and that should make it easier for schools to meet the requirements. president biden will leave for atlanta, georgia. the president will be visiting the cdc just after this new guidance came out. there's a live look at joint base andrews. they say that they are about to hit the vaccination goal of 100 million doses a day. they will do it today, i should say, the original plan was for the president and vice president to promote that package. but the shooting changed those plans. now the first joint trip will also include a meeting with asian american community leaders in georgia. the top concern, rising anti-asian rhetoric and violence this past year. a hearing on discrimination got heated on the hill, got personal as well. we will talk to georgia congressman hank johnson who sits on that committee. what he wants to hear from the president and vice president today in atlanta. we start with that breaking news from the centers for disease control, the cdc now saying, three feet instead of six feet in schools. only if every student and teacher and staff member is wearing a mask. that new recommendation is for all k through 12 students and communities with high covid transmission rates, the cdc recommends middle and high school students keep that six feet distance. the major chain come change aft in massachusetts schools. that found there was little difference in infection rates between schools that distanced with three feet versus six feet. every school district required masks there in massachusetts. heidi is following this story for us. jeff bennett is in atlanta where the president and vice president will visit cdc headquarters a few hours from now. i want to bring in a new york city health and hospital infectious disease epidemiologist. stand by if you can. heidi, let me start with you. what are you hearing on the ground about this new guidance? >> reporter: it's a big deal. a lot of the schools i talked to here and across the nation have said, one of the biggest challenges they have in reopening is that they don't have that six feet of distancing. i just got off the phone with the commissioner here. he said a number of districts that were doing six feet are already moving to try and do the three feet rule, trying to break agreements with these teachers unions which had agreed in a number of districts to the six foot rule. this is not however without controversy. i also talked with the head of the teachers union here. she told me, look, we have these agreements in place. the studies you are looking at, they are assuming perfect mitigation measures. for instance, 100% universal masking, even though we know there's problems with that in some high schools. at the heart, the big issue, the contention here is that these studies are not saying that there is no risk difference. they are saying that they couldn't pinpoint the statistical difference in the risk. the teachers unions are saying they believe that we are just deciding based on all of this other evidence that's coming in about the effects on children and families of having to do school in lockdown to simply assume more risk. their ask is quite simple. they just want to be vaccinated. the teachers union officials told me many of the teachers are not vaccinated as numbers are going up to the highest levels we have seen since last february in terms of community spread. the teachers here were not prioritized the way they were in other states. that is their message, is that they want the vaccine and then they are happy to negotiate about this three foot rule. we have the more contagious potentially more harmful variant comesing. if we know, they can be asymptomatic vectors. >> let's listen to what folks told you. >> what we are -- what unions have been advocating for for a year is to make sure that we win every single cdc recommendation to keep our students and their families and our educators as safe as possible. we are going to have to figure out in the light of reducing the distance how to ensure we are still keeping everybody safe. >> again, the head of the teachers union. how big of a deal is this guidance? how does it change things for teachers and students and staff? >> it's a significant change. it's a welcome change. we know it's difficult to maintain that six foot distance and trying to accommodate that and operationalize it in a school setting. you can't expand real estate in a school, especially in areas where the weather is cold. you can't have activities outside. you are limiting the number of students coming in and having in-person schooling. they are following the science, the evidence. these are recommendations. each state, each district is going to look at the risk reduction measures in the context of masking and ventilation and offering vaccinations to student and staff and see if they can implement the measure. >> forgive my ignorance here. if it's okay for students and teachers and staffers to be three feet apart what about us? can we go to three feet as well instead of six feet? >> i think that it's important we look at risk reduction measures. as long as we mask and have good ventilation, we can look and see. that's going to be different in the health care setting. each setting is different. in hospital where they say vaccinated can mingle, that's not the case in hospitals. when we look at other office settings, you will see more guidance come out with that as we have more information and we look at the risk reduction measures implemented in all the settings. >> one more question. i think for a lot of folks watching and listening, they are probably wondering, did the science change? did our understanding of the science change? do we know? >> our understanding of the science. we are in a novel situation. as we learn more information, we give more clarification, we lean into the guidance. we makeup dates and changes. when we were talking about the six foot distance early, we knew it wasn't a bubble. we know that transmission dynamics are different. based on that, we are able to change guidance. >> jeff bennett, president biden will be visiting the cdc a few hours from now. what do we know about the president and the vice president's plans while they are there? >> reporter: the white house said the president and vice president would get an update from their medical and health teams about the ongoing effort to combat the pandemic. you can bet this will be part of it. i think they really articulated what this means from a public health perspective. i can tell you politically, president biden is closer to meeting his articulated goal of having more -- as many schools as possible open safely within the first 100 days of his presidency. today as you mentioned, he will meet that self-established goal of having 100 million shots in arms within the first 100 days, about 40 days early. with schools being able to reduce the space between desks from six feet to three feet, that means that more schools can open for in-person instruction. i can tell you, based on my own reporting, that there have been school districts that have been open -- small school districts across this country open for most of the year in person. they had been doing this already, enforcing three feet of distance and not the six. in part, because the academy of -- american academy of pediatrics had called for that. i think we will hear more from the president about that and about the ongoing effort to fight the pandemic and to stand up the vaccines. one of the things that teachers unions want to see is teachers and staff members are fully vaccinated before they head back into classrooms. >> jeff bennett, stand by in atlanta. the cdc again in this new guidance also saying that in communities where transmission is high, they are recommending middle school and high school students remain at least six feet apart if schools aren't able to keep studens and teachers in assigned groups. do you worry that may cause confusion? >> it does make sense. if you look at the data, you see that children in the younger age group, in elementary school, when we look at the cases, infection rates and hospitalization, it's very, very low. children in that age group are less able to spread and transmit coronavirus. when you look at high schoolers and teenagers, it's different. it's more complex when we talk about the transmission. you are able to see that, for example, teenagers are able to spread the virus more efficiently. in that context, you will maintain a six foot distance. maintain the current guidance in place. >> a big thanks on this friday. jeff stand by. i want to zero in a bit more on president biden and vice president harris' trip to atlanta. let's bring in blayne alexander. she's there in atlanta. on top of the visit to the cdc, in a few hours president biden and vice president harris will speak to asian american leaders in georgia. jeff bennett, what more do we know about what the president and vice president's message is going to be to them? >> reporter: i'm told that they want to convey their support. this will be the first joint trip by the president and vice president. this visit had been scheduled as part of their so-called help is here tour to tout their $2 trillion -- nearly $2 trillion covid relief package. this trip was already on the books. it was understandably -- the focus was transformed in light of the shootings here in atlanta earlier this week. the bulk of the trip now, both the president and vice president will spend at emory university, meeting in private with asian american community advocates and elected leaders. they will hear them out. beyond that, the president will deliver remarks at around 4:00 p.m. eastern, in the 4:00 hour. i'm told the president and vice president are keenly aware of the ways in which members of the asian american community have faced increased discrimination. added on that is a new layer of trauma in light of the shooting. the president will talk about what he has said and done to address this issue and what more he can do to bring the full resources of the federal government to bear on this issue. >> let's talk more about the victims here. we have not heard a great deal about them over the past few days. what more can you tell us about who they were, about how they are being remembered? >> reporter: craig, unfortunately, we haven't heard too much about them, because there are four that haven't been publically identified. there were eight people who were tragically killed. we only know the name of four victims. that's because they are having a difficult time getting in touch with the family members of the other four victims. they are working with the consulate, other officials trying to contact loved ones, some of whom may be overseas, and let them know about the tragic events. once they have done that, they will release the names. that's one hurdle officials are coming up against. as for the victims we know, we know of the four people killed, these are the people that were killed in the first location, about 45 minutes north of atlanta. i have been in touch with family members of several of them. one is a sister. they kind of describe her as the rock of the family. she would open up her home and let people come and stay when they didn't have a place to stay. she would throw parties, birthday parties, holiday parties. she and her husband, who just got married last summer, had gone to the spa together for a quick getaway to have time to themselves away from the children. they were both there in separate rooms. he was there. he heard the gunshots and heard what was happening. he was able to get out uninjured. unfortunately, she was killed in the attack. that's one portrait of the many people, the many lives that have been shattered in this. >> what more can you tell us with regards to the investigation? >> reporter: sure. that has a long way to go. that's something that atlanta police have been repeatedly saying that -- trying to underscore that even though the suspect was captured hours after the shootings and even though he has been interrogated by police, we have gotten trickles of what was said, atlanta police say they have a long way to go before they are able to pin down what they are calling a motive. they are being strong in the fact that that's one of the big focuses. everything is on the table. they are not ruling it out. the big question is, is this a hate crime, per se? was it motivated by race? was that the driving factor in this? they are looking closely at that as well as a number of other possibilities. as for the suspect himself, you notice we haven't seen him in court. we haven't seen him publically. that's because the calendar date was -- the court date was on the calendar. his attorney asked that be canceled. there's no date set for any future day. we don't know when we will see him publically before a judge. >> do we know why his attorney wanted it canceled or delayed or postponed? ( horn blaring ) breaking news now in the derek chauvin murder trial. first, the judge there on the left side of your screen, he has declined the change of venue request for the defense. that means that trial will stay there in minneapolis. shaquille brewster outside the courthouse. that's the first bit of breaking news. shaq, i understand that the other bit of breaking news is that we have our 13th juror, who has just been seated. what more can you tell me about that? >> reporter: that's right, craig. in the past couple of second literally, we got our 13th juror. the court just needs one more to complete the jury panel in the trial of derek chauvin, the officer accused of killing george floyd. this has been a significant news day in terms of the trial. the judge this morning denied motions from the defense, from the attorneys of former officer chauvin, to delay the trial and to move it out of the city of minneapolis. i want to play you a little of the judge explaining why he decided to make this decision. before we do that, i want to set it up by making the point, the reason why the defense was asking this is it goes back to the settlement between the city of minneapolis and the family of george floyd. that was something that got a lot of attention over the course of the weekend. the defense asked for the judge to delay this to let things calm down a little bit. this is what the judge said today. >> i do not think that that would give the defendant any kind of a fair trial beyond what we are doing here. i don't think there's any place in minnesota that has not been subjected to extreme amounts of publicity on this case. >> reporter: those were losses for the defense. they were calling for the delay and the change of venue. they did get a partial win involving some evidence from 2019, a 2019 arrest of mr. floyd that fit a similar fact pattern to what happened on may 25th, the day george floyd was killed, of course in 2020. the judge said, some of the evidence does qualify as medical evidence. he is allowing some of the evidence to be admitted in trial. that's reversing a previous decision he made months ago. the defense had a partial win on that regard. in terms of the top lines, the headline of the change in venue and delaying this trial, the judge denying those motions from the defense, craig. >> shaq, with this new juror, this 13th juror, a lot of folks are very interested in the makeup of the jury and whether it will reflect the demographics of minneapolis. what can you tell us about how the jury looks, their backgrounds? >> reporter: right. the reason why i'm looking down is because i want to get the numbers right. with this juror, who is a woman, this means that this jury will be a majority of women, which is opposite of how this started. it started with a majority of men. now this means there have been eight women seated to this panel. so far, five men. we have one more to go. we know that the majority of the jury will be compiled of women. in terms of the racial breakdown of the panel, we don't know the race or ethnicity of this last juror to be seated. before the juror was seated, we knew there were six members who were white, four were black and two identified as mixed race. in terms of the ages, we know the youngest is in the 20s, a man. we know one of the oldest, excluding this latest juror, was a retired woman in her 60s. that's what we know about this jury at this point. it's important to note that the jurors will remain anonymous through the process. the information that we have now, which is all information provided by the jury to the courthouse and then the court is providing that to us, that is all we are going to know about these jurors until the end of the trial when the judge deems it fit to release the details of the jurors. >> we should point out that that's one reason we are not listening in during those proceedings so as not to accidentally identify a juror or a potential juror. shaquille brewster on top of it outside the courthouse there in minneapolis. just a few moments ago, president biden leaving the white house, bound for atlanta. the president took some questions. what he said about russia, what he said about china, what he said about covid coming up in a few moments. the house just passed a pathway to citizenship for so-called dreamers. can it pass the senate? >> i'm sure we will talk at some point. >> have you imposed sanction on russia? >> that will come in time. we hope we can keep the pace about 2.5 million a day, which would mean we may get to -- may be able to double it. we met the goal and continuing to move forward. thank you. >> that was president biden a few moments ago before he boarded marine one en route to air force one en route to atlanta, georgia, this afternoon. you heard the president there expressing confidence in his secretary of state. you heard him brag a bit about meeting that 100 million shots in arms goal. that happening today. the president saying that we are right now vaccinating roughly 2 been the 5 million americans every day. the president saying he is hopeful that that will speed up the process of vaccinations as we watch president biden there wave and board marine one as he heads to joint base andrews. told that his son hunter biden was there on the balcony waving to him as the president heads to atlanta. we should note this will be the president and vice president's first joint trip together since being elected. more on that in a bit. right now, two bills now head to the senate could provide a pathway to citizenship for millions people. one of the bills passed by the house thursday is the american dream and promise act. it would provide a pathway to citizenship for the millions of so-called dreamers who came to this country undocumented as children. the other is the farm workforce modernization act. it would create a system for undocumented workers to apply for legal status and let farm workers apply for a green card. it's not clear if it has enough votes to pass the senate. neither would have a measurable affect on the surge of migrants at our southern border. gabe gutierrez is getting a look at the surge in the rio grande valley. he is in brownsville, texas, talking with people who are making that difficult journey. >> reporter: good morning. customs and border protection says it's detaining on average more than 500 unaccompanied mine -- migrant children each day. here semantics is secondary. at the southern border each night, they finish their long journey by crossing the rio grande. they just came through the brush. they tell me they are exhausted and that spent weeks trying to get here from guatemala. they are 15, 16, 17 years old. they don't know what's next. they claim to know little about u.s. politics. did you decide to cross because of president biden? no? some law enforcement officials attribute the surge to the biden administration's policy shift, allowing unaccompanied minors to stay in the u.s. >> seems like we just went through this not too long ago and here we go again. >> reporter: there are nearly 10,000 migrant children in federal care. according to new data obtained by nbc news, more than 500 migrant children have been in border patrol custody for over ten days, far longer than the 72-hour legal limit. many republicans are calling it a crisis. the white house insists it is not. despite the biden administration's stated policy of sending migrants who arrive to the u.s. as part of a family back across the border into mexico, customs and border protection is releasing more families into the u.s. because neither mexico nor the u.s. has space for them. >> families who are apprehended at the border are also immediately expelled, unless we confront a limitation on mexico's capacity to receive them. >> reporter: as the white house urges mexico to limit the flow, it announced thursday that it was sending 2.5 million doses of the astrazeneca covid vaccine to mexico, raising questions of a quid pro quo. >> i wouldn't read into it more than our ability to provide, to lend vaccine doses of a vaccine that we have some available supply to a neighboring country. >> reporter: the battle at the border comes as the house passed two immigration bills, including a pathway to citizenship for young, undocumented immigrants. >> we have a broken immigration system. it has been that way for decades. it's time we get about the work of fixing it. >> reporter: but those bills are expected to hit a wall in the senate where republican votes are needed to avoid a filibuster. here at the border, resources are stretched thinner each day. >> gabe gutierrez for us in brownsville. thank you for that. we have learned that homeland security secretary mayorkas will make a trip to el paso, texas. the secretary will be joining a bipartisan delegation of senators to view operations, get a briefing on the sheltering and transfer of unaccompanied children. at this moment, more than 500 migrant children have been in border patrol custody for more than ten days. that exceeds the three-day legal limit. julia ainsley broke that story for us overnight. she joins me now. the surge at the border, it shows no signs of slowing down here. the facilities, housing the children, far past capacity. what's the holdup here? >> reporter: well, the holdup is with health and human services. we saw a similar situation in 2019 when there was another surge of children under the trump administration. basically, health and human services takes a long time to be able to bring more beds online. we saw last weekend they called in fema to set up two new facilities. those have opened this week. one in dallas and one this midland, texas. when we spoke yesterday to biden administration officials, they said that another possibility is to get more beds in the existing facilities, but to increase covid precautions. double masking and more health care professionals. they are desperate because as you see, they are over capacity, especially in the border patrol stations. we know where they set up a facility just to process more children and more immigrants, they had over 3,300 as of yesterday. the capacity is for 250. >> julia, quickly here, we just pointed out that 500 of the children have been held more than three times as long as the legal limit. is there a penalty? is there consequence? >> reporter: there's no penalty that we know of. it has been done before over past surges. under the law, this is in laws passed by congress to protect vulnerable populations, you are not supposed to keep any immigrants in these conditions over 72 hours. that has a reason. for a lot of the children, they are sleeping on mats with aluminum blankets. they have minimal time to go outside. the lights are kept on 24 hours a day. we do understand they get three meals a day and they have access to snacks. it's not the place for anyone for a long period of time, let alone children. they are being pushed to get the children out of the facilities as quickly as possible. >> julia ainsley on breaking news there. thanks. a few hours from now, president biden and vice president harris will meet with local leaders in atlanta's asian american community. georgia congressman hank johnson will join me. we will talk about how they are going to try to comfort a community in mourning. just moments ago, more names of the victims were released. we will pass that on as well. later, more than a million covid shots have been given in the united states. what about people who can't get appointments, people who can't get online? >> yes, our brothers and sisters of asian heritage are living in terror at this point. they feel that anything is possible, bad things are likely to continue to happen. so they are afraid. when they hear comments from people who try to somehow excuse the violence against their people or if they try to distract attention away from violence against our asian brothers and sisters, they look at that as a signal of folks not caring and so, therefore, let it continue to happen. i'm so happy that president biden and vice president harris are coming to georgia today to console and to aid and comfort the people who, as i said, are living in a state of terror right now. >> congressman, stand by for me for a moment, if you can. we have more breaking news out of your home state of georgia. we just got new details about the remaining victims of the spa shootings. blayne alexander is standing by. what more can you tell us? what more do we know at this hour? >> reporter: we have just within the past few minutes learned the names of the four remaining victims, the four killed during the rampage tuesday. soon park, young grant, yong yu. we know they range between the ages of 51 to 74. these names were being held up because atlanta police were having a very difficult time getting in touch with family members. they worked with the consulate to make this happen. some of the family members lived overseas. it was taking a long time to notify them. those names have been released. we know the full breadth of the eight lives taken during this attack this week as released by the medical examiner's office. >> thank you for -- blayne alexander in atlanta. congressman, it got heated between congressman chip roy of texas and democratic congresswoman ming of new york. this is what congressman roy -- this is what he said that's getting a lot of attention. >> now we are talking about whether talking about china, the chinese communist party, whatever phrase we want to use, if some people say we think those guys are the bad guys -- >> your president and your party and your colleagues can talk about issues with any other country that you want. you don't have to do it by putting a bulls eye on the back of asian americans across this country, on our grandparents, on our kids. >> congressman roy tells nbc about his opening remarks in part. quote, we need more justice and less thought policing. no apologies. what say you, congressman?
