hearing for one of the two migrants charged with the killing of a 12-year-old girl in houston. the men lured her under a bridge, tied her up and killed her. each is facing capital murder charges. prosecutors are asking for the men to be held on $1 million bond. more on that as we get it. first there is this. >> how are you preparing for the debate? we see president biden is out at camp david and you are on the campaign trail. what is your strategy. >> i look forward to the debate. >> campaign trail versus camp david. strategies could not be more different. both are preparing for the debate just three days away. i'm gillian turner, bill and dana are off today. >> mike: i'm mike emanuel, this is "america's newsroom." president biden has been at camp david since thursday. he and his team are rehearsing behind closed doors with no public events on his schedule. >> gillian: former president trump was in philly this weekend and he got an emotional response from one young supporter. >> make sure he gets a special sandwich for himself. come here. look at him, huh? look at this guy now. come here. >> good morning, mike, president biden kept a low profile over the weekend. that low profile expected to continue this week. it has been quiet at the white house. the president and first lady have not been here over the past several days. that cadence expected to continue over the next few days as the president is at camp david in the maryland mountains with aides. he is expected to leave from camp david to go directly to the cnn debate on thursday at 9:00 p.m. eastern time. simulcast on fox news. on friday the president will hold a rally in north carolina with reporters. trump was in philadelphia at temple university with thousands of people. hitting the campaign trail hard. holding rallies and he is preparing for the debate. mike and gillian today marks two years exactly since the supreme court struck down roe v. wade and the administration plans to tout that heavily putting blame directly on donald trump. hoping even two years later that crucial decision will resonate with voters as people prepare to vote in the coming months. president biden out with a new ad this morning, watch. >> president biden: donald trump says freedom. after 50 years of failure with nobody coming close, i was able to kill roe v. wade. >> meanwhile the white house facing some tough questions about the promotion of a new press aide. someone named tyler cherry handling the president's climate change agenda. according to colleagues at fox digital he once tweeted police are the direct evolution of slave patrols and lynch mobs and made other questionable posts. he wrote yesterday past social media posts when i was younger do not reflect my current views period. i support this administration's agenda and will continue my communications work focused on climate and environmental policies. a white house spokesman said we're proud to have tyler on the team. back to you, mike. >> mike: thanks. >> gillian: katie pavlich is a fox news contributor and hans is -- so different styles this week, right as we said. biden is hunkering down presumably focusing on this debate monday, tuesday, wednesday, over the weekend. he is not out there. it is not like nobody from the campaign is. i read earlier today in "politico" there are 200 events in the state of georgia this week leading up to the debates but we won't hear from the president himself. do you think it is a missed opportunity? >> the president has not been available for questioning or just in terms of access for his presidency. normal behavior. also how he ran his previous campaign while president trump was on the campaign trail. this is not different. what i look for this week is how they are preparing to talk to certain audiences. joe biden has a big problem now keeping his base and coalition together. his campaign chair is out there doing media interviews and they can't explain why they are losing hispanic voters. what will president biden say to the people he needs to keep in the party. also to nervous democrats looking at thursday and going we hope he does a good job ahead of the convention in a month and a half for the democrats in august. trump's base is locked up and speaking to everybody, obviously but also to those independent undecided voters, which there are very few. true for biden as well. different styles. typical of both of them what they've done in the past. but we'll see how the debate goes thursday. both of them will be reined in when it comes to the rules of the microphones being turned off and seated nature of the debate. >> mike: former president trump asked how he should treat president biden? >> how should i handle him? should i be tough and nasty or should i be -- should i be tough and nasty and just say you are the worst president in history, or should i be nice and calm and let him speak? >> mike: how important is mr. trump's tone during the debate. >> i suspect one of the three or four things we'll talk about after the debate and leading up to the debate. the debate is 80 hours away. i'm glad we're doing this segment now, not in 48 hours. 48 hours inclear to me the story will change at all. we've been in this position trump is campaigning and test driving lines. look what trump is doing. do you think he likes performing? i think we all know the answer to that. he will look at this as a performance. the president's team knows it is a performance for him as well. i think the crucial thing they are looking at is making biden appear like a fighter. they want to kind of convey he is fighting not donald trump but fighting for the american people. i agree that all the come partm compart compartmentalizeed, joe biden needs to show up and is a fighter and go toe-to-toe with donald trump. 80 hours, one more number better than i am. >> biden is on defense. losing in all these swing state poll. new polling showing he may be closing the gap but he is going into this down. he has to prove he is able to punch above his weight and get back in terms of competing with trump in a lot of these places that democrats should be winning, including minnesota. >> gillian: want to hear from each of you if you had to bet money on it today who trump's v.p. pick? here he is on saturday in philly. >> in my mind, yeah, nobody knows. who do you like as vp? [people shouting] >> you like j.d.? who do you like? who do you guys like as vp? [people shouting] >> a lot of variants. >> that's a focus group there. i don't know who will be the vp. we do it ever four years. >> gillian: it's always fun. >> he is like any other man. just like any v.p. selection only more so. we have to wait. >> gillian: the former president says he has decided who it is but hasn't told the candidate yet. look at the long list. according to the people in that room they all want someone different. not clear who it might be. there is only one person who looks like george washington being considered. that is north dakota governor doug burgum. so possibly he would be the pick based on a former president. >> he did have a smile for j.d. vans. >> gillian: j.d. is in the running and can carry maga past the 2024 election into 2028. >> he needs to dial a little -- dig deeper and ask why they like j.d. and sarah huckabee sanders. >> gillian: thank you for being here. have a good day. good luck. >> mike: former president trump's legal team is going back to court. a florida judge a considering dismissing the case over allegations jack smith was unlawfully appointed. jeff paul is live in fort pierce, florida. jeff. >> day two. series of hearings related to trump's classified documents case set to get underway in less than an hour at the federal courthouse in florida. much like friday. today's motion centers around trump's defense team saying the appointment of the special counsel was unconstitutional. specifically today's early morning motion centers around the funding when it comes to the employment of special counsel jack smith. trump defense wants the case thrown out for this reason in addition to their friday argument the d.o.j. regulations don't allow for attorney general merrick garland to appoint a special counsel but later in the afternoon it will be federal prosecutors and their turn to address an issue in court. they have filed a motion pushing for a limited gag order on trump after the former president made comments that f.b.i. agents were out to kill him and his family during their search of mar-a-lago back in 2022. trump said the f.b.i. was locked and loaded ready to take me out and put my family in danger. smith's legal team says the statement is not only false but endangers the lives of law enforcement. former deputy assistant attorney general did you presays the judge will have her work cut out for herself today. >> the judges have to draw a line. not an easy line to draw. they have to balance the needs to protect integrity of the proceedings and not violating the first amendment rights of the former president and others. it is not an easy task for a judge to do. >> we'll be standing by for a possible decision today which could just result in another written order that will be released by the judge in the coming days. tomorrow's motion will center around the fact that the actual search warrant itself back in august of 2022 at mar-a-lago was unconstitutional or unlawful given that according to trump's team they left out some information to the judge who signed off on that search warrant. we'll be standing by, mike. >> mike: we'll follow it all. jeff, thanks very much. [shouting] >> mike: climate activity is are becoming more active. this time they stormed the 18th green at a pga tour event. how it all ended. >> mike: catastrophic. heavy flooding forces evacuations in the heartland. there is also this. >> you know, if you are a realtor and you rely on home transactions to make a living, it is not a good story. if you are a seller it is a great story because near record prices. unfortunately if you are a buyer there is very little inventory to buy. some of the inventory that's out there is very sail. we see bidding wars. it's tough sledding for new home buyers. >> mike: larry kudlow's take on the housing crisis. >> existing home sales for may came in just over 4 million units, the lowest level in 30 years. during the trump years, by the way, home sales were running around 6 million. meanwhile, average home prices came in at $419,300, the average. that's a record high going all the way back to recorded data, which began in 1999. >> mike: it's getting more unaffordable to buy and rent ising up significantly as well. what are folks to do? >> well, my advice to would be renters and home buyers is move further away from where you want to live. the further away you are from your job, it is probably cheaper. that used to be something that mattered being close to your job. so many people working hybrid that it is not a five day a week commute, perhaps a two-day a week commute. that's what people are doing, moving farther and farther away. the problem is another data point that came out last week which is new home construction and unfortunately we aren't building enough supply of single family homes or apartments. so this problem of rising prices and high demand isn't going to go away any time soon. >> mike: i want to get the fox news poll in there. personal financial situations, 45% holding steady, 41% falling behind. just 14% getting ahead. final thought on those numbers, mitch. >> inflation, which is the reason why people feel like they are falling behind, 40% of the inflation headline number we see is shelter costs. so this housing problem is sort of baked throughout the entire inflation story. >> mike: always great to see you. thank you for your analysis today. >> good to see you, mike. >> today i have gotten the auditorium with 75 to 100 men from the east division and we held hands as commissioner stanford brought us together and we prayed for our officer. >> gillian: no such thing a a routine day on the job for law enforcement. one philadelphia police officer fighting for his life after a traffic stop. illegal migrant accused of killing a 12-year-old girl in houston. multiple crimes across the country are fueling broader concerns about the border crisis. >> the border was secure, the wall was almost finished and joe biden issued 96 executive orders changing remain in mexico. folks, the reason we're overrun now because of the policy choices of joe biden. when the sawdust settles and the engine roars the thing you care about is a job well done. but when you get your tools from harbor freight something about the job feels different - your wallet. whatever you do, do it for less, at harbor freight. ♪ introducing, ned's plaque psoriasis. he thinks his flaky red patches are all people see. otezla is the #1 prescribed pill to treat plaque psoriasis. otezla can help you get clearer skin. don't use otezla if you're allergic to it. serious allergic reactions can happen. otezla may cause severe diarrhea, nausea, or vomiting. some people taking otezla had depression, suicidal thoughts, or weight loss. upper respiratory tract infection and headache may occur. live in the moment. ask your doctor about otezla. it's payback time. all these years, you've worked hard. you fixed it. you looked after it. maybe it's time for your home to start taking care of you?
