with him to court in delaware tomorrow for jury selection. >> are or the type of experience trial attorneys that secure acquittals on defendants home turf. in fact, having low the lead attorney here here actually had bob menendez acquitted in a previous trial in new jersey in federal courts. so they are raring to go here for a trial but this is a it really difficult situation for hunter biden because he's not just facing these charges. he also is fighting charges in federal court in california related to tax crimes or edge tax crimes. and so if he does have a conviction in this case, if that ends up being the result here at this trial, it's only supposed to last a few days, then he's going to have a lot to think about going into a second one because if you lose one case at trial, you could potentially face a sentence that includes jealous time, think, get much more difficult for you. once you have a second trial. so a really dicey situation for

like to underscore one thing, jessica, at the timing. so you don't get to appeal it until after the sentencing and then it takes about a year to work its way through the new york system. i know so people are saying, well, what about going straight to the united states supreme court? you cannot go to the united states supreme court until you've gotten all the way through the new york system. so you're talking about at least a year before the new york appeal is done and then trying to go to the supreme court. so we've got a long road ahead on just this new york appeal, let alone all the other and we are hearing from the former president. he's person, he is gone personally after the judge, which he did not violate the gag order in doing that, that was allowed. but since the conviction, we have seen him really doubled down. he's called the judge judge merchan, a devil judge merchan is going to have he will preside over the senate sentencing phase. >> is if you're his attorney, are you counseling him against doing that does that help him in any way? >> it doesn't seem like it

that to making the effort to call him sort of a melody. those are things i only on the question of change in the venue and all those things you've probably will pop i asked, i don't let the court would do much, but certainly when we talk about constitutional principles, those things may catch the attention of the new york court of appeals or ultimately if he's not successful in the state courts, they may catch the attention of a federal court should his, should he be successful, get his appeal her by a federal judge. >> all right. so looking ahead to sentencing if he is sentenced to jail, i mean, the implications of that as a us attorney, you served on the terrorism and national security subcommittee. so i wonder how high do you think the chances are that we might see a violent response to this? >> would we look back at history, especially involving mr. trump? >> there have been outburst by service four years. >> we've seen that as recently as january the six and so i hope we don't and i hope that

view of law has been quite demonstrated to be not all of them, but some of them partisan. and so this is actually the playbook of autocrats we've seen around the world. they tried to pack the courts with judges that are friendly to them and when they encounter a judge or a court or a jury that's not friendly to them then they attack the system to soften it up for future attack. and now we're seeing his followers going along with that. >> you know, what's interesting is that part of our i mean, correct me if i'm wrong, but part of our judicial system is we accept the fact that you win some, you lose some and in this case, in donald trump's three pending cases he's actually one more than he i mean, he's the court seems to be in the legal system, seems to favor him more than it seems to punish him. yes, he was convicted in this case. however, in the classified documents case his trump appointed attorney, i mean, judge aileen cannon is
