>> we gave update we will have tests in the coming weeks very soon. >> carley: jen psaki says more choices for testing are on the way. many americans are still left standing in the cold. todd, when it comes to testing, biden administration promised 500,000 free tests to the american people. yesterday we learned the contract for the tests, some have not been completed and will be completed over the next few weeks. maybe americans will get tests before spring, maybe after. it is a total mess, if you get covid and many people are, you have to miss work 5-10 days, get a test in order to confirm that you can come back to work. there aren't enough tests. so many people are confused and left in the cold on what exactly to do and how to handle this. >> todd: it is absolute debacle, carley, that video we keep showing of people innin loos, what are we? a third-world country? the lines look like a bread line in communist russia or a communist country back in the day when there were bread lines. biden ran on covid, there was nothing stopping joe biden from ramping up manufacture of test kits when covid numbers were low in anticipation of the holiday surge. again, i keep driving this christmas falls on december 25th every year and people gather with their family every year, you know it is going to happen, you should have been prepared. you were focused on destroying afghanistan and trying to push through unnecessary spending and destroying our economy far into the future. if they can't do testing, what hope they can do anything else? >> carley: yeah, todd, the other thing, biden administration guidance says race should be a factor when it comes to getting monoclonal antibody treatment. two people walk into a office, one white and the other hispanic or black, and they have diabetes, the black or hispanic person would get the monoclonal antibody treatment over the person, which is not fair. why don't we have enough treatment to go around in the first place? >> todd: exactly right. it is also illegal. let's remember that, discrimination based upon race is day one constitutional law illegal, it is the first thing you learn, you can't do it. race is a protected class, you can't do this. back to the contracts, you mentioned carley, why did it take so long, why haven't we signed these yet? >> no question about it, this is nothing more than election power grab by the democrats. they want to defederalize the election and take away voter id, both sides of the aisle like vote or id and want to keep that. they want to take that away and federalize the election and make it to where candidates you may not agree with or approve get money from taxpayers. it is ridiculous what they are trying to do here, defederalize the election, it is clear in article 2 section 2 clause 2 the state legislators are given the right exclusively to set the laws for voting rights for the states and union. >> carley: anothering kevin mccarthy says if he becomes speaker of the house, he would strip schiff and omar of committee assignments, take a listen to this. >> if eric swolwell, not reason he should be on intel or homeland security. >> omar should not be serving on foreign affairs. look at adam schiff, he should not be serving on intel, when he knowingly used a fake dossier. >> carley: kevin mccarthy says democrats started this by stripping marjorie taylor greene and goldbar of their assignments, what do you make of this? is it the right thing to do? >> kevin mccarthy will be speaker of the house, when he is, i have faith in kevin. he makes good decisions, this is the right thing to do. democrats have to understand, they started all this, started it with marjorie taylor greene and if the minority party is not going to be able to make their own committee assignments, if that is the role of the majority party, democrats have to understand what is good for the goose is good for the gander. i agree, eric swellwell should not be on intel, schiff or omar should not be on foreign relations, they should not be on those committees. >> todd: makes no sense why they were put on there in the first place. before we let you go, you are in cella bratory mood, georgia bulldogs won the championship. here is video of kirby smart hoisting the trophy. how excited are you, congressman? >> you know, that's a good question and this is why i'm hoping today's report is going to get a lot of attention. when you look at safety of law enforcement, no mistake, it links directly to our communities and the safety of our communities. when law enforcement thinkings fatalities are up, it can be linked to communities and crime. when you look at what is happening around the country today, there is no mistake that crime is up and that law enforcement officers are putting their life on the line daily to make sure that our communities are remaining safe. >> carley: yeah, when you're talking about crime in the future of law enforcement safety, you have to look at current events happening right now that could affect police officer safety in 2022. the nypd commissioner wrote a letter to police officers about the district attorney, the new district attorney's policies here, some of them like resisting arrest will no longer be prosecuted, armed robbery, according to him, will be charged as petty larceny. she's worried about this. what does that mean to law enforcement safety here in new york city? how did the assault happen? there were seven prior times with that person struggling with addiction or mental health. we need to get that person services. it is common sense, i don't understand the pushback. >> todd: lieutenant randy sutton is joining me. that guy doesn't understand the pushback, lieutenant, how disheartening and quite frankly, frightening is it he is ushering in criminality to the big apple? >> i got to tell you, i'm really disappointed in the voters of manhattan for electing this guy. i consider him a trojan horse district attorney. when i say that, he is literally the enemy ush erred into the gates of the city, who is the enemy of justice and the enemy of public safety. and yet, he's been given carte blanche to put in his radical ideas about criminal justice and they are literally irrationale and insane. this is -- what he's doing is he is creating the purge in new york city. i got to tell you, what we're going to see here now because of his desires to decriminalize basically everything is going to lead to a blood bath in new york. >> todd: so far, so good for criminals in 2022. here is, as of sunday, year to date robbery up 25.1%, murder up 33.3%, grand larceny up 63%. so the bad guys clearly got the d.a.'s memo, lieutenant randy sutton. can police do anything to stem the tide or is this -- are their hands tied? >> here is the problem, you have a mayor elected to try and fight the criminal surge in new york and yet at the same time, the district attorney is the one who is in charge of actually prosecuting the crimes. he's saying, i'm not doing it. when he says he will prosecute armed robbery as petty larceny, this is something absolutely unheard of. here is the reality, for the people of new york, you have elected an individual who cares nothing about the lives and the victims of criminality, he cares nothing. he cares only about the criminal. you're looking at a guy who is now ushering in, you said the golden age of criminality, you weren't really exaggerating one little bit. your previous guest marcia, talking about the officers who were killed last year. not only are the people in new york less safe, law enforcement officers themselves are less safe because of the policies that he just announced. my organization, wounded blue, deal with injured officers. last year, more than 60,000 american law enforcement officers were physically assaulted in the line of duty. new york city, you have just released the cracken when it comes down to the crime in new york city. >> todd: right. it is unconscionable. i am nervous to go back when we go back, i do not know what we are getting into. it is reality in the big apple. randy sutton, we appreciate your time. carley. >> carley: happy to have you. we are learning the biden administration is prioritizing race when administering covid drugs. is this following the science or dangerous infiltration in our healthcare system? >> dr. nesheiwat: yes, this pandemic involves every single one of us. you can pick up covid if you are vaccinated. it works to minimize symptoms and reduce severe complications. anyone can pick up coronavirus and spread it, vaccinated or not. instead of focusing on the unvaccinated, focus on need for therapeutics, monoclonal antibodies, rather than point the blame on people. two-thirds of americans are fully vaccinated, we are moving in the right direction on that. we need to focus on managing this pandemic, carley. >> todd: yeah, the biden white house is focusing on monoclonal aspectbodies in a curious way, showing race is being prioritized in administering drugs like monoclonal antibodies. here is guidance from the white house, their own words. race or ethnicity may place individual patients at high risk for progression of severe covid-19 and authorization of rab is not limited to medical conditions or factors listed above. doesn't this guidance force you to violate your oath to protect and serve and help all patients? >> dr. nesheiwat: this is medical discrimination, i treat a patient based on what they present with, not based on the color of th skin. look at core root of the problem and why they are at high risk. how do we get them healthcare they need? anyone that needs life-saving medical therapy, doctors will fight tooth and nail to make sure they get what they need. i think the focus is to see what is the core root of the problem rather than putting a bandaid on the issue. we can't deny anyone in need of medical care what could potentially make a difference between life and death. i think we need to shift our focus there. >> carley: yeah, doctor, why are we rationing monoclonal antibodies at all?
