laura ingraham, this is "the ingraham angle" from washington. thanks for joining us. they're coming for you, that is the focus of tonight's angle. once a decision was made to go after donald trump using the full force of the federal government, special prosecutor jack smith felt invincible. the ag had full confidence in his ability and the press showered him with endless adulation. >> we have jack smith, we pursue without fear or favor. he is doing that. >> his approach to personal health and exercise correlates to how he approaches his prosecution and strategy. >> laura: they loved him more when they dropped the indictment. >> jack smith's indictment here is straight-forward and narrow, but boy, it packs a punch, it is clean, calculated and i feel like it almost certainly is going to result in a conviction. >> the level of specificity and detail was profound. jack smith surgically put together this indictment. >> laura: for years trump made them feel like wiley coyote, missing his chance to get the roadrunner. ♪ ♪ >> laura: it wasn't just the press willing to ignore the precedence set by the prosecution. most of official washington was willing to ignore it, as well. they all had their reasons for wanting trump permanently sidelined from politics. for liberals, he was an existential threat who had the ability with his multi ethnic coalition and establishment gop never liked him. why wouldn't they? they are part of the swamp that trump was trying to drain. the party antitrump fever never broken no matter how much prosecutors and judges reveal their bias. if a civil rights activist would have been forced to turn over twitter or x, the media would have gone nuts. they were looking for all tweets, created, favorited, liked or retweeted by donald trump. it was a fascinating example of how jack smith is vacuuming up nearly everything. >> jack smith wanting to peer deep inside trump's twitter account, which the ex-president wielded a weapon. twitter said there are direct messages, we will have to wait until trial to see if there was anything juicy. >> laura: this is disgusting temperature is an investigation, clearly in search of a crime. this is their campaign strategy, by the way, using a taxpayer funded prosecutor to get at the private communication of biden's chief rival, hoping there is something juicy to help biden and embarrass trump before the election. >> just sit down, please. when you report fake news, which cnn does a lot, you are the enemy of the people. >> laura: not just trump smith is after, he wants to humiliate the public, too. the judge wants to expose everybody that donald trump unfollowed, followed, muted, blocked or unblocked and this jack smith warrant, by the way, including information regarding the user name associate with the accounts including information from their connect or notification tabs. clearly smith is trying to show how much power trump had, how much engagement he had over followers to build this january 6 narrative. how many people are we talking about caught up in the dragnet? as of today, donald trump has 87.4 million followers on twitter. liberals are doing everything to strip away constitutional rights and they get away with this by calling everything permanent crisis, whether covid, election deniallism crisis. they honestly believe trump doesn't deserve free speech rights or even presumption of innocence because he is too dangerous. for years mr. steltzer. >> there are 10 ways to tell if your president is a dictator. >> laura: over past few years we've seen who the real tyrants are, correct? they don't just want to sensor trump or his followers, they want them smeared, discredited and even imprisoned. remember, biden himself, repeatedly reinforces this narrative. >> president biden: donald trump and the maga republicans represent extremism that threatens the foundation of our republic. maga republicans have made their choice, they embrace anger, they thrive on chaos and live not in the light of truth, but in the shadow of lies. >> laura: after 2020, his administration was on a mission to silence parents and catholics. >> i will never let them take away your freedom, never let them take it away. [cheering] >> they want to silence me because i will never let them silence you. they are not after me, they are after you, i just so happen to be in their way. >> laura: none of us should be passively watching thiscution of trump and think it is a one off, it's not. democrats have given up on convincing people their policies are working. none of it is working. all they have is fear and shame, all they are selling the voters, they are telling you that a vote for trump is a vote for hitler. trump's reelection will mean the end of democracy, this is their campaign strategy. all the while, they are destroying faith in fundamental institutions and presiding over chaos at home and abroad. jack smith is a disgrace and any judge that allows him to make a mockery of the legal system is no better. the fact is, there is nothing special about this special counsel, one man interference machine operating without scrutiny or oversight. i'm saying tonight, it is time the house judiciary committee calls to capitol hill to testify, scrutinize everything jack smith is doing, which should lead to cutting off all funding and unhinged power-crazed prosecutor with unlimited budget, accountable to no one should have never been given this power in the first place. as far as mainstream republicans, if you wonder how things have gotten so polarized, no one trusts you to do the right thing, look in the mirror. our government is compiling enemy lists and carrying out surveillance and censorship, you are silent, that is taccid approval and the voters will never forget. you are like lobsters in the grocery store case. still moving around and completely oblivious to what comes next and nikki haley will not save you. weaponization of government against the people must be exposed and prosecuted and ended once and for all. anyone who stood silent should never get close to power again. and that's the angle. joining me now is senator josh hawley member of the senate judiciary committee and homeland security. your reaction to efforts by smith, the judiciary behind him and the lack of oversight given what's happened with the cases. >> laura, i will say this is the most unbelievable incredible abuse of the first amendment of our constitution we have ever seen in american history thachl is no small thing. we have had serious abuses in the past. this special counsel is out of control and he's doing bidding of joe biden. he is going after individual citizens here. be clear about this, he is trying to get the record of twitter users who disliked tweet by donald trump or who retweeted a donald trump post. this is unbelievable stuff and it reminds me of what happened in hong kong, what the chinese communist party did. i was on the street with protesters in the middle of the brutal crackdown. you know what they did? they turned hong kong into a police state, every camera was turned on protesters. they followed them on social media, tracked them on their phones. when you look at what jack smith is doing here, looks like the same exact thing. this is ccp tactics, communist china tactics used against the american people in service of going after this president's political opponents. courts have said, federal courts, that this administration has deliberately violated first amendment by working with social media companies. this is the president deliberately and directly ordering his white house to go to twitter and facebook, to go to instagram and to pressure them to censor speech they don't like, take down posts about school board meetings, about covid, about election issues, about the hunter biden laptop, all of those things. >> laura: sorry to interrupt, senator, the thing that i'm blown away by and this is not directed at you, is how few members of the republican party have really stood up and called this out for what it is. as ied in the angle, silence is approval in this case, when the government is used against the people who fund the government, that tyranny. i mean, where is the senate leadership on this? where is any leadership on this? >> there is no accountability and you are exactly right, this ought to be the number one issue. this is how a police state behaves. this is abuse of government power deliberately against anybody who disagrees with them, anybody who offers political viewpoint they don't like, they have you censored and tracked and followed. this is outrageous and people need to start getting impeached for this stuff. alejandro mayorkas needs to be impeached. christopher wray of fbi, his fbi violated the first amendment, there need to be consequences. it is silence and nothing is a bigger threat to democracy than this. >> laura: senator, i appreciate your voice on this, the tasid approval is from people who don't like trump. they don't understand they are next on the chopping block. thank you. ctil, never heard that acronym, it stands for cyber threat intelligence league. sounds good, right? >> this is really quite sinister. you see some of the most high-powered cyber security experts in the world who come out of military intelligence, israeli, british, the united states, claiming they are volunteering their time to work on cyber security. what they were doing was creating a censorship industrial complex and apparatus to censor ordinary americans for disfavored speech, they described it as pollution and this missing period we had, 2019, before the pandemic, we didn't know what was going on. in 2018, they ginned up the idea russia interfered with the election. now we know that is not the case. in 2019, turned out to be key year they were organizing this. in 2020, they are basically hiding and this is most shocking part, describe themselves as having physical security, cyber security and a third part, cognitive security. it is literally mind control, they were trying to stamp out whole narratives they did not want people to believe. they were trying to censor whole ways of thinking about the world, the pandemic and elections and it is shocking when you see how many people were involved and working for law enforcement and military organizations. >> laura: that is part of the reason people are still driving around with masks in their car. this just happened moments ago at "new york times" book summit, elon musk tearing into bob bob iger for pulling ads from x. if somebody is going to blackmail me for money, go f yourself. the advertisers pulling ads from twitter will be responsible for killing the platform. my question, is it fair to call companies part of the censorship regime? of course he can't. why should this rank partisan oversee any aspect of any case involving anyone in trump world? what are the remedies here for trump and others? news contributor sol wisenberg former deputy independent counsel founder and president of the article iii project. now, mike, let's start with you. to be fair, you know, this is nothing new for judge howell. she has a history of using charged language when speaking about january 6th. she once referred to the protest as about the most -- thing she had ever seen and saying more like a mob like the nazis and fascists that day. mike, what's the recourse for the trump team here? >> that's a very good question. she is a highly partisan actor. she is an obama judge. she used to work as a democrat staffer chairman patrick leahy a former federal prosecutor with loretta lynch and andrew weissman. she co-authored a legal paper with andrew weissmann from the mueller probe. she supervised the mueller probe. she has been the harshest sentencer of january 6th defendants. she even pressured the doj to sentence them more harshly seized a congressman's phone overturned by the d.c. circuit. she made gntd give them time. going twitter with them warrants with jack smith to get all these records that the government is not entitled to have. she is a left wing activist. >> laura: sol, this is why justice scalia believe that roving independent special prosecutors problematic, correct? there is no oversight. there is no real accountability here. is there any recourse at all for the trump team, given these comments made by her and some of the previous comments about how trump is a flight risk these other ridiculous comments she has made? >> there is very little recourse when you realize that they are within the d.c. u.s. district court system. i can't stress enough, laura, how dangerous this is. you know, the independent judiciary is the crown julie of the amerjewel of theamerican sy. when a judge can't shed his or her political role, it does tremendous damage to that. you know, i clerked for a judge on the second circuit, jay daniel mahon, he was co-founder of the new york state conservative party that got out of the motto elected in james buckley elected. when he went on the second circuit, that ended. he never gave a speech of any kind that was in any way political. you have to realize this when you put on the robe. she has made a number of very, what i consider, inappropriate comments and i think just bringing it to the public's attention, public shaming, filing any motion that you can is the most realistic recourse you have right now. >> laura: mike, politico said back in 2021 that judge howell believed that the feds were being too lenient against january 6th defendants saying that charges against some might understate the gravity of their actions because the chaos they contributed diverted police from more threatening members of the crowd. mike, she is out for, you know, blood, legally speaking. you know, what does that say for trump case there in d.c.? >> well, there is no chance that president trump is going to get a fair trial in d.c. she supervised the grand jury proceedings. she rail roaded him as we discussed by making his attorney turn over notes. she threatened twitter and said that if twitter -- twitter couldn't even tell trump that jack smith was getting his records because he was supposedly a flight risk. like he was going to escape from -- trump was going to escape from secret service protection. she fined twitter $350,000, $7,000 an hour for being 51 hours late in responding to a subpoena by jack smith, signed by her for millions of pages of records. she is a partisan activist. and the supreme court needs to actually do its job and correct. this. >> laura: sol, i thought the democrats don't care. they always talk about norms and they respected institutions. they don't care that this is killing the public's faith in the judiciary. they don't care. >> do you remember how upset they got?
