sense. we have a couple of -- they're called starter trains. >> yeah, these are what we call ready to run starter trains. >> we just saw thomas the tank engine. >> thomas is so popular. it has its own tv program. so the little kids really love thomas the tank. >> all right. now this one right here -- >> this is polar express. >> yeah, this is polar express right here. >> it's going right there. >> right there with the lighted cars. steve, this is the -- i want you to feel this. feel the quality and the weight that's in that locomotive. >> what's that weigh? about 10 pounds? >> yeah. that's why they last from generation to generation and they're passed down from one family to the next family. >> when i was a little boy, we had some trains and i remember once my mom bought a -- not a lionel set but i was always afraid that we were going to wind up getting a shock. good thing about these trains is it's absolutely practically impossible to do that. >> yeah, they last forever and the nice thing about it, all of these train sets that you see here and the other one that we have are ready to run. they all come in one box. everything is in a box. the track is easy to snap together and you can expand it. you can add cars. you can add tracks and as you can see from this layout, there's no end to the creativity that you can do when you have model trains. >> we have had a train that runs around our christmas tree for many, many years and the thing is they cost a couple hundred bucks but you'll have it for generations and you can hand it down to your kids. >> absolutely. that's the beautiful part about the lionel trains. >> thank you very much. >> you're very welcome, steve. thanks for having us. >> very, very nice. which switch do you they to turn them off? have a problem with that. let's talk about the debate last night. did you watch it because it was the last one before the iowa caucus on january 3rd . the frontrunners decided to focus on president obama. many thought mitt romney would come out and attack newt gingrich as he has in the last week in the press calling him zany and unelectable but that didn't really happen last night. >> yeah. >> in 2008, the american public were convinced by barack obama that they needed someone to believe in, that they could belie belie believe in. we now understand we need a president that believes in them. >> if there's been a greater example of on-the-job training, this is it. >> we are getting screwed as americans! our president thinks america is in decline. it is if he's president. it's not if i'm president. this is going to be an american century. >> you have a radical who is a campaigner-in-chief who doesn't do the job as president because he's too busy to run for re-election, the constitution didn't work. >> he had trouble, newt gingrich with a few things. his relationship with fannie and freddie. for the most part, i was shocked, i told you this morning, i would have put $10,000 of mitt romney's money on the fact that mitt romney would have taken on newt gingrich directly. why else would he have laid the groundwork monday, tuesday and wednesday with saying he has no idea about the economy, saying newt gingrich can't be counted on. he's erratic and everything else and he used the term zany. when he came down to sitting shoulder to shoulder, he did nothing. i wonder if that could be pawlentesque in refusing to take on the guy when you see the guy. >> there was a poll that came out yesterday, a rasmussen poll that showed despite the fact that we heard that newt was way ahead in iowa, the rasmussen poll shows that mitt romney has 23%. newt has 20 and ron paul has 18. that makes no sense to me, by the way. >> maybe what was going on, the campaign just said, we don't know what's going on. let's play it safe. that's what they did. newt himself said i'm doing a lot of self-editing over here. i don't want to be zany. we were kind of expecting maybe mitt romney was going to go ahead and hit him upside the head. he did not do that. however, michelle bachmann did. there was a duel over two issues, abortion and money that newt gingrich's company had taken regarding freddie mac. listen. >> we know that he cashed paychecks from freddie mac. that's the best evidence that you can have. over $1.6 million and frankly, i am shocked listening to the former speaker of the house because he's defending the continuing practice of freddie mac and fannie mae. >> what she said is factually untrue. i never went in and suggested in any way that we do this. >> one of the concerns that i had is when speaker gingrich was speaker of the house, he had an opportunity to defund planned parenthood and he chose not to take it. that's a big issue and also, i think even more troubling, when he was in washington, d.c., he made an affirmative statement that he would not only support but he would campaign for republicans who were in support of the barbaric procedure known as partial birth abortion. i could never do that. >> sometimes, congresswoman bachmann doesn't get her facts very accurate. i had a 98.5% right to life voting record in 20 years. >> i think it's outrageous that -- to continue to say over and over through the debates that i don't have my facts right. when as a matter of fact, i do. i'm a serious candidate for president of the united states and my facts are accurate. >> i think it's dangerous for newt gingrich to continue to say that about michelle bachmann. you got to be careful with the female voters out there that you don't cross over that line of keep saying that a woman doesn't know her facts. that's point number one. on the flip side, newt gingrich has an answer for everything. newt gingrich has an answer when people attack him. he has an answer about how to solve america. he has an answer about how to solve social security and how to solve the economy. so, you know, i think they both did really well last night in this debate and back to mitt romney for a minute. that fair and safe kind of way of handling the debate, i just don't know if that gets you noticed again. one of the things he needs to do is get noticed and being fair and playing it safe, not -- >> after you watched him. >> absolutely. >> he looked calmer and much more presidential but i was surprised to see the difference in tone from monday to thursday. i'd like to bring something else up, the iowa public television station that interviewed newt gingrich in the morning should have given us an indication he wasn't going to be fighting this time. he says i regret taking a shot at mitt, he said, it was foolish on my part. he had taken one more shot at me and he knew he wasn't -- he knew it wasn't true, made an assertion, he knew that was absurd but it violated all the core principles i have in terms of trying to stay positive despite temptation. >> we heard in that sound bite montage where newt said i never lobbied under any circumstances. that is absolutely false, according to fact check. they talk about how "the washington examiner" says that newt visited some republican congressmen to convince them to support a bill expanding medicare including prescription drug subsidies when newt was being paid by astra zeneca and pfizer so for him to say i've never lobbied on behalf of anybody under any circumstances, that, in utah putting his own life on the line to comfort a woman trapped under a city bus. officer kevin peck crawled under the bus after seeing the woman's tennis shoes sticking out and the woman was severely injured but officer peck was able to hold her hand and distract her from the pain and from looking down at her leg until the paramedics arrived. the woman is now in the hospital. she's expected to make a full recovery. when i saw that photo this morning, i thought to myself what better time than during the christmas spirit and christmas holidays to be having a guy do something like joining us right now is the governor of the great state of south carolina, niki haley. good morning to you, governor. >> good morning. it's a great day in south carolina. >> is today the day you throw your hat in -- you know, your support behind jon huntsman? >> today is the day that i am throwing all of my support behind mitt romney for president. >> why? >> you know, this was something that when i look at the focus of what every family cares about, it's jobs, the economy and spending. and what i want is someone who is not part of the chaos that is washington. what i wanted was someone who knew what it was like to turn broken companies around and someone who had proven results by improving a failed olympics that ended up being a great success story and someone that knows what it's like to make a decision and lead, not just make a vote and mitt romney is that person. and i think now more than ever, we need someone that has the leadership to deal with a broken washington in a way that we can get things done. and as governor of massachusetts, you know, what we saw is he balanced his budget and he cut taxes 19 times with an 85% controlled democrat legislature. that says a lot and something that we need from a good conservative governor at this time. >> you're known as a good conservative. and you'll also know that the fact that newt gingrich is winning big in your state by double figures. in fact, in a recent nationwide poll, newt gingrich leads mitt romney by 20 points on the question of who is the better conservative and who is the true conservative? mitt has the lead when it comes to liberals and moderates. why do you believe the public perception is off? >> yeah, i don't think public perception is off and, you know, one of the things i think that the public is doing, especially the people of south carolina is they put a lot of thought into how they're going to do this. what i know is this is -- you know, we can nit-pick issues all day and i think that's what we've seen through the debates, what it comes down to is how do we get every person a job? how do we make sure our economy is back on track? the only way we're going to do that is do it with somebody that's done it. not talk about it. when i look at mitt romney and see those companies that turned around, see that he's took the olympics and made them a pride for this country, it makes a big difference but it's not -- it's easy to vote and i can say that because us a legislator and now i'm a governor. making a vote is one thing. making a decision and getting something passed and done is very different. it's that leadership that we need and it's that courage that we need and i'll also tell you, my husband michael is in the military and right now, military actions are very, very important. mitt romney knows we have to strengthen our military in a time that this president has done nothing but tried to weaken it. >> south carolina, the primary there is january 21st. and if you look at the past history, south carolina, whoever wins has a pretty good track record. how many of the candidates came to you and lobbied hard for your endorsement? >> i think we spoke with every candidate except for ron paul. i think that was -- and it was just because ron paul never made the call. but every other candidate we spoke to and what i will tell you is you put all those candidates together and you've got one perfect candidate. but you're never going to have a perfect candidate so what you do is you look at the times of the day, you look at what we need in the country and you say let's get on track. let's get behind the person and let's make this happen and what lets me know on top of that and the bonus of all this that this is right, governor romney is the one candidate that president obama tries to hit and get out of the way. that lets me know he's scared of him and lets me know governor romney has a good fight in him and that's the way that president obama doesn't want to have to go against. >> governor, i'm sure you were watching the former governor there at the debate last night in sioux city, iowa. you know, we have known for a long time he's been very successful in business but interestingly enough, we got a soundbite where he admits that he hasn't always made the right decision. listen to this. >> i understand, by the way from my successes and failures what it's going to take to put americans back to work. i remember when the founders of jet blue came to me and said invest in us. i said that will never work. kind of wrong. >> just a little wrong on that. what did you think about his performance and the performance of newt gingrich last night? >> i thought he was incredibly strong. and when someone can go and say that they've learned from mistakes and successes, that's someone that's ready to lead. you know, we're dealing with the president now that refuses to admit that he's ever done anything wrong. that there's -- that there is any need for improvement. this is a former governor that knows what it's like to deal with challenges but also get things done and when you don't get it right, you say how do we make it better? >> no, it's still -- i mean, it's colder but still not cold enough yet. >> you can take a couple much weeks, it will probably be about that time, you know? i don't know. upstate new york kid. yeah, yeah. it's getting there. but it's not there yet. more to the point of the live shot was the debate last night which was noted last night and again this morning for its civility. the seven candidates up on stage who had knocked each other around in a number of debates and most recently last saturday spent a lot of time being nice and looking presidential. >> president obama we have to be talking about. he's unveiled himself as president that's not the right person to lead this country. >> i sometimes get accused of using language that's too strong so i've been standing here editing. and i'm very concerned about not appearing to be zany. >> now, if there was an aggressor in the debate, it seems to have been congresswoman michelle bachmann who went after newt gingrich on a couple of different -- couple of different instan -- instances and once it was ron paul and exchange with iran, let's listen. >> carelessly flouting it and starting these wars so often. >> the problem would be the greatest underreaction in world history if we have an avowed mad man who uses that nuclear weapon to wipe nations off the face of the earth. >> again, bachmann clearly the aggressor. the question for bachmann in a campaign is how well that performance is greeted by iowa voters who generally don't like negative campaigning. they'll tell you they don't like negative campaigning and it was in sharp contrast with the rest of the performances on the debate last night. back to you folks in new york. >> good point. >> thanks very much, steve. >> and ratings should be in. i think it's going to be extremely high. neil cavuto was on there for the first time. he looked good. did fantastic. >> now to the rest of your headlines. brand new video out of seattle that shows a violent clash between police and occupy protesters. watch closely, this all unfolded on monday night. you can see the brick being thrown at police and then from somewhere in the crowd, a flare came flying at the officers. seattle police say bags of paint and steel bars were also thrown at them. 11 protesters were arrested. they claim police used unnecessary force but the police department is standing by the officers saying they were in danger and those are the protesters on the front cover of "time" magazine. >> celebrate, guys. good job, making everybody proud. america's toughest year, firing back at the justice department. the justice department releasing a scathing report accusing him of civil rights violations against illegal immigrants. he defended his record and he says the accusations are nothing but a politically motivated smear campaign. >> let's keep talking about it and get something done in washington and congress. and resolve this problem. but don't come here and use me as the whipping boy for a national, international problem. the department of homeland security is banning his deputies from questioning inmates about their immigration status. that's a show down. >> i heard about that. meanwhile, take a look at the snow piling up in the state of arizona. look at that. this new video is from flagstaff. plows are out in force after the latest winter storm dumped 17 inches over the last two days. average high in flagstaff is supposed to be in the 40's and the 50's this time of year. but as you can see, it's beginning to look a lot like they had a blizzard. call it an early christmas visit from santa's reindeer. instead of taking over the skies, they were spotted wandering a highway in texas. that's where they were. they took off down a busy road after a trailer they were riding in became unhitched. police say they were flooded with phone calls but didn't take them seriously at first. >> 49 -- 911, what is the address of the emergency? >> yeah. >> tell me about this one. >> bagel is a seizure dog from a puppy mill. unfortunately, his little tongue sticks out because they didn't do anything with his teeth. they had them all pulled out. he's super, super sweet. he's a senior but still has lots of life in him. >> that's a lot of shakes for dinner and smoothies. >> tell me about smokey. >> smokey is the same. he came also from a puppy mill. >> have teeth? >> yeah, he has teeth. >> got teeth. all right. >> only about 8 months old so he wasn't there that long. >> yeah, he looks like a puppy. >> yeah, he is. he's a good puppy. >> and that -- he's also available. >> yes. >> there's something to keep in mind that you just told me in the break is that a lot of people on an impulse buy will go out and get a puppy as a pet which is great on christmas day but the next day what happens? >> uh-huh. sometimes they -- the newness wears off really fast. there's a lot of chaos at christmas and everybody wants a puppy. but sometimes they regret it later. so we ask that maybe you get a -- think about what kind of puppy you want or an adult dog. a lot of people always want a puppy and there's plenty of adults and seniors in shelters. but that you plan ahead. you get a certificate to a shelter. and then you let -- you give your children like the card at one of the big pet stores and they buy all the things ahead of time and they have those for christmas and afterwards, they go out and pick up their dog. >> ok. how do the dogs feel about wearing these outfits? >> absolutely, yeah. on our composite, you'll see a plus and average as a more true composite in all polls. you'll see more of a gap in our composite than something like the rear clear average because we like to weigh more heavily the polls that take into account the likely voters so that's why you'll see newt with a little healthier lead than some of the other averages but clearly you're seeing a little bit of a shrinkage in the lead. he's still the number one horse. everybody would agree with that. romney obviously in the number two spot and thank you, ron paul people. you can lay off the hate e-mail this week. no empty rider in the third spot, ron paul is the number three horse. no doubt about it. >> real quickly, what did you think about the fact that newt and mitt, your top two horses in your derby pretty much played it safe last night? >> yeah, i thought that was pretty interesting. romney was pretty smooth. i heard frank luntz say he thought it was one of romney's best debates. i didn't see any major punches thrown. what people are talking about the most are rick perry's tim tebow line when he sort of made everybody cringe just a little bit. i didn't think any major purg punches were thrown. it was a nice debate. >> you mentioned rick perry. let's go to the second tier of candidates in political derby and we've got rick perry in the first position on the blue horse and then he is followed by bachmann and then santorum. all right. why do you have perry on top? >> well, it's really, really close. the editors of political derby, scott and fountain and kaiser and myself, we've been debating this for the last couple of days who is really up between perry and bachmann? [ male announcer ] for unsurpassed fru and veggie nutrition... v8 v-fusion. could've had a v8. >> answer to the question of the day, lot of you got it right. it was benjamin bratt but the winner is mike in pennsylvania. congratulations. now to a story we first shared with you yesterday. following 9/11, lieutenant lario pentano rejoined the marines to fight in the war on terror but after being deployed to iraq in 2004, he was falsely accused of murdering two iraqi insurgents much the army claimed he shot the insurgents in the back but he insisted it was self-defense. yesterday on "fox & friends", he joined us to share his story. >> he suggested i executed prisoners which is not what happened. i was defending myself but the point is without autopsy evidence, there was no way to know for sure. >> a year after being charged, the lieutenant got his autopsy and was eventually cleared thanks in part to our next guest. dr. william rodriguez is a former forensic anthropologist and urged them to dig deeper into the case. good morning. >> good morning. >> what did you do? one of the first things you w t wanted to do was exhume the bodies. was that tough for you to pursue? >> i had been watching some of the news coverage not only on television but in the magazines and newspapers about the lieutenant's case and i thought it was very erroneous to charge him just on the word of a single individual without actually looking at the forensic evidence. and i thought to myself that these bodies need to be exhumed and expressed this to my colleagues and those individuals of the investigative field particularly that of the naval criminal investigative service. >> it turns out that the one witness who said that he had shot these two insurgents in the back was a disgruntled employee who he told us yesterday that he had had to fire prior to that. but they went with his word. anyway, when you get the bodies out, what do you find? >> well, when i had the bodies when they were exhumed by ncis, we got them approximately about a year later, they were in advance stage of decomposition but by looking at the forensic evidence, i was able to determine that the story told by the lieutenant was correct. they had been shot from the front. they were facing so we saw that all of the evidence we saw evidence of the gunshot wounds that were coming from the front of the body or anterior going to the back so they were not shot in the back. they were shot as he was facing them. >> you know, doctor, it seems like that would be one of the first things someone would do in a criminal case. wouldn't they hire somebody like you and find out, hey, were they shot in the back or in the front? >> you would typically see that in certainly a civilian case but i think what happened in the heat of war, this was right after abu ghraib. nerves were very raw in iraq with the iraqi populations and here in the u.s. there certainly was a heightened sense to hold people responsible if there were crimes committed. >> i know you believe now that the lieutenant is a patriot? >> he certainly is. after seeing -- reading his book and i wrote him a letter this past spring thanking him for his patriotism, his services in the military, and his personal sacrifices that he encountered not only during his marines stint but also at home afterwards. >> right. >> and i was very inspired by his book and we got to talk with each other and have become very good friends. >> nice to know. dr. william rodriguez, the forens forensic anthropologist who broke this case wide open. good to chat with you this morning. >> thank you. >> they're on their way. soldiers heading home for christmas. geraldo is with them. we'll check in live at the top of the hour. nick lachey has come a long ways since the days of 98 degrees and now he's considering a career in morning tv? first he's stopping by the curvy couch after he gets done reading the newspaper. before what is break, they have to reach an agreement on how to pay for the payroll tax cut and unemployment benefits. those expire on december 31. incredible new pictures from the top of one world trade center. it's known as a freedom tower in new york city. it reached 90 story this is week, leaving just 14 more to go. it's covered in glass all the way up to the 65th floor and the concrete floors have been built up to the 82nd floor. the building should be finished by the end of 2013. about half of the tower's 13 million square feet of office space has been leased so far. those are your headlines for friday. >> steve: beautiful. the headline last night was the live from sioux city, iowa, it was the gop debate. as you can see, the candidates were on the stage making their final argument. mitt romney did a fine job. he was very straightforward. michelle bachmann, she essentially was a prosecutor with newt gingrich and she really did hold his feet to the fire with some things that she felt that he had said in the past, which were incorrect, she said. >> brian: there was a lot of congressman ron paul, more than any other debate. they kept coming back to him and just when he started to make some sense, then he would make nonsense by talking about iran, our foreign policy, what we should do. that's when he becomes a side show. when he talks about politics and sovereignty, when he talks about economics, certain things he says economically that's resonating. i think he'll be a factor in iowa. but i was shocked how much he talked last night. >> gretchen: the interesting thing from this harvard study that came out yesterday, a lot of disaffected liberals, young people who voted for president obama may now be in ron paul's camp. what would that mean moving forward? is he a serious contender, at least in iowa? let's talk a little bit about what candidates didn't do last night. a lot of people expected mitt romney to come out swinging against newt gingrich because for the past week, that's what he's been doing in the press. he called him zany, unelectable. he called him a very wealthy man, just like he is. well, last night he didn't do that, guys, and i was pretty surprised that he didn't. he got a -- you got to wonder if he saw maybe some of the reaction from other people who have been commenting on the negative take and maybe he thought we shouldn't do this, or there is a new poll out now in iowa that shows that mitt romney is ahead of newt gingrich. so maybe he felt like he didn't have to do the attacks. >> steve: plus, maybe it's the fact that the people of iowa didn't like the negative stuff. when we saw newt gingrich and mitt romney going at it the week before, it was tough to take for a lot of people in iowa, at least it's when some of our e-mailers have said. >> brian: here is the problem with your theory, ron paul did the negative ads on newt gingrich. he sunk examine paul came up. rodney it attacking, but maybe their analysis showed that wasn't the reason he moved up. >> steve: you got to figure if this is the new tack going into iowa, mitt romney, his camp will continue to make attacks on newt gingrich, but done by surrogates. they'll do the dirty work while mitt romney takes on the president. >> brian: the governor of iowa, he thinks that -- he questions whether he has the discipline and focus to get the nomination. >> gretchen: it could be. but newt has come under a lot of attack from former members of congress and other elected officials and i did feel like he had an answer to every single attack last night. it's something that he is good at. so what did you think about it? let us know. you can e-mail us or twitter as well. >> steve: we were talking earlier about some of the fact checking that went on and we hadn't mentioned mitt romney, at one point last night he said that mitt did, he had created tens of thousands of jobs and when fact check looked at his record when he was at bain capitol, they were an investor in staples which created 90,000 jobs, so there had been some layoffs at some of the other k but according to fact check that, comment on mr. romney's part, mostly right. >> brian: that was mostly right. he said yesterday in a humble fashion, people use this term, he doesn't connect. there is something about mitt romney that doesn't connect. he's too good looking, too perfect. but one thing i found in my amateur psychology days, is that if you can talk about your own vulnerabilities, you can talk about stuff you've done wrong, people can relate to you better. don't you think a has a lot to do with the sound bite with him talking about jetblue. sometimes i make mistakes and sometimes i miss opportunities. for example, when jetblue came up to me and asked me for an investment, i said, that will never work. and he did not make money on it. >> gretchen: the war in iraq is over and thousands of u.s. troops are now heading home from iraq just in time for christmas. first stop, camp virginia in kuwait. geraldo rivera is there with them and he joins us live. good morning. good afternoon, geraldo. >> hi, gretchen, steve, and brian. a couple of blackhawk helicopters have just landed here. if you hear the sound track, that's why. over a million g.i.s, you guys, you know, have come through iraq over the eight years and nine months of this bloody conflict and over the next several days, i can't say exactly when, all of our combat troops will have been successfully withdrawn from that bloody conflict. what about their vehicles, what about those tanks and armored cars and humvees and all the rest of that logistics that helped support this long war? they're going home, too, or going to afghanistan, or they're going to the junk heap. we saw that operation, tens of thousands of them will be shipped before the end of march 2012. as that operation continues, i'd like to you meet the man who is the spokesperson for all our forces in iraq, he's major general jeffrey buchanan. we've got blackhawks in the background, general, but let me just ask you about this withdrawal. it seems to have been extremely successful. i haven't heard of any casualties. is it the enemy just letting us leave? >> it's been very successful. but it's because we focused on planning every one of these movements. it's a deliberate operation. we take force protection very seriously and our troops are doing an exceptional job. >> is this a bittersweet moment for you? here we're leaving after almost nine years, 4,487 deaths, 0 odd -- 30 odd thank you casualties -- thousand casualties. did we win this war? >> we'll have to have the benefit of history looking backwards. right now looking at it today, i can't help but be inspired. i served many years in iraq. i can't help but be inspired by their tremendous progress. they have a lot of opportunities. but all of those opportunities have come because of the great amount of sacrifice. my greatest hope is that they take advantage of the opportunity that they have. >> you and i ran into each other, bloody triangle, ramadi. they've come a long way since then. i remember how inspired i was when i saw them sewed voting. will -- them voting. will their democracy come together? does that make sense? 11 protesters were arrested. they claim police used unnecessary force, but the police department is standing by the officer, saying excuse me, did you see the bricks? >> steve: no kidding. take a look at this. as we look at the weather on this friday, that is arizona and that is snow, a lot of it. location, flagstaff, arizona. the plows are out in force after the latest winter storm dumped 17 inches over that location in just 48 hours. the average high in flagstaff, supposed to be in the 40s and 50s. this time of year, but as you can see, it's beginning to look a lot like the week before christmas. but in minute money, not arizona. >> gretchen: forget about running the hallways, two high school athletes in new york suspended for tebowing. you can see it started out with just a few students. here they are. striking the quarterback's prayer pose. then it grew to 25 students, tebowing in the hallway. that's when the ring leaders, conner and tyler were sent to the principal's post office given one day suspension. imagine what else they could have been doing, like smoke in the bathroom or something. anyway, they're appealing the punishment. >> just did it to honor tim tebow. seemed like the cool thing to do. he's a leader in every aspect on the field. >> i don't think we did anything that warranted a suspension. >> gretchen: school officials say the suspensions were warranted because the boys were warned several times not to block the hallways. >> brian: it was a big night for the gop presidential candidates and now more news. a short time ago, south carolina governor nikki haley joined us as i mentioned about an hour ago to be exact, with a major announcement. >> today is the day that i am throwing all of my support behind mitt romney for president. what i want is someone who is not part of the chaos that is washington. what i wanted was someone who knew what it was like to turn broken companies around, someone that knows what it's like to make a decision and lead. not just make a vote. >> brian: governor haley was elected in 2010 with help from the tea party. south carolina, of course, a critical state for conservative republicans and newt with a huge lead currently. >> steve: we thank the governor for making the announcement right here. what did happen last night? steve brown is live there with the post-game show. hello, steven. >> hey, steve, gretchen, brian, good morning. yes, the debate was notable for its midwestern niceness by most accounts. much of the debate had a friendly kind of tone to it. if there was an aggressor in the debate, then quite clearly it was michelle bachmann who went at it with newt gingrich on a couple of occasions and then there was this exchange with ron paul. >> we have an ieae report that recently came out that said literally that iran is within just months of being obtain that weapon. nothing could be more dangerous than the comments that we just heard. >> all right. >> no report said that. it's totally wrong on what you just said. >> iaea report. >> that is not true. >> independent of that, much of the debate, again, was candidates kind of giving their closing argument, if you will, being complimentary of each other and trying to look presidential. have a listen. >> some people aren't happy with some of my leadership is, i actually worked things out with bill clinton to get welfare reform, a tax cut, and four balanced budgets signed in a way that required bipartisanship. >> to get anything done, i had to learn how to get the respect of the speaker of the house and the senate president, democratic leaders. i found a way to do that, to find common ground from time to time. >> bipartisanship, three candidates in a row, romney, gingrich and paul all talking about working across the aisle. that's something that hasn't been mentioned much in debate sos far this year. back to you in new york. >> steve: all right. steve brown, thank you very much for the live report. moving on, he's known for his dead on impersonations of bill clinton, dick cheney, and regis philbin, to name a couple of the just last saturday, he returned to "saturday night live" for a surprise appearance in one of his most famous roles. >> let's start with you. how did you come to moderate this debate? >> that's right. it was one of those friday night specials. lauren came to me in the hallway friday night and he said, trump, and walked away. [ laughter ] no, someone followed him with a bunch of research. >> steve: how do you figure out how to too him? >> -- do him? >> normally i try to be a little -- that's kind of a caricature. normally i try to print it accurately, but we were so short on time, i went straight to the character. but trump, hands, where is he from? what's he sound like? what are his hands? does he have anything weird that he does with his mouth or anything like that? trump does something unusual when he gets angry, he does sort of a... >> my mom is a very good breastist, yeah. so i used to do impressions with her. she came home and she would do the people from the neighborhood. she came home one day and she was impersonating this man, mr. nelson and she said something like him and then i said something like him and we both looked at each other and said, wow, yeah. do you it too? really? yeah. >> gretchen: with so much tragedy and trauma in your life, was this book cathartic for you? >> well, i was into a lot of aberrant behavior. >> steve: you're lucky to be alive. >> i would say so, yeah. the cover of the book is a prayer and an answered prayer. it was my first prayer. so i didn't know how to pray too well. but i did request the bible. i was in jail at the time. >> steve: you found god through aa and a lot of introspection. >> i think i found god in a prisoner's docket in the bahamas when they said, will the defendant please rise. >> brian: right. he had that problem on the cruise line? >> yeah. you know, i didn't really know how to pray. i didn't want to offend anyone with this title, you know, but that was my first title. it was a way of saying, i'm turning it over to you. i just felt like god, the maker of trees and hanger of planets can look at this guy and go he can't do better than that right now. he doesn't mean to disrespect. he's not better than that right now. but i did get a nice bible, so i had a proper prayer to go to the docket with. >> brian: being you overcame so much, there is no doubt the best is yet to come. i look forward to your next project. where will you be? joining me now with some answers, judge jeanine pirro. if anyone needs justice in this case, it's his family and those four beautiful children who now don't have a father. >> you know, this is a sad, sad scenario and i have to tell you, gretchen, it should not have happened. judge laporte made a decision to release this guy, lamont pride, not on bail, but on his own recognizance. look, setting bail when i was a judge, i did it all the time. it's not rocket science. number one, does the guy have ties to new york and what is the likelihood that he will return to court? we already know that there was a warrant outstanding for him in north carolina for shooting someone. we already know that he had just been in her court pleading guilty to possession of a knife. we know that he had two prior incidents in new york and we know that this is a guy from another state. so why would you let him out without bail? why would you release him at all? >> gretchen: why do you think? >> i think she became blase to crime and indifferent to the harshness that goes on on the street and i think this is a woman who just is not into her job and i don't say that lightly. i was a county judge. but when you got someone with a formula that is so clear under new york law, he meant none of the criteria for releasing. >> gretchen: you're not the only one who is upset about it. mayor michael bloomberg here in new york city said this. >> somebody who the rap sheet in front of you shows is potentially a dangerous person has a gun, has a criminal history, common sense says don't let him out until you make one phone call. it's not a lot of work to do to protect the public. it was not done, plain and simple. >> gretchen: what can be done? can a judge get in trouble? >> sure. you've got the commission on judicial conduct. you've got impeachment. but at thend of the day, this is going to be more about a wake-up call for judges who think that oh, this is another piece of paper going across my desk. i think that who needs to be commended here is the nypd. they called north carolina twice and they said look, we've got a guy who is wanted for shooting in your state. we want to make sure you lodge a detainer in new york. north carolina denied they got the call until new york proved they had the phone records. then north carolina calls the brooklyn d.a. five days later when it's too late, of course, and they say, we upped our warrant and the assistant d.a. never told the judge. i mean, there are four places in the system where it was messed up. >> gretchen: if this were california, you might be able to make the argument, hey, our prisons are too full. is that the case in new york? >> what is the judge thinking? i have to go cook this guy dinner so i've got one less guy at the dinner table? i'm not going to keep him in? there is no benefit. bail is for the purpose of making sure you come back and if you're dangerous and you really need to look at him twice. this judge didn't do it. shame on her. >> gretchen: all right. you heard it from judge jeanine. haul hear more from her show, "justice," saturday at 9 p.m have a great weekend. you've heard of ugly christmas sweaters? >> steve: i'm doing okay. but that is one ugly sweater you're wearing. >> thank you very much. >> brian: how did you get this idea that ugly was so in and profitable? >> a few years ago, i was -- my children were getting ready to go to college. i was an at home mom and looking for something to sell during the christmas season. so i did some research on google and trending and looked to see what searches were trending and i came up with ugly christmas sweaters. did a little research and it certain israeli a booming industry. that's what i jumped into. >> gretchen: here is the amazing thin, do you all these sweaters yourself and some sweats that are already ugly, you make uglier. what do you put on them? >> i add fringe, jingle bell, pompoms, 3 d things. i like to add lights. anything you might hang on your wall or tree is fair game for a christmas sweater. >> steve: yours, the sweater you're wearing right now, i understand, has lights in it. you have brought some sweaters to show us, some of the ugly sweaters because a lot of people have ugly sweater parties where they get together, everybody tries to outdo each other and whoever has the ugliest wins the prize. so let's see the first one you got there. >> sure. this is a classic '80s sweater. i didn't add anything to it. it didn't need anything added to it. it's kind of a scary toy sweater. >> brian: nothing says christmas like raggedy ann. >> gretchen: looks like brian's or steve's size. >> brian: it's a shame, but i have enough sweaters. >> gretchen: you can wear it on our christmas special. >> steve: next sweater, please?
