>> it's so tight between the girls. i have to go with gabby douglas. >> all right. what a smile that would be. shannon miller, the most decorated olympian in our history. now, to a terrifying near-miss at one of the nation's busiest airports. three commuter jets came within minutes of a possible collision at reagan international airport. abc's jim avila is there with the latest. >> reporter: the three commuter jets all flying for u.s. airways and collectively carrying nearly 200 people onboard, were in the process of taking and landing at washington's reagan international airport, when they nearly collided in mid-air, around 2:00 p.m. wednesday. >> traffic will cross downfield. >> reporter: with the storm approaching, air traffic controllers, just over in warrington, virginia, changed the direction planes were flying into and out of the airport to avoid shifting winds. did they tell controllers at reagan? "the washington post" reports that information was not passed along. and two planes were launched in the path of another flight that was landing. >> washington tower, unable to reach you. >> stand by. >> reporter: tower controllers saw the mistake and turned the inbound flight south, just 12 seconds from possible impact with the other plane. >> we were cleared to the river there. what happened? >> stand by. >> we have to get on the ground here pretty quick. >> reporter: overnight, the faa confirmed the near-miss to abc news. saying it will take appropriate action to address the miscommunication. meantime, u.s. airways says, it's working with the faa. and safety is its top priority. you can hear the tension in those controllers' voices. about two weeks ago i was given a tour by the faa inside that control tower. you could see that, in fact, one controller controls both the takeoff and landings with an assistant. there's a supervisor behind he or she. >> jim avila, in washington, thank you. scary moments there. let's turn, now, to abc's paula faris with a look at today's news. >> good morning. we begin with breaking news. three alleged al qaeda operatives have been arrested in europe. let's get right to abc's nick schifrin. nick, what do we know? >> reporter: good morning, paula. the men have been arrested in southern spain. what makes this is worrying it's reportedly the first time they were found with explosives. the three may have been planning an air attack since they were training to paraglide. they were attending training camps in pakistan. al qaeda has hit spain before. they blew up trains in 2004. what makes this more worrying, just in the last few weeks, al qaeda issued a message looking for spanish-speaking lone wolves. paula? >> nick schifrin, live for us this morning. thank you, nick. and the united states is taking a more active role in the uprising in syria. there's word this morning that president obama has authorized the cia and other agencies to offer support to the rebels who are trying to overthrow president bashar al assad. however, that report does not include weapons. there's been a security breach at a u.s. nuclear facility which is supposed to be one of the most secure sites in the world. three peace activists, including a nun, managed to break into the grounds surrounding the y-12 national security complex in tennessee. that's where the gott stores weapons-grade uranium. "the wall street journal" says the protesters cut through fences, got past guards and then defaced the building, triggering the highest security alert there since 9/11. and a security of our financial markets is once again in question after a software glitch set off wild trading swings on wall street. look what happened to the stock of one tech company, soaring 300% yesterday. the problem, it was traced back to what's being called a rogue algorithm at a new jersey brokerage firm. the program sent millions of trades flooding into the market, affecting hundreds of companies. the trades were later canceled. a massive fire broke out early this morning at this refinery in tulsa, oklahoma. this oil refinery. no injuries. the fire is under control and is being allowed to burn itself out. and finally some dramatic from this store in texas. you see the clerk stand up to stretch. then, the car drives right through the wall, sending him flying across the floor. you guys, the clerk is okay. the woman behind the wheel, charged with drunk driving. but just to be clear, the next day, people hung up a sign outside that says, this is not a drive-through. just in case you didn't know. i think we need one of the signs behind us. >> he didn't get injured. that's incredible. paula, thanks so much. now, to an abc news exclusive about james holmes, the shooter at a colorado theater less than two weeks ago. news from kmgh in denver, raising questions about what his university may have known before the shootings. abc's mark greenblatt joins us with the very latest. mark? >> reporter: good morning, amy. one victim remains in critical condition here at university hospital behind me. but the attention has now turned to the psychiatrist who treated james holmes, as we've just learned that she's hired two new civil attorneys. this, as we also learned that she may have reached out and expressed concerns about holmes' behavior to some of her colleagues nearly six weeks before the shooting. for weeks, the world has been wondering, did anyone see signs this would emerge from a seemingly ordinary ph.d. student. abc news has learned psychiatrist dr. lynne fenton, who was treating holmes at the university of colorado, was also a key member of the school's threat assessment team. in fact, these documents abc uncovered showed fenton actually wrote the university's policy on threat assessment. what's more, our affiliate kmgh is reporting exclusively, by early june, fenton notified other members of the team about her concerns about holmes' behavior. but on june 10th, three days after holmes bought an assault weapon, he tells the university he's quitting. so, the larger threat assessment team never had a formal meeting and never intervened, thinking they had no control over holmes after he left. at the very time experts say it should have been a red alert. >> that's a signal you should intensify your efforts, not walk away. under those circumstances, most well-trained assessment teams would have gone into action. >> reporter: but listen to what the university chancellor claimed early last week. >> to the best of our knowledge, we did everything we think we should have done. >> reporter: words under fire now as those close to the victims now ask could this all have been prevented? now, we reached out to the university of colorado and asked them, did dr. fenton express any concerns with some of her colleagues on that threat assessment team? they're not commenting, citing a protective gag order from the court. i did talk to one of fenton's new aattorneys. and he's not talking either. amy? >> yes. a budding romance between taylor swift and the youngest kennedy. new details on what his family says about her. let's say it's mutual admiration all around. >> it should be. we're going to begin with the all-points bulletin that sent police, fire and rescue to pop star miley cyrus' home. they were responding to a 911 call about a home invasion, only to find out it was all a hoax, called swatting. paula, you're back with details. >> the swatters are typically young computer hackers working alone or in groups. sometimes they select their victims meticulously. other times, it's completely random. this case, they chose miley cyrus. telling emergency personnel shots had been fired and an armed hostage situation was under way. this was the scene outside pop star superstar miley cyrus' north hollywood home just last night. the lapd along with fire and rescue squad members raced to the location after receiving a report of a possible home invasion. >> we responded to a call of kidnap in progress, one person stopped. >> reporter: officers established a perimeter. and with guns drawn, approached the house. >> we checked the residence. there's nobody at home. we believe it's a prank call at this time. >> reporter: miley cyrus, who was not home at the time, appears to be the most recent victim of swatting, when a 911 call triggers law enforcement, by pretending there's a crime in progress. listen to this 911 call that sent a s.w.a.t. team to an atlanta radio personality's home this june. >> i just shot my wife. >> you shot your wife? >> i guess you're going to have to find out. i'm going to shoot someone else soon. >> reporter: it turned out to be a hoax. >> a 3-year-old, a 6-year-old and my wife. it wasn't just me being targeted. >> reporter: anyone can be swatted. and increasingly, they are. law enforcement is cracking down. >> not only is it bad, it is a crime. if we are able to determine who committed this crime, we will arrest them and prosecute them. >> this doesn't just endanger the possible victims. there's a massive financial burden. the fbi says each swatting incident costs law enforcement $10,000 on average. and there's the legitimate life and death situations that is taken away from, as well. >> to beware of. now, the man convicted of stealing $1.7 million is using an unusual reason to ask the court to go ease s on him. he says he deserves it because his sexy ex-wife has turned into a self-proclaimed cougar and is bad influence on their daughter. >> good morning. willard ross lanham is the investor or the man who likes to party. willard lanham is asking for leniency this morning, because he fears for his daughter if left with his ex-wife, lara, a self-described cougar. >> a cougar really is a woman that's going out and meeting young guys. and tend to click with people younger. >> reporter: call it the cougar defense. lanham, once a hot-shot consultant for the department of education, lived lavishly with his then-wife 15 years his junior. and named the street after her. >> it was normal. he was making money. i don't think anybody would say, where is this money coming from because it never was huge. >> reporter: in march, a jury found lanham guilty of fraud. he's facing 20 years in prison. but lanham is asking for just four years, saying his 17-year-old daughter can't rely on his ex-wife, calling her emotionally unstable. his attorney writes, laura is going through a highly ostentatious mid-life crisis. conducting herself as a teenager and dating men in their 20s. >> i'm not sleeping with these kids. these are my friends. will i date eventually? yes, they were. were they raunchy, no, they were not. lanham says she shut the site down for her children. but the blog is making a comeback. his ex-wife doesn't wish britain upon him. but cougar or not, her life is now none of his business. >> let this go. let us go. deal with your own life and stop messing up ours. >> well. willa willa willa willard lanham said you get a sense of her lifestyle. lanham is appealing the conviction. and we have one of the calendars coming for you, josh. >> that's great. >> i'm just going to -- >> moving right along. october was an especially interesting month. >> seriously. this dramatic rescue, this can follow that. a hiker in california. take a look at this. hanging on a ledge for more than two days. facing death, even writing good-bye notes to his family. it was then that a rescue team did what the hiker thought would never happen. defying gravity and saving his life. abc's ryan owens has the story. >> reporter: just think of dangling up there. literally hanging on for dear life. imagine doing it for two seconds. now, meet the man who did it for more than two days. >> i've never been in a position to say, how much am i willing to do to stay alive. >> reporter: larry bishop is an experienced hiker. the 64 snapped this picture before climbing to that peak behind him near fresno, california. on the way down, he took a wrong turn and got stuck on the slick granite face of the mountain. he took this photo, too. almost 10,000 feet up on a 45-degree angle. >> i basically hoped that i had the stamina and the determination to bear the pain and hang on. >> reporter: he had no water, ate plants to survive. during the day, the view was spectacular. but the sun beat down on him. he was dehydrated and delirious. >> i wanted to see saviors. i wanted to see people who would rescue me. >> reporter: but there was no one there? >> yeah. >> reporter: he started a good-bye notebook to his wife and daughter. >> i love you. i'm sorry i can't make it. >> reporter: detailing the most difficult hours. >> i'm very tired. groggy. worst 24 hours in my life. hope someone has their rescue squad coming. >> reporter: they did. and finally found him 52 hours into his ordeal. bishop didn't think he could hold on much longer and neither did his rescuers. two of them risked their own lives to sprint several hundred feet up that slick rock. >> just dashed. made a mad dash up. >> reporter: just in the nick of time? "the bourne legacy." it has everything you love in the series. action, passion, conspiracies. it's a complete package. and the man who brought it all to life, tony gilroy, about to join us. first, let's look at what he brings to life. fans are counting on 41-year-old jeremy renner to take the "bourne" series to the next level. he's playing the lead in "the bourne legacy," the fourth installment in the wildly successful bourne series. the brave behind the series, tony gilroy, the writer of all of the previous bourne series, pulls double-duty. writing and directing "the bourne legacy." this is the first time the series won't star matt damon. >> i've been at it for 13 years, i can't believe it, on this franchise. and building it up in a variety of ways. how can you do a sequel that keeps jason bourne alive? matt damon set the bar so high. >> it's a great acting part. we need world-class, platinum actors. >> reporter: so, gilroy and his team added a new character, aaron cross, played by renner. >> it's a huge responsibility, i suppose. it doesn't change anything, however. if i work 10 days on a movie or 100 days on a movie, it's the same amount of commitment. >> reporter: gilroy hopes that commitment on-set ultimately translates into a seamless performance on screen. saying movies should be much more fun to watch than to make. this one is awfully fun to watch. how was it to make it? let's ask him. tony gilroy, academy writer. and now, director. you wrote the first three. then, you decided to get behind the camera, as well here. does that, to a degree, help you achieve yo vision to another level? >> i think, yeah. i mean, directing is the final control. i mean, if you're writing well, you're seeing a movie in your head. but it's a director's medium. my involvement in the first three was really -- was really outside of production. ideas. >> but it was propulsive. and the trilogy plays out. where does this movie come from? >> this movie came out of desperation. since matt had gone, jason bourne was no longer in the picture. they talked to people and try to figure out where to go next. and i was lucky enough to have one of those conversations. >> we hear it was a massive search for your two leads in jeremy and then rachel. what allowed you to get them both involved? >> jeremy was not available for months and months. his name finally popped up as we were getting desperate. and frank marshall and i ran over to berlin and sat down and had dinner with him. he was exactly what we were looking for. rachel, i cast right away. she was there on monday. by wednesday, she was cast. >> they're great -- also, you have edward norton there. who is carrying this behind the scenes. and it's interesting. you look at your body of work. your heroes aren't necessarily good. your villains aren't necessarily bad, especially in edward's character. he believes himself to be a patriot. >> yeah. we're talking about people that are -- we have a lot of people that are keeping us safe. he's taking the burden of that moral responsibility on himself. and with his eyes wide open. >> this isn't just again springing from whole cloth. you're doing a lot of research here. and i was watching this movie thinking, how much of this might even be sort of true? how much did you find in your research? >> this isn't science fiction. there's a huge appetite -- there's no drug-testing in war. anyone who is skeptical, if they leave the movie and go online for ten minutes and list a few key words, they'll find out all of this is on the horizon. >> it's remarkable. and it does link it together very quickly. you don't have to have seen the first three to enjoy this one. >> no. we were conscious of that making it. we road tested it to make sure. if you've seen the other three, it should enhance the other three. you should be able to watch this one on its own. >> tony gilroy, again, congratulations.
