the payoff is potentially, the allegation is potentially it goes directly to the benefit of the family members. all the direct family members, haley biden, hunter biden, joe biden, frank biden, the grandkids taking $100,000. to say there was not a financial benefit to joe biden was absurd. >> kayleigh: it is, talk about joe biden, house oversight committee presented this, this is recent. pull up a check. $40,000 check to joe biden, you see the date 2013. bottom left corner, "loan repayment," and it began with northern, chinese company and goes to hudson west, joint venture with hunter and goes to the group and then goes over to sara biden, sister-in-law of the president and the check to joe biden. i want to lay that out, that is how complicated these companies were. they call it a loan payment, what say you, jason chaffetz? no, you are supposed to be on the house side answering questions from democrats and republicans on the house committee, that is the way the justice system and legislative process works. that is the way you do things, independent branch of government asking questions. to suggest this was trump, it was brought by biden's department of justice, nothing to do with trump. to ask questions totally legitimate. >> kayleigh: jason chaffetz, thank you for your expertise. emily compagno, two u.s. code section 192, refusal of witness to testify or produce papers, every person summoned by the authority by house of congress upon any matter must show up, i'm paraphrasing, or phase a fine and possible imprisonment. there are consequences for defying congress, if you have a doj willing to enforce that charge, as we've seen it done with steve bannon. >> emily: exactly, steve bannon and peter navarro, failing to show up and failing to produce documents. there is consequence here if the law is fairly applied. hunter's comments, i find them laughable. no one cares that hes an addict, no one cares but him. he failed to pay taxes, false testimony on gun application and pretty obvious influence pedalling his father is in part. it would not exist if not for his father. to try to parse out a narrative where his dad is inculcated, he could have shut it down or hunter could have said it has nothing to do with the beginning. it is obvious, the thing of value was his father and the house will vote on this impeachment investigation. it will issue and give subpoena power to those three committees, starting investigation. i subscribe to speaker johnson's point, this will investigate properly, methodically, deliberately and not in a political manner. hunter biden tried to paint himself a victim, he is a victim of his own behavior and we are seeing potential for consequences on the judicial level and congressional. remains to be seen if that part is fairly applied as steve bannon and peter navarro know all too well. >> kayleigh: a wall between influence pedalling, not true. he said his family did not receive money from china, that is not true. he claims he never spoke to his son about business dealings, that is not true, what do you say to the american people? >> it is important to note, the subpoena is an enforceable directive to appear. it doesn't require you to answer every question or any question, that is controlled by whether you have a legally kog niezable confidentiality privilege, which hunter biden has in spades having been indicted twice and if you believe the prosecutor that he is under investigation for other charges, as well. he had plenty reason not to answer questions today, but to my mind, he had no legally convincible reason not to show up. importantly, what he's going to say and the republicans totally botched the timing on this, this is more powerful argument than it ought to be. they will argue that the subpoena in connection with impeachment inquiry is not legitimate because the full house has not voted for the inquiry and they made the subpoena returnable on the same morning that it turns out later today they'll vote on the impeachment inquiry. it allows abbe lowell, savvy defense attorney, to say, even republicans know this is not legitimate and rushing in to get it approved later today. they have given him a good argument to make. last thing, this is being driven by crazy, congressional holiday calendar, where the guys want to go off on vacation. if i went into a district judge and said, i have an emergency, if you will do this for me, i'll get right on it in four weeks, the judge would look at me like i was crazy. >> emily: during the trump administration, when they subpoenaed mcganin,he had to show up. does that pay a part in hunter's resistance or the reverse? >> i think it does, emily, the thing is, i think he had to show up today, even if you bought the idea impeachment inquiry is not legitimate, which is position trump took in the first weeks of the ukraine impeachment, that subpoena and issued by oversight and judiciary committee. they have subpoena power. that is not a suggestion or invitation, it is order to show up and i think they had to show up. i think the politics of this and you heard from jim jordan when he spoke afterward. i think he realized how this tees up. if they are not going to vote on impeachment inquiry until this afternoon, it is bad look talking about the president's son, which is serious business, to hold him in contempt when you have not buttoned down if the inquiry is approved by the full house. i took jordan to say next move they are going to make is reissue subpoena and have him come in and then if they try to enforce it, 245i have a full house vote behind them. >> emily: thank you for that analysis, we'll come back to you shortly. we'll bring the conversation back to the couch, the chairs. marc thiessen, what say you about the point andy makes, democrats are having to live with norms that i blew up during the trump years, will that impact hunter negatively? >> marc: it could. they did two impeachments. in nixon era, there was bipartisan support for impeaching him. it should require bipartisan support for doing that. andy point is why this is a bad idea fchl subpoena from oversight committee instead of impeachment inquiry, there would be no question he has to show up. he can argue, i don't have to do it, it is big mistake. >> emily: take devil's advocate side and argue this is positive. do you subscribe to the concept that some argue, many argue biden administration has been less than forthcoming and this is only tool to get more information? essentially aside from that conclusion, maybe he won't be impeached, but is this most effective method for getting the information? that is what the american people and congress need to have. >> kayleigh: it helps enforce subpoenas and forces white house to comply and hunter to comply and his attorneys to comply. it strengthens their hand. jim jordan, his press secretary sent this statement pursuant to contempt charges. statement says from jim jordan and james comer, hunter biden defied lawful subpoenas and we will initiate contempt of congress proceedings and will not provide special treatment because his name is biden. he initially said there is a process, appears contempt charges will be filed. we have that empty room that hunter biden was supposed to be in and was not. when under subpoena, you must show up. several people with january 6 said we want public hearings and jamie raskin said that is not possible and they had to come in. now jamie raskin says you should give hunter biden public hearing. contempt charges will be coming, will joe biden and doj enforce them? i will leave that to viewers. >> emily: do you feel hunter engaged in right strategy, making public commentary, refusing to comply with a closed-door testimony? do you feel this was the right move considering ultimately he will be sitting at one of the tables? now that we can dissect his words, do you feel good move on his part? >> leslie: chad pergram and jason chaffetz eluded to this, chad pergram, comer could have called on the sergeant of arms had he showed up. hunter biden appeared on the senate side, they could not take him into custody. supposedly david spunt reporting if things move forward and go into this inquiry, take into account that hunter had offered this written letter to congress he would come in and answer public questions, which is one word he used there when making his statement. a lot going on there. >> emily: talk about capital, not the capitol, but capital of biden abiding by the law. will that engender him to the american people?
