very welcome for this today. special counsel investigating hunter biden goes behind closed doors in minute answering questions. there are whistleblower allegations that prosecutors went easy on the president's son. we're monitoring this and take you there in moments. first it was one month ago today when the middle east erupted. >> iron dome interceptors, everyone go flat. interceptions taking place. >> terrorist group hamas unleashed unadulterated evil in the world. [shouting] >> bring them home. >> bill: all of that in 30 days and more, right? the future of the middle east mired in uncertainty. the israeli war against hamas entering its second month. that war follows an unprecedented terror attack in israel. tensions across the globe. watch it every day and see it for yourself. they are amped up. i'm bill hemmer, it's tuesday. >> dana: i'm dana perino in "america's newsroom." with all that activity we don't have to be reminded but worth mentioning over 240 hostages including 9-month-old baby now ten months old. they have been there a month. we hope he is all right. we'll get you the news on the war here. israel's war on hamas is prompting iran-backed militias to target americans. firing a barrage of rockets and suicide drones on u.s. bases in iraq and syria. >> bill: igniting what the f.b.i. calls an historic rise in anti-semitism at home. last week in indiana police arrested a woman for intentioning crashing her car into what she thought was a jewish school. the building was, in fact, associated with an alleged hate group. >> dana: in california authorities say a jewish man has died following a confrontation with a pro-palestinian protestor. the cause of death was a blunt force head injury. police are asking anyone who witnessed the incident to come forward. >> bill: in a moment we'll head to trey yengst in southern israel in his post today. let's start with the death in california and william la jeunesse there. what have we learned? >> ventura county sheriffs office is treating it as a homicide. a pro-palestinian protestor hit 69-year-old paul kessler, seen here carrying an israeli flag in the head with a megaphone knocking him to the ground where he hit his head on the pavement. as you mentioned protests like this are happening around the country, bill. this one was on monday in the la suburb of thousand oaks near the ventura county border. pro-palestinian and pro-israel border took up sides on an intersection when paramedics responded to a flight in progress. according to the medical examiner kessler died of a blunt force head injury. >> when i saw the fight start i saw a bull horn come across, very easy to see from where i was. >> so after the incident, some in the smaller crowd of jewish supporters wanted to cross the street and confront the palestinian protestors still chanting israel, what do you have to say? how many children did you kill today? they elected not to. >> they were like let's go and i turned around and i said don't you move. i said if you go over there, i'm going over there and it's not going to end well for anybody. >> so last night jews held a candlelight vigil. local rabbi where kessler attended services says paul was a father, husband and important member of our community. we're heartbroken by the act of violence and stand together unified. the jewish federation of greater los angeles also released a statement saying quote, violence against our people has no place in civilized society. we demand safety. we will not tolerate violence against our community and we'll do everything in our power to prevent it. now police have video of a person of interest. witnesses identified as the assailant. i saw video of the sheriffs deputy speaking to this man in a light blue shirt. he could also be charged with a hate crime. police have a news conference scheduled today at 10:00 a.m. >> bill: we'll watch that. william la jeunesse, thank you. >> dana: israeli troops pushing further into gaza city as they target the underground tunnels and terror machinery of hamas. trey yengst live in southern israel this morning for us. hi, trey. >> good morning. it's been one month since that massacre against the israeli people here in southern israel and today the israelis are bringing the fight back to hamas inside gaza strip pushing deeper into gaza. the level of destruction be behind me. israeli forces are operating in the distance in the northern part of gaza. as you said they are working to destroy the tunnel system and command centers of hamas. we do know that overnight the israelis say they've destroyed one of those command centers and recovered a number of anti-tank guided missiles and small arms. these soldiers have been operating around gaza city and working today to try and develop a humanitarian corridor for thousands of palestinians that still remain in the northern part of the gaza strip. this video here shows civilians waving white flags escorted by israeli tanks on the main road, the artery from the northern part of gaza to the southern part and an opportunity for those who didn't heed the previous warnings to get out of harm's way. we've seen today israeli attack helicopters and drones in the distance despite a reduction in air strikes. infantry troops are on the ground searching for the 240 hostages israelis believe are being held in the tunnels but also trying to kill any hamas leadership still in gaza city. >> dana: i had one question. in that video you just showed, those are -- who are those people all marching together? >> those are palestinian civilians who live in and around gaza city that didn't take the previous warnings to leave. now as the israelis are pushing deeper into gaza and are expected to start sending units into the center of gaza city, they are trying to get those civilians out of the way. this is an evacuation of civilians. israelis say they will continue trying to get people out of the way as they push deeper into gaza. wanted to ask you about this. prime minister netanyahu doubled down. >> i will have my cameraman pan up and see the attack helicopters we were talking about going back and forth and firing into the gaza strip as we speak. our cameraman will pan up to see the helicopter as we continue to talk. >> dana: i wanted to ask you about netanyahu. he said i won't play the sound bite so we can see the video but said tactical pauses are considered and have been done and he said that we've had them before. i suppose we will check the circumstances in order to able humanitarian goods to come in or hostages, individual hostages to leave. i don't think there will be a general cease-fire. a chance to comment on that as we see the helicopter you are showing us. >> look, in that interview with israeli prime minister netanyahu, it was illuminating for a number of reasons. two main reasons come to mind here. first of all, he said there will be no cease-fire. you may see a small pause in the fighting to allow more humanitarian aid to enter the gaza strip. israelis are facing pressure and make sure medical support and aid that people need as the war enters day 32. the other has to do with netanyahu's comments about what will happen after the israelis push deeper into gaza. he indicated for the first time that israeli forces will stay for an unknown period of time inside the gaza strip, occupy gaza. it will be used to secure and establish lies the security situation on the ground. if they have an exit strategy and how long they will stay. >> dana: be safe there. we appreciate it. looks like a beautiful, sunny day there even amidst the war. thank you. >> bill: back at home now, polls are open in virginia, republicans trying for more success at the ballot box in that state as its governor says hold the house, flip the senate. if they do that they would control all of government in the commonwealth and those results could serve as a bellwether for next year. alexandria hoff is live in virginia southwest of d.c. how is it looking? good morning. >> good morning to you. lots of activity today. this election today will serve as a referendum for governor youngkin. i spoke with his team a couple months back and they said he is focused on holding the house, flipping the senate. he wants to prove his strategy and today our 140 seats in virginia's general assembly are up for the taking. democrats have a slim hold of the senate. the gop taking both would insure the passage of youngkin's agenda on public safety and education and abortion. he has been heavy on the campaign trail. >> do you feel it? you can feel the spirit of virginia washing over the commonwealth. you can feel it in loudon county, folks, it is real. >> so today will come down to several hotly contested races. democrats focusing on abortion. virginia is the only southern state without significant restrictions. governor youngkin is seeking a 15-week limit with exceptions. >> abortion is on the line. access to books, insuring that we've got some common sense gun reform. issues that affecting our lives. >> election is a test of republicans' willingness to vote early. his pac invested heavily in a campaign to destigmatize it. >> we went to work to get republicans off the sidelines. it has worked. we've seen really strong early voting turnout particularly in our battleground districts. >> president biden has endorsed nearly a dozen democrats in this race. nearly two dozen. i want to point to another interesting race also taking place today. new jersey where democrats they hold both chambers. they held it for quite some time. republicans are looking to see some momentum that they saw in 2021 to pick up a few more. 120 seats up for grabs today. if republicans were to gain the majority in either chamber of new jersey that would be for the first time in two decades, bill. >> bill: thanks, alex. we'll see how it goes. candidates in kentucky and mississippi governor's races important to watch this. making their final pitches to voters today. kentucky republican daniel cameron cast his ballot at a school in louisville. that video just into us here. he is the a.g. now and he is hoping to unseat the democratic incumbent andy beshear by capitalizing on frustrations with the economy and president biden. in mississippi republican governor tate reeves is fighting off brandon presley as he seizes on the governor's low approval rating. he is looking for re-election. presley a distant cousin of the king elvis presley. >> ask himself is, you know, is this the best path? this is probably the last moment for him to do that check and it's probably good if he does. >> this was the equivalent of going to the doctor. the guy has high blood pressure will you-up set him and make him worse? that's the medical malpractice equivalent of acting like nothing is happening when clearly something is happening. >> dana: growing core use of democrats saying president biden should consider ending his re-election bid. this in response to devastating poll numbers and growing concern about his age. karl rove is here. for everybody who missed it let's put them up on the board to remind everyone. in the "new york times" poll president trump was leading biden in 5 of 6 swing states. biden campaigned is blowing it off saying that the year is 2011, 1 year out from election day in the "new york times" put out polling showing president obama trailing significantly in battleground states. flash forward to present day. "the new york times" out polling about president biden. the team has consistently proved "politico"s wrong. with your help we'll do it again next year. is the biden campaign in trouble or do they have a point that we're a year away? >> they're in trouble, big trouble. the fact that they can't admit it will put them in even deeper trouble. the poll has a whole galaxy of things that ought to concern the white house. support among young through the floor. support among latinos dropping. support among blacks president trump has 22% of the black vote in the six battleground states. the six battleground states themselves of those six battleground states the only one where president biden leads trump is in the state of wisconsin and leads him by two. if president trump flipped five of those battleground states where he is in the lead today he would go from 236 votes in the elector y'all college to 289 and with it take the white house. here is worse news. the margin over biden. they not only tested president trump, but they tested nikki haley in the six battleground states donald trump is ahead of joe biden by a combined 4%. if you take all six states together 3300 sample, big sample, trump is up by four. nikki haley not as well-known as biden or trump is up by eight. generic republican saying it's biden against a generic republican, biden is behind by 16 points. so this is bad news for the white house. better than seven out of ten in the survey in the battleground states say he is too old. better than 2/3 say he lacks the mental fitness and acuity and sharpness to be effective as president. then you get into the issues and he is in trouble with those as well. >> bill: hispanics and african-americans, that poll, if it's right, republicans have never been that high with black voters in america. want to play this clip from a couple days ago. senator fetterman and others talking about the future for the current president. >> there are two additional democrats running for president. one is congressman from minnesota, the other one is the governor of california. but only one had the guts to announce it. >> there are people on the local, state and federal level that want to raise their hand but told to sit down. joe biden, please, if you love the democrat party, if you love the people the way you say you do you will fall back and allow another candidate to win. >> bill: all right now, all evidence suggests that joe biden will be the democratic nominee in 2024. let's say they get their wish. how does this unfold? in 50 years only one president has stepped down after a first term, lbj in the late 1960s. even if biden takes a knee, what happens to kamala harris? it's not like gavin newsom will slide in there with a lot of acrimony. i see this as having significant issues across the board for democrats. >> you are darned if you do and darned if you don't. what we're looking at now is the democrats will nominate joe biden, who ran as a transitional figure and now says trust me, i will be 82 shortly after the election and count on me being at my vibrant best until 86 when i will end my second term. nobody believes that. secondly, you are right, if they try and replace him, one way is for him to do what lbj did in march of 1968 and that is say after the new hampshire primary i'm not running and people ran. another way to do it is just simply stay in until a lot of the delegates have been spilthed and step aside and let the delegates who are biden pledged delegates make the decision. my suspicion is if it does happen that's the more likely way it will happen. at some time in 2024, after a bunch of delegates have been elected, that that's the best way to do it. you know, he doesn't want to do it. he and his wife have convinced themselves that he is the only democrat who can beat donald trump. in reality he may be the only major democrat who can lose to donald trump. that's what these numbers say. these numbers say the democrats are in deep trouble if joe biden is on it. generic republican gets 52% of the vote and biden gets 36. nikki haley up by eight and donald trump in the battleground states is up by four. biden is in no good shape in any of the swing states. >> dana: fun to watch. karl rove, thank you. >> bill: nice to see you. >> dana: happening live now a large demonstration outside of the united nations. families of people held captive by hamas demanding their release. >> bill: what a scene. >> i think it well very well. you see what a scam this is. this is a case that should have never been brought. it's a case that should be dismissed immediately. the fraud is on behalf of the court. the court was the fraudster. >> bill: that was the reaction after he was on the stand all day monday in his own defense. high stakes civil trial might end his business in new york city if the judge and a.g. win. his attorney will join us live coming up momentarily here. >> dana: the democrat divide widens as quad member rashida tlaib faces new calls to stop her heinous rhetoric. >> mr. president the american people aren't with you on this one. we will remember in 2024. al. i was 5...6 years of age and i knew i was going to be a vet. once alexandra called me to let me know that bank of america had approved my loan... it was important to me. we not only just provide the financing piece, we do everything that we can to surround them with the right people. all you need is a perfect, amazing team that will guide you through the right steps to be successful. and that's what bank of america was for me. my name's eric. i am 39 years old. i've started thinking about getting botox® cosmetic for the last couple of years. i just see myself on video calls all day and i really start noticing the lines. i'm still eric and i got botox® cosmetic. i'm seeing a lot less prominent lines than i did before, the results have been subtle but noticeable. botox® cosmetic is fda approved to temporarily make frown lines, crow's feet, and forehead lines look better. the effects of botox® cosmetic may spread hours to weeks after injection, causing serious symptoms. alert your doctor right away as difficulty swallowing, speaking, breathing, eye problems, or muscle weakness may be a sign of a life-threatening condition. do not receive botox® cosmetic if you have a skin infection. side effects may include allergic reactions, injection site pain, headache, eyebrow, eyelid drooping. and eyelid swelling. tell your doctor about your medical history, muscle or nerve conditions, and medications, including botulinum toxins, as these may increase the risk of serious side effects. see for yourself at botoxcosmetic.com. ♪ hi, i'm jason. i've lost 228 pounds on golo. ♪ i don't ever want to go back to wearing a 4xl shirt or not being able to climb up stairs without taking a break. so i'm committed to golo for life. at ameriprise financial, our advice is personalized, based on your goals, whatever they may be. all that planning has paid off. looks like you can make this work. we can make this work. and the feeling of confidence that comes from our advice?
