system. in fact, the u.s. supreme court said last year in a case that it's constitutional. >> well, apparently the secretary of state, if the reports from his traveling plane -- he's coming back from asia. if those reports are correct, then he's apologizing. so i guess they are trying to smooth that one over. also wanted to record keep on jay carney announcing that this task force on the nsa and potential abuses has issued its report to the white house. we knew it turned it in on friday. it's going to be released today. we know they recommended separating the cyber commands from the military cyber command from the civilian in nsa on phone collection. and also that the phone collection be kept at the companies rather than kept bithe nsa for five years. the president, though, is not going to issue his recommendations until a speech sometime in january, right? >> so if they do that, that would be a big deal for a couple of reasons. one is it would end all the legal problems. you know a judge just this week said that violates the
data from the nsa to the private sector, back to the phone companies, so the nsa isn't just sort of holding it there. they can go to it whenever they want to. they also recommend more court oversight of searches of that data so that when the nsa wants to search it for a particular phone number, they got to get more court backing for it. a few other things. they are recommending that the next nsa director, currently an admiral, traditionally a military official, be a civilian to give the impression of the public a better public oversight of this organization and recommending a special assistant to the president for privacy, and they also recommend, and this is interesting, that the cyber command, the military cyber command, be split from the nsa, but this is something that the white house has already publicly rejected. now, it's interesting as well that they are not just talking about protections for american citizens. they are talking about protection for foreign citizens as well, including making it clear that when the nsa accesses foreign data overseas it's purely for national security interests. they are not going to go out
commands, the tenth fleet, which has no ships. the 24th air force, which has no planes. u.s. cyber command, to do this sort of thing. china's created military commands, russia's created military commands. so for me, there are two takeaways here. one, we better defend ourselves, and we're not doing that. unfortunately the obama administration's attitude is we'll defend the government, the rest of you are on your own. and the other takeaway here is we don't talk about arms control. we ought to try to get this military under control. we need some civilian oversight of this thing before it happens by accident. >> when you talk about our military cyber command, is it offense or defense or both? >> it's both. >> okay. >> it's both. >> so it's about finding ways to access other countries' vulnerabilities, not accessible through physical warfare but through computing. >> right.
