right-wingers in his own party. congressman james clyburn, assistant democratic leader, joins me live to discuss what's going on. fast truck. fulton county d.a. fani willis wants to set donald trump's georgia trial for august 5th, 2024. how that could shake up his bid for the white house, just three weeks after the republican convention. and exactly three months before election day. and, buyer you rustin. the -- march on washington finally gets his due, in the critically acclaimed movie, rustin. the star of the movie, colman domingo, joins me live to discuss his top score worthy performance. i'm jonathan capehart, this is the saturday show. s is the saturday show. >> this morning, the federal government is open, for now. late thursday night, president biden signed a short term funding bill into law just one day before the deadline. but the -- please, hold the applause. the stopgap law, with the laddered ctiing resolution, kicks the cado the road until next year. funding some federal agci until january 19th, and the rest until february 2nd. the only silver lining in all of this is that congress has bought itself a little more time to negotiate a long term plan. and yet, that extra time might not be enough to protect house speaker mike johnson, who's only had the gavel for 18 days. in order to avoid a government shutdown, to govern effectively a chamber where he can only lose four republican votes, johnson had to rely on democratic votes. a whopping 93 republicans voted against the bill. sound familiar? it's the exact dynamic that caused his predecessor, congressman kevin mccarthy, to lose the gavel back in october. and the mechanism that hastened former speaker mccarthy's departure still hangs over the head of current speaker johnson. the motion to vacate. ultraconservatives haven't been shy about making their disclosure known. on wednesday, former trump white house strategist steve bannon called the bill, quote, abject surrender, and warned the new house speaker that he is quote, on the clock to achieve conservative victories. thanks to republican dysfunction and -- who can be more to coney and in the pursuit of right policies and spending policies, those conservative victories have been hard to come by. a frustration that was articulated this week, but congressman chip roy of texas. one thing, i want my republican colleagues to give me one thing, one! i can go campaign on and say that we did. one! anybody sitting in the complex? you want to come down to the floor and come explained to me one material meaningful significant thing the republican majority has done besides, while, i guess it's not as bad as democrats. >> joining me now is assistant democratic leader, congressman james clyburn. also the national co-chair of the biden campaign. congressman clyburn as always thank you so much for coming to the show. given the dysfunction on the republican side, is the best bet to avoid a government shutdown next year for the senate to send over appropriation bills approved on a bipartisan basis? >> first of all, thank you very much for having me. the fact of the matter is, these are money deals. money deal must originate in the house. we have got to send something over to them. they can take that something. they can buy vehicles and send something back. something more meaningful and something that makes more sense. we have to do something in the house to get the thing started. i hope what we will do that. we can pass some bills. just not all of them. and what we would do is when we get back in january, and for the next month, february, we will get some things done. maybe not to my satisfaction, but just get it done. move it over to the senate. that way we can start a process of doing things in a more meaningful way. >> i guess, hope springs eternal on that point, congressman. speaker johnson, like speaker mccarthy before him, needed democratic votes to get the measure over the finishing line. like mccarthy, johnson is facing blow back from some in his conference. will he face the same fate as kenneth mccarthy? >> i can see ham experiencing the fate. in fact, the republicans are demonstrating so much dysfunction, sooner or later the public is going to take a look at this and come to the conclusion that they have absolutely no idea how to run the government. i have already come to that conclusion. the public seems to be lagging here. maybe something will come to fruition after the holidays. >> president biden has asked congress for nearly 106 billion dollars for wartime aid in israel and ukraine. it is not in the continuing resolution. given the opposition of some house republicans, without finding ever come to fruition? can the united states not afford to send that aid? >> we absolutely, as a nation, cannot afford not to stand up for our allies! ukraine has been a great ally. ukraine has tremendous support among the nato countries. quite frankly, i think as a future nato member we must support them. i think the votes are on the republican side to do it. the fact is, this thing has got to be done without any democratic votes. that is craziness. they only have a four vote margin. if they were to do the right thing out of thanksgiving, it would be down to three. let's move forward, what's wrong with doing things in a bipartisan way? we say -- you seem not to appreciate it. the next morning, you blame us for the problem. we have now done the same thing with the speaker. hopefully he will demonstrate some appreciation and reach out to his caucus to see if he can -- the bipartisan nature going forward. that will prove his benefit. >> one more question for you congressman before i let you go. we have seen a former speaker, allegedly, elbow a former colleague in the kidney. another republican calling other senator a smurf. the republican senator trying to fight the president of the teamsters. and republican freshman accused of stealing campaign cash and pay for things like botox and onlyfans, deer view, or that is not a furniture store. congressman, you have been in congress for 30 years. have you seen anything like this? >> absolutely not. the fact, you have to get way back in history to see anything quite like this. i just happen to be a leveller of history. i remember, preston brooks in south carolina came on the floor of the senate, over the issue of slavery. i think you have to go back about that far. you are talking about the 1850s here. in the run up to the civil war. it seems as if that is what they've got going on in the republican party. a civil war. they had the same margin that we had when we were in the majority in the last congress. four votes. we had differences. we are not a monolithic party. one thing we do have, which they seem not to have, that is civility. civility! i believe very strongly that, we ought to be conducting ourselves in the body the way we would like to see our children conduct themselves in their classrooms. i don't think that what we have seen in recent days from the republican conference is anything akin to what anybody would be teaching their children going forward. t anybod james clyburn, it makes congress look like an episode of baby's kids. congressman, thank you very much, as always, for coming to the saturday show. joining me now in studio to continue this conversation, kurt by teller the contributor the l.a. times, and house spokesperson and luke broadwater, congressional correspondent anthony your times. i'm so glad both of you are here on set. luke, let me start with you. congressman clyburn seemed to kind of hopeful, or confident, that the house of representatives could get its act together before the next funding deadline. to send bills over to the senate and get them passed and to the presidents desk. is he overly hopeful? is the dynamic there in the house there for that to happen? >> i think that is, somewhat, optimistic. the house republican so far have been so dysfunctional on getting their act together to both right and pass and rally around these spending bills. look, it is possible. the divisions in that party are so deep right now between the freedom caucus and the more mainstream conservatives. it is going to be difficult for them to rally around any single piece of legislation. >> correct me if i'm wrong, the motion to vacate is still there. that still hangs over speaker johnson's head. >> yes, that is correct. >> any rumblings that anybody is going to exercise that option in the way than congressman matt gaetz did against, now congressman, kevin mccarthy. >> speaker johnson is in a little bit of a honeymoon phase right now. because there was so much turmoil during the speaker fight, and because the hard right ousted kevin mccarthy, they have taken a little bit of a step back. but, they are starting to get angry. he had a very contentious meeting with the house freedom caucus over his last spending bill. it was made clear to him that they did not like what he was doing. siding with the democrats and trying to keep government open. in some ways he could be on thin ice if this continues into next year and he keeps governing in the way that kevin mccarthy did. >> so, the speaker is on thin ice. still a honeymoon phase. but clearly, republicans don't hate him the way they hated former speaker, kevin mccarthy. is that thin ice going to crack on him? >> yes, of course it is. first of all, the speakers on thin ice might vote just be the ongoing theme song of the speaker of the house under republican rule. that is not going to change. as long as they keep this ridiculous and insane trigger to just have a handful of guys say, we don't like what you're doing. you are out. >> it just takes one with the motion to vacate. >> how is that not the first move of the new speaker to change that terrible job. why would anyone accept this job under such a terrible condition? having one vote to say, i don't like you, you are out. it is insane! nothing has changed with kevin mccarthy to where we are now with how the dynamic exchange with government shutdown. they feel the same way. they are happy just passing this two tiered approach. let's be clear, they couldn't get the job done when there was just one deadline. wanted anyone think they can do it when there is two? >> right, right. latter continuing resolution. although i never got to ask you about the dynamics in the senate. is it more likely mirror going to see the senate, on a bipartisan basis, send appropriation bills to the house before the house can even get its act together? >> as congressman clyburn pointed out, constitutionally, spending bills have to originate in the house. ultimately, the only things that can become law are the senate bill, really. you have a bipartisan negotiation over there. the president will sign ideas that originated in the senate because they won't be so far to the right, they won't be so partisan. ultimately, whatever the house does the senate have to agree with. that is going to be the thing that will ultimately pass. that is what we saw with the two tiered idea. the two-tiered idea originally had deep cuts associated with it. when the senate said they wouldn't accept those, speaker johnson took them out. what the senate wanted, ultimately, is the bill that passed. >> how likely do you think it is that the senate and the jamming the house? that is what they are talking about. the senate is basically saying, y'all can't get your act together. we have to govern this nation. we will be the adults on capitol hill and send you something all you have to do is pass it and then we can move on. >> the only way to avoid a shutdown in general is if the senate asserts itself and says, okay, you have to take this. if you don't want to take it, republicans will only shut down if they refused to act on what the senate will send them. >> we have less than a minute left before we take a break. you guys are going to be coming back in the next round. we will have fun in the next segment. can you just talk about, real quickly, your reaction to the news coming out about speaker johnson's interview he did, i think, just before he came speaker. he was talking about gods retribution on america because, as he sees it, america is going down a wrong path. who is this man? [laughs] >> he is threatening -- he wants to fight a teamster? that is gutsy! luke, in all seriousness, and that was some craziness this past week on capitol hill. is that the new normal? or, are people losing their mind simply because they have been in session for like ten weeks and they want to get the heck out of town? >> i think it is a bit of both. everyone i've talked to after that day on capitol hill talked about how embarrassing it was, how dumb it was, how we have reached new lows on capitol hill. i think there are a couple of reasons for. number one, there is so much bad blood internally amongst republicans over the speaker fight. people really hate each other. kevin mccarthy hates timber church. tim bertrand hates kevin mccarthy back. >> especially now. >> they are at each other's throats. the other thing is the incentive structure is off. now conflicts for conflicts sake. outrageous actions like standing up and trying to find someone in a hearing, these things get rewarded. other people are actually proud of how they are acting. they fund-raise off of it, they get more money, they get more likes on social media. it is both the personal bad blood in these new incentives. >> my favorite line from o'brien, you stand your bought up. before i come to you, i want you to listen to what leslie jones had to say on the daily show about senator markwayne mullin picking that fight with the president of the teamsters. >> i knew this dude was trouble from the moment line heard his name, markwayne. all one word. his parents didn't even love him enough to pick one single name for him. they just shove two names together and called it a day. calm down, markwayne, that isn't something i want to hear on c-span. it's what you hear when you watch an episode of cops. >> [laughs] i mean, we are laughing about a the republican party, house republicans are now, truly, a national punchline. >> yeah, put the punch in punchline there. it might be a good time to point out that a week from today, exclusively on peacock, is wwe survivor series. that seems like what the republic have turned the united states congress into. there are people complaining they are being kidney punched by the former speaker of the house. we have senators challenging witnesses to a fight. these are the people we are supposed to believe are going to make the case in 2024 that they should stamp our. that they are responsible actors that can right the ship of government and give the american people everything that they need. these guys can't even get it together without wanting to punch one another at this point. i'm kind of at the point, jonathan, you know what? as we would say on the playground, let him fly. let them do it. get it out of your system. it'll be the greatest spectacle on c-span history. maybe we can all grow the hello. >> that example the set for the children. they are doing a good job of that already. in the interview with congressman clyburn at the beginning of the show, he slipped something in there that i wonder people picked up on. slhe was talking about the majority. when we had the majority, we had the same margin that republicans have now. if they do the right thing after thanksgiving, their margin will be three votes. what he is alluding to is congressman george santos and the ethics committee chairman, congressman mike guest, filed a motion to expel george santos. they tried it once before, it failed. how likely are they to succeed when they come back after thanksgiving? >> i think the chances are better now. there were a number of republicans, and some democrats, who voted to save george santos last time because he said he hadn't had to process. we haven't seen the full report and the full investigation. in their view he has had that to process. he had a chance to be interviewed by the ethics committee. we now see the full result of all the investiga
