>> it is complicated. some people may want the president to remove himself from the race. there is no alternative. the president has to make a decision. he has to decide if he wants to continue. if he does articulate a vision of how we can win the race. i think he intends to stay in the race. it is ultimately up to the delegates of the dnc convention. that gets very, very messy and will result in a lot of chaos and folks on the far left of our party creating a lot of noise which could be ultimately damaging to our chances in november. >> former obama senior adviser david axelrod tweeted out reality check joe biden is the nominee of the party nominated across the country. and cast the potus themselves decides to quit which he won't that issue is settled. discussion going on nile when few wanted to have a. largely irrelevant today. south carolina congressman. >> i have not talked to the president since friday. if he asked my opinion, i would give it as i always do. he should stay in this race. he should demonstrate it going forward. his capacity to lead the country >> first of all, if you remember , a month ago the wall street had a report. much of what we saw on tv is accurate. democrats acted like it was made up. they would not talk about it. also, let's be honest. no way they will pass kamala harris. bypassing the first african-american woman vice president. if biden was to step aside, that is behind -- beside the point. >> it is not just the white house on the line. majority in the senate, majority in the house. a lot at stake in november. is there any chance they step forward and say we have a problem. >> there is been some reporting like that. publicly saying the president needs to the race. privately there been some concerns. there is been a lot of discussion. as i said, the problem is the only person that can make this decision is the president. republicans like to think they are these conspiracies in our party. obama and clinton will come in and make a change. that is not how our party works. if he wants to step down, he can one of the things that is interesting about these media appearances is you have not seen people in those tough races on tv saying anything. they are being quiet right now and i think that that is somewhat telling. >> will there be another debate? >> i do not foresee one. why would you want to put yourself through that? a lot less time. now they are allowed to have the discussion. would not have that luxury. >> there is the trump deep states. how do you see this. >> a lot of choices that are better than the last time around jd vance is a very talented senator that can articulate the vision well. tim scott is a very charismatic senator in terms of showing up some growth that trump has made which is a weakness now in the biden campaign. i don't think he can make a bad choice, frankly. >> hoping it will be governor glenn duncan on friday. how do you see it? [laughter] >> that was worth a shot. >> i know. >> gentlemen, good to see you. the supreme court set to roll monday at one of the most consequential cases in recent years involving former president trump related to presidential power. madison rivera is live outside the supreme court with what we can expect for tomorrow. hi, mattie. >> hi there, mike. it has been quite a day. the case involving former president trump's claim of presidential immunity the most anticipated one. steps from his d.c. election interference case. last august former president trump was charged with four felony accounts related to the allegation he interfered with the election. arguing trump cannot be criminally charged with any actions he has taken. no person is above the law including the president of the united states. a federal judge refused to diminish the charges against the former president. in february u.s. appeals court unanimously rejected trump's claims that he cannot be prosecuted. during argument the court. skeptical's opening some level of protection that could send it back to the lower courts. benefiting trump as that would delay the interference case even further. virtually eliminating the chances they could be tried before the november election. >> they may come up with a nuanced view and send us back. if they send it back it may be for the trial court to determine what here was part of the function. that will take time. the caucus kit -- the clock is ticking. >> expected to hand down a ruling on monday. impacting our social media platforms posted by the users. >> live outside the supreme court. many thanks. for more on this let's bring in seth. welcome. >> fox news contributor. where is the opinion, where is the opinion. this line is critical in determining where article two begins and it on some of these issues. coming up with a nuanced view and sending us back. >> what are your expectations? >> i think they will send it back. we are in agreement there. you can't take too much of a nuanced deal. it boils down to mr. trump's actions outside the scope of his executive authority. he really is a kid to an employment case in the sense that you have jury instructions on whether someone's actions are inside and outside the scope of their work. it is a very powerful job. it is the witness test. that is when it will get remanded down. the judge will take the case. the supreme court will have a very difficult time finding executive immunity as well. it gets remanded down here it she needs 80-90 days to be able to run the trial. starting the trial in september. we will see what happens on monday with this major decision. it is possible we will have a trial here in washington in september. >> we will track that. the supreme court ruling friday. six-three decision. here is the former president on that one. >> may the supreme court ruled that biden's department of justice has wrongly prosecuted hundreds of americans for peacefully protesting on januar. we are asking based on the decision they should be immediately released. >> this leads into mr. trump's case because one of the charges that he is facing in the d.c. federal court here relates to this innovation or this delaying of an official proceeding on capital here. the president's lawyers will argue the supreme court said that as long as it relates to the alteration of alteration that can stand. i believe that this charge relates to the alleged falsification of records that were going to be counted in the presidency. it will be a defense. they did lead into. it will be an uphill battle for the president based on this ruling this past week. >> i want to be fair and show the attorney general reaction. more than 1400 defendants charged with their illegal actions on january 6 will not be affected by this decision. final thought on that case? >> i think that he has probably end part correct. the approximate people that have been convicted, only for the two are facing charges solely with respect to discount. half of those people are currently incarcerated. he has right that it is not a broad swath it will make a big deal for dozens of defendant that have been convicted of this crime. >> a lot of the political cases are getting our attention. tell us about that. >> the supreme court declared more on the administrative state two major decisions. one was overturning the chevron doctrine. giving agencies broad authority to issue rules and regulations. they blew that apart after four years. in an sec case, they threw out a civil monetary penalty ruling where someone was alleged for security fraud and in that case they merely attacked the administrative judge complex in washington, d.c. american businesses have been complaining for years that they are fighting lots of regulations , lots of administrative law judges that are in administrative internal employees of the very agencies where people are trying to get a fair take. these are big decisions from corporate america. providing more freedom for a lot of the ways that american businesses run. a big week not only for mr. trump, but corporate america as well. >> tomorrow is july 1. we
