the latest. what do we know this morning melanie. we know that former president cheney is here in the hospital and uncheer how serious his - unclear how serious his condition is. he had come in for tests after importancing dis-- experiencing discomfort. he issued a statement reading former vice-president cheney was not feeling well and seen by his doctors in george washington university. on the advice of physicians he was admitted to the office for further testing and expected to be there ov the weekend. not clear what it is. his last heart attack was in february of this year. that was mild one but his fourth one. he's had angio plaste to clear his arteries and a pace maker. that didn't slow him down and since leaving office he is one of the vocal critics of the bum bull administration criticizing the president. >> thanks. we'll keep an eye on his condition all morning. >> we'll turn to the rolling ton arcticle. the military spoking out against rolling stone magazine breaking ground rule in journalism. so the question is, did rolling stone publish the comments on the record remarks by general mcchrystal. was that journalistically unethical to do given the circumstances. >> the military said none of the solacious quotes from president obama or vice-president biden were in official interviews. they took them from off the record discussions about the over all theme and chain of command in afghanistan. none theless, still looks like he should have been out. whether on or off the record. >> he hasn't dispouted them. all he said he apologized and then he resigned. he hasn't disputed them. here's what rolling stone said. a lot of things were said off of the record and didn't use. we abided by the ground rules in every instance. there were multiapproximately times where there was off the record and background or not foracious tribulation. unless the source specifically said this next part is off of the record and turn off your tape recorder and take the pen off of your hand. but sometimes the sources don't realize geraldo's point. he spends time embedded with the troop in afghanistan . the idea is, you are certainly sitting there for hours at a time, right. there might be time when you are having direct one on one sprues and kicking back and enjoying the beer and literally at the airport. >> you let your guard down. >> you let the guard down . whether or table is set in stone. you have civilian leadership and secretary gates saying this. >> we didn't say we would switch off the lights. we would begin a transition face in which the afghan government is taking on more responsibility. >> we are not anding for victory in december and afghanistan stabilized 13 monthses from now. we ask by december that we have enough evidence to demonstrate the proof of concept and that the approach is showing progress and we are headed in the right direction. >> general petraeus wants more troops. >> remember, wasn't it joe biden or said this is a date certain and tank it -- take it to the bank. it sounds like there is room for flexibility on the date now. >> also flexibility on the rules of engagement. if you ask the troopos the ground what is the biggest problem is the rules of engagement. it is make difficult for our troops to engage with the enemy because of the rules. they have to hold back and who they identify as the enemy. it is like fight with one hand tied with the hands behind their back. >> mcchrystal. his whole philosophy about afghanistan. he did long interviews about the way in which he went forward in afghanistan . to have a small footprint and should blend in, in the background. you don't want civilian deaths. it is to the point one hand tied behind the back. it is hard. you know that person is a taliban and now you have to plend in. it is admirable to control civilian casulties. mcchrystal's whole point. if we end up killing civilians that makes perfect sense. it is hard to know if petraeus will change it much. hoe was mcchrystal's mentor and they are like-minded in terms of this. we'll see what happens. they said they will revisiteving. this is what joe leiberman and an n coult are had to stay about the rules of engagement. >> i hope they reconsider some of the current rules of engagement. obviously he understands to win the counter insurgency you need the people on your side. when you are killing civilians it is harder to do that. on the other hand it is a war. sometimes you have to fire first. >> they have been chasing at restrictive rules on which insurgents they can choose. they have to have had identified before they treat it like an insurgent. that is mcchrystal strategy and wants to turn the military into you know, peace corp with guns . >> interesting discussion about the rules of engagement. we are talking to congressman peter king about his thoughts on this. a political panel to discuss the future policy in afghanistan. fox news alert. while you were sleeping the tropical depression became a tropical storm. it could disrupt oil containment in the gulf. we'll have the latest on the weather. >> first of many that woo will see in the gulf this summer, and so kind of practice in the gulf. this is a storm north of honduras and moving northwest. it is going to interact with the yucatan peninsula. it is not strong enough to cause major problems in the yucatan area. it is pulling off northwest and then in the gulf sometimes by monday and at that point, we'll have a better idea. all guidance will pull it off to the west and not toward the area where all of the oil >> to the american people. it is it a change in personnel but not a change in policy. general petraeus fully participated in our review last fall and he supported and helped to design the strategy that we have in place. >> a debate on this. yen strategist and kristin powers. good morning to you ladies. crirstin. not a change in policy. but does it need to be a change in policy and strategy? as you know, it's supposed to happen next summer so let's listen to what the president says about that now. >> we didn't say we'd be switching off the lights and closing the door behind us. we said as we begin a transition phase in which the afghan government is taking on more and more responsibility. >> we're not asking for victory by december or by july of 2011, we're not asking that afghanistan be stabilized 13 months from now. what we are asking is that by december we have enough evidence to demonstrate, if you will, the proof of concept. that the approach that we're taking is showing progress and that we're headed in the right direction. >> it certainly sounds a bit gray, doesn't it? one thing is it clear, they're going to have to listen to david petraeus on this. it's the third commander in afghanistan and whatever he wants is going to have to be taken into serious consideration because we can't depart from what we're doing over there yet again. >> that's a great point and i think it actually gets the president off the hook. there's so much respect for david petraeus and republicans and democrats this week, reading conservative columnists thought this was a home run for president obama. picking david petraeus because now he can come back after eight months to dave's point and say you know what, we're going to need more time. you listen to your generals and everyone respects david petraeus, they may be there 2012, 2013, doesn't matter, but if general petraeus says it. >> the timetable may or may not be changing. we've heard from servicemen and women that they feel ham strung. and even if they see a terrorist, an armed terrorist going into a house, if that terrorist puts down their weapon before going into the house, the soldier can't fire on that terrorist, things that just seem to really stretch the servicemen and women's capabilities. so, will that change under petraeus? >> stanley mcchrystal was number one, he was concerned about civilian casualties, that was his first priorities and the troops said that was like fighting with one hand tied behind their back. and under stanley mcchrystal. it appears under david petraeus they may be loosening this up and allowing them to interpret who is the taliban. >> stanley mcchrystal said publicly before the plans in afghanistan, look, you have to win the hearts and minds of the people in afghanistan and if you're killing civilians on a regular basis trying to partner with tribal leaders and tribal elders, it's not going to work so we need to put our guns down. >> joe lieberman commented on so did ann coulter, take a listen to the thoughts on policy. >> in 2010 will be had a critical year. military operations-- or is he dependents upon a drug dealer-- the wrong sound bite, obviously. we'll try to get that for you later and senator lieberman talking out about that and ann coulter, here we have it now, take a listen. >> i for one hopes he reconsiders some of the current rules of engagement and obviously he understands that to win a counter insurgency you've got to get people on your side, when you're killing civilians it makes it harder to do that and on the other hand, this is a war, and sometimes you've got to fire first. >> they have been chasing at the restrictive rules which insurgents they can shoot. the they need to have insurgents identified to them by an afghani before they can be treated like an insurgent. look for a gun, and that is mcchrystal's strategy, as the rolling stone guy says, wants to turn the military into, you know, the peace corps with guns. >> basically ann coulter making the point they're almost like n.a.t.o. forces like mogadishu in somalia. and watching individuals killing her individuals and they couldn't do anything. >> it's a tough one. when civilians are killed, it's horrible and then there's lots of repercussions and general mcchrystal thought it increased the insurgency, when insurgents were created when that happened. let's talk about rolling stone. >> what started this mess as you know is the rolling stone story with quotes from stanley mcchrystal and his entire staff about the president and joe biden and all of the quotes. now military and top brass are saying that rolling stone may have in fact broken the rules, that a lot of things, in fact all of the salacious in their opinion quotes about staff, about the president, were in off the record conversations and say it's inappropriate how paroling stone went about publishing off the record comments. >> yes ne did this, did it on purpose to help get rid of mcchrystal, that's what they think rolling stone did. you never pal around with super liberal media ever. the choice disturbs me with mcchrystal speaking the truth about obama and gang. >> editors said a lot of things were said off the record that we did not use. we abided by the ground rules in every instance, in every case, in this story there were multiple times there were express requests for off the record and background not for atri bugs and we abided in every instance, obviously, the journalist is sticking by his rules and ethics and everything even if it was a bar and unguarded moment if they didn't say off the record, it wasn't off the record. >> i think it hurts all media in the situation to get a sense what's going on in war time, you develop a relationship with the military for embedded reporters and have to develop a relationship there. what's on and off the record. i think it hurts all media when they're trying to cover a war. >> they certainly won't trust reporters for a while. >> certainly not the rolling stone. >> moving on, a fox news alert, former vice-president dick cheney is in the hospital admitted yesterday after feeling discomfort. 69-year-old has a long history of heart problems as now. >> malini wilkes is it standing by at the hospital with the latest on his condition. do we know anything? >> we do not. we know that dick cheney is here at gw hospital and this mork we're not able to get new information from the hospital or his office and we know that he came here yesterday for tests after experiencing discomfort that he is 69, and had a series of heart problems and wise for him to get checked out right away. this is what his office had to say last night. former vice-president cheney was not feeling well and seen this afternoon, meaning yesterday, by his doctors in their offices at george washington university on the advice of his physicians he was admitted to the hospital for further testing and is expected to remain in the hospital over the weekend. now, his last heart attack was in february although it was a mild one, but this, that was a fifth heart attack since age 37 and had quadruple bypass surgery and two angioplasties, a pacemaker, a stent. it's not clear if this is for his heart. because he's had knee problems and back surgery and doctors want to monitor him through the weekend. alisyn, dave, clayton, back to you. >> thank you, keep us posted throughout the show. >> now let's turn our attention to another controversial move going on right now. obviously the attention about arizona and immigration law set to take place the end of july, florida now looking to mimmic the arizona law, also, and other states considering the same. this comes as news this morning, president obama appointed a sink wary city supporter as the liaison between the federal government and the state immigration officials and those who run ice, immigration enforcement committee. in houston, he's been sympathetic, but widow has been speaking out who lost her husband as a result of an illegal immigrant killing her husband. she says he could have done more to do that-- to stop it and otherwise her husband might still be alive. >> yeah, we don't know how he would go about enforcing this arizona policy, but one can figure that he would be working against this arizona policy, you know the obama administration intends to file suit against arizona and they're expected to do so this week, what would he do? implications for the oil conditions in the gulf and rick leventhal is in louisiana. we'll start with rick. >> it will strengthen through the day and time over the warm waters, upper level winds are favorable for strength and what it doesn't have as you take a look at the weather maps is enough time over water and it's going to continue it pull off to the west and southwest and move over the yucatan peninsula and making a first landfall right around the bell least, mexico border and rain across gaut malla and honduras. as it moves over land, most of the models pulls it over to the west and the second landfall will likely be the mexico coast line or the texas area and put up where the oil spill is. things are looking good for the oil spill, a small chance it would move in that direction. good news for this storm, but nice, many, many storms this season, we're expecting an active season and we're going to see some soon. hopefully this storm is not the one. >> let's get to it. rick leventhal in grand isle, louisiana, he spoke to locals down there, what are folks saying down there, rick, are they concerned? >> well, they are and normally a tropical storm would be no big deal for folks here in grand isle and along the gulf coast, where hurricanes are a way of life. in this case, yes, they're worried because if a tropical storm were to hits the spill area, it could force suspension of containment and cleanup efforts for up to two weeks and right now they're collecting about half, they think, the oil that's gushing out of the floor of the gulf of mexico. and that would have to stop. thad allen at the coast guard says they would have to clear everyone off the ships in the area, stop the containment for up to five days before the storm arrives and days to set up after the storm passes through and the folks along the beaches, these communities along the gulf coast that are already seeing their towns devastated by the oil spill now worry about more oil possibly coming ashore and here is what one local told us this morning. >> when the storm comes in, we're going to catch hell, it's going to be dispersant and oil all over the place. it's killing all the animals, you know, and i'm totally disgusted. >> yeah, they've got some really rough times here obviously the last couple of months and any, any talk of a storm coming ashore now makes things a lot worse. i can it will you that bp says that while initially they thought it would take five days to stop operations and prepare for a coming storm. now they think they can shorten it to two days, one is now a good time to invest in bp stock? we're joined by financial expert jordan goodman, fast profits in hard times. >> good to be with you. >> on april 20th, the day of the spill. 50.48. >> right. >> today it's at 26.83. and people look at what happened to exxon's stock after the valdez and it ultimately kicked back up and people got richer after the spill. same thing about bp. >> no, exxon valdez was terrible, a small amount of oil, one ship, one coast, they're pumping out. every two to three days, the amount of the exxon valdez is coming up and this is continuing. hopefully this well will be stopped in august, but this is a huge amount, much more, no, not a good time to invest and people are betting against them dramatically down 100 million dollars from the peak. >> it sounds like even after the oil is done spilling and cleaned up somehow miraculously that bp won't recover. >> correct, they're going to have-- water quality act a 15 billion dollar fine for that they put aside 20 billion, that's not close. jindal from louisiana said the damage to louisiana alone is about 100 billion. and who they're going to go after not the federal government they're going after bp. that's why the stock is down. >> unlimited liability and people are freaking out and cut out their dividend altogether, a major thing, a lot of people relying on the dividend income and people are avoiding the stock, i think it's going down much lower. >> we only have a few seconds left. you think bp will go bankrupt. >> the liabilities is unlimited and it's stupid to have them go bank result. who are you going to get to clean up if they don't do it. >> and i read in the notes, it isn't unamerican to invest in bp it's just plain stupid. >> that's correct. >> thanks for coming in and not mincing word. the hard earned american tax dollars somehow funding afghan war lords and taliban? congressman jeff flake is up next with this alarming report. >> all right. if you're not up and out of bed yet. the next story may knock you out of bed. the u.s. may be unintentionally funding the taliban. you heard me right. a new congressional report suggesting we're paying tens of millions of dollars to afghan warlords to secure convoys to carry supplies to our troops and that money could be headed to the taliban. and shedding light on the shocking report, nice to see you this morning, congressman. >> thanks for having me. >> how in the world is this happening? is this true? >> instead of having our own troops to guarded supply lines for the goods that go from military base to military base we engain in a host trucking contract. the engare afghan economy or gdp is 13 billion. this contract is worth 2.1 billion so it's a lot of money and with that contract to move the supplies required to provide their own security. now, of course, much of the country is controlled by the taliban or elements sympathetic to the taliban, what happens as much as 1500 dollars per truckload. >> wow. >> there are approximately 8 to 10,000 truck missions per month, is protection money basically. so those who control the roadways, whether they're taliban or the people sympathetic to the taliban, can let the trucks pass through. >> yeah, a great piece in the sunday new york times two weeks ago how you could count on these afghan warlords, they gave them $15,000 and that that supply of, that truck supply would make it where it needed to make it to, because they could depend on them, $15,000, you're saying a lot of money filtered in the country side to the very people we're fighting. >> right. that's the-- the problem here, it's certainly more efficient than having our own military guard the supply lines, but the soviets occupied afghanistan, for example, 75% of their force structure was used simply to guard the supply lines. so, they only had 25% to occupy the country. >> we're almost out of time, congressman, i've got to ask you, how do we stop this?
