it's a difficult decision. like i said earlier, this was a spectrum-based case of is this mistake understandable under the circumstances or does it cross over in to the criminal realm. that is something only the jury had the authority to decide. could have been a very close call but they did in fact come to that unanimous decision here as we know now. >> neil: tom, it's very likely this case will be appealed and the question of what grounds and what odds do you give the defense. >> i have to say i didn't see a lot during the course of the trial that would give them a strong argue for reversing it. i thought by in large the judge controlled the proceedings efficiently. we've seen in other high profile cases the judge offer gratuitous commentary from the bench. so expect the defense will mount an appeal.
