widening as liz cheney is censured by her state's own party. it makes her the latest republican to face backlash from her own side over her vote to impeach trump. $509 million that's how much trump's election lies have reportedly cost american taxpayers. and the battle of the ages fwop great teams face off. we'll see the largest age gap between opposing quarterbacks in super bowl history as many gather for super bowl watch parties today, the u.s. surpasses 27 million covid cases. on this sunday, february 7th. good morning. >> patrick mahomes was 7 years old when tom brady won his first super bowl. >> no? >> yeah. >> my mind got blown. >> exactly. we're live at msnbc headquarters in new york. we have a team across the country for us. our correspondents and analysts are standing by following the latest including mariana sotomayor covering impeachment. monica is in west palm beach with the latest on trump's defense strategy. and we have mike in delaware following president joe biden. we start with you, mariana, this sunday morning. we're about 48 hours away from trial kicking off. what can we expect? >> hey, good morning. yeah. it's been almost a month since we saw the house formally impeach former president donald trump. now it's the senate's turn to decide whether they'll convict or acquit the former president. we don't really have a firm schedule except for the fact that the impeachment trial begins on tuesday. for republicans and democrats in the senate don't want it to go on forever. the last impeachment trial lasted three weeks. they're hoping they can get it done by next saturday, which would be less than a week. and i'll let monica talk about trump's defense and what they're going to argue. when it comes to the house impeachment managers, all of them democrats, they're going to try to appeal to senators' heart strings. all of these elected members of congress in the capitol as the insurrection took place. it was a joint session of congress and that's why the former president told his supporters whether it was via tweet or at the rally they should go fourth and try to one last time to very much to try to flip the election results. even though there was no possible legal way for that to happen. at least on january 6th. now house democrats are also expected to point to rhetoric. it was the president many a time who started the message. they'll be pointing to reports of ongoing fbi investigationings. especially since they talked to a number of people who stormed the capitol. many of them saying that message stop the steal motivated them to try to confront and some violently wanting to, at times, say they wanted to kill members of congress. all of that, they're hoping, will appeal and win over 17 republicans. we don't know if there are that many yet. but very much trying to remind republicans how they felt in that moment because you remember even hours after that insurrection happened, many republicans, including ones that supported the president, saying that he had to bear the brunt and had some responsibility in inciting the violence. that's what democrats will try to remind and push so by the end of the week they have enough votes to make sure trump never serves in office again. >> kevin mccarthy saying he deserves some of the responsibility but backtracking. monica, the former president has been clear he won't testify in the trial. what should we see? >> reporter: that's right. we're getting a few more details but really the former president's legal defense team, more than anything, at this point, is projecting optimism. they say they feel extremely confident this trial will actually be very short in nature. david and bruce both expected to be less than a week starting on tuesday, of course. they also are now indicating they are also planning to use some video. as part of their presentation. we know that democrats are certainly going to be using the real time imagery videos and photos and lawmakers accounts of what happened on january 6th. now we have bruce caster saying they plan to use democrat's own words from the last year or so when we've seen social unrest across the country. that's a bit of a new development and detail they haven't shared before. that's all they're talking about. they're continually arguing, they feel, on the merits of the case. they're going it say it's an unconstitutional proceeding and you cannot convict a former president since he's no longer in office. that's really the crux of their case. they also believe, backed back when they say is their own constitutional experts here, there's nothing that democrats can come and do and say that will change that. they're going to rely on that but they also haven't completely ruled out whether they would bring any witnesses or add additional testimony. we don't believe so at this time. we don't know it from the other side whether they'll be bringing additional in. something else we're watching for is whether we'll hear from the former president in any capacity while it's ongoing. we know he won't submit any testimony, written or oral, but will he call a press conference or go and do media interviews? these are things he hasn't done since he left office. and the other kind of interesting remaining question, we know snigs in addition to the two attorneys we mentioned previously, there's a third one added to the roster who will be in the chamber defending donald trump. we still don't know who it is. as you remember, guys, we talked about it last weekend, there was a team of attorneys in place originally a much larger one that ended up leaving because they didn't agree with donald trump on the legal strategy. it's unclear who the third person is but we know we expect to see them and this person will be speaking on camera as a part of the former president's defense. >> in the meantime, the wilmington west wing or white house. there's new strategy coming out with biden trying to turn the focus away from impeachment trial this coming week. what exactly are the plans? >> reporter: well, ken dis, you heard mariana say democrats and republicans on capitol hill are hoping if are quick impeachment trial. that's the case among biden officials who will do their best to keep their focus on pushing the american rescue plan. they're at $1.9 trillion effort to get the vaccine program and to get the economy back on track here. and we saw the white house here begin to unveil a little bit of what their counterprogramming strategy will be yesterday as they unveiled their new take on what you used to be called the president's weekly radio address. in the biden administration, it took the form of a one-on-one conversation between the president and a woman in california who lost her job as a result of her company's reorganization because of the pandemic. this was a conversation designed to showcase the president's empathy. something they think connected in the campaign and continue to connect with american voters during the course of his presidency. and what we're hearing from white house officials is that over the course of the week, yes, everyone in washington will be focussed very closely on that impeachment trial. the rest of the country is still eager to hear more about the president's plan. so you might see the president convene meetings with mayors, governors to try to sell this proposal outside of washington. you might also see him make some visits to federal agencies to talk about specific parts of the deal. and, yes, maybe folks in washington aren't going to pay attention but they continue to reinforce the idea that this proposal is widely popular among the broader swath of the american public and want to pressure lawmakers in washington to support it. part of that, as well, we'll see the president doing that pregame interview with cbs news taped on friday. it's traditionally part of the super bowl programming. a new excerpt released overnight in which the president talks about his son hunter and his emotional battle with substance abuse. let's take a listen. >> the honesty with which he stepped forward and talked about the problem and the hope, it gave me help reading it. i mean, it was like my boy is back. you know what i mean? anyway. i'm sorry to get so personal. >> so clearly the president emotional talking about what has been a difficult moment within the family. remember that moment from the debate against president trump during the fall campaign. now a lot of questions, of course, about why the president has been here in delaware. one of the reasons, in fact, it's hunter and beau biden's birthdays this week. we know the anniversaries, the milestones are important to the president. we were expecting potentially to see him visit his son's grave site as he often does when he attends mass. we saw the president getting a check up. he visited to get an x-ray on the fractured leg. you remember the dog-related injury. he's getting a clean bill of health. his doctors said the leg is fully healed, guys. >> i know too well about the dog injuries. [ laughter ] mariana, we want to talk about something we mentioned at the top of the show. liz cheney the latest to be censured by her own party. by bsh state republicans in wyoming to impeach trump. she held on to her leadership role in the house. >> reporter: that's right. you showed the graphic showing five out of the ten republicans who voted to impeach the president. all of them being censured or rebuked in some form or fashion by their state parties. liz cheney not backing down. she actually said in a statement that her vote was driven by the constitution and that she took an oath to protect it. now, that is something that she also said behind closed doors when it came to that vote. whether she was going to remain in leadership. that vote happening a couple of days ago here on capitol hill. we did see a difference and a clear divide within republicans in the house. whether they define themselves as a party of trump or of these more traditional conservative values, we remember congresswoman marjorie taylor greene that vote was public. many republicans voting to make sure she stayed on the committees. well, in a secret ballot, a majority of republicans also wanted to make sure that cheney stayed in leadership. that's different than what we've been hearing publicly with a number of republicans wanting to not just see her gone but gone from leadership but potentially gone from office in two years. so very much a division that will continue here, especially in the house about whether this republican party defines itself and will continue to follow what former president donald trump has done to the party or if they will continue to revert back to where they even were five years ago. >> quite a lot to get to, as we begin this morning. thank you all. we'll dig deeper into this now with the founder of 43 alumni for america, john varner and danielle moody. john, the last time you were on, you said the division in the republican party gives it a chance to reinvent itself. you heard there liz cheney is censured -- >> don't hang your head. it's okay. >> ben sasse has been censured. >> a lot to hang my head on. >> let's say the republican party is a car. how is it driving now? >> it is driving all over the road with not much direction. needing to fix the gps on the car quickly. first, thank you for having me. you know, great super bowl sunday being up this early. excited for tonight. >> you're welcome. >> and, you know, i wear these censures with a badge of honor, if i were liz cheney and the other colleagues of hers on capitol hill who have been censured by the republican parties. these are folks who took an oath of auchs to protect and defend the constitution of the united states and to be censured for doing that is beyond my wildest comprehension. yeah, i would -- it is -- right now we're without a leader. without anything but a wild debunked conspiracy theory driving the party. we need a responsible adult to stand up in the gop and give what the american public deserves. two political parties based on a foundation and belief in american democracy. right now it's just the democrats. it's not the gop. >> they should wear it as a beige of honor. that's a note taken from cindy mccain's twitter page saying she wears it as a badge of honor. her late husband was censured and she was, as well. the "washington post" releasing a new analysis. they tallied up the cost of trump's voter fraud claims. how much they cost american taxpayers. they found the total is $519 million. the majority of it going to the insurrection, the inauguration, of course, the repairs that needed to be made to the capitol, all the security challenges, the legal challenges here. do you think this will come up in the impeachment trial this week? >> i hope it comes up on a giant white board that the democrats put together. this insurrection and incitement by the president cost the american people more than just $519 million. it's cost us our ability to have peaceful transfers. it cost us the ability to have elections that the entire country believes in. right. not just people that voted for the democrats. it's unfortunate that this party that has stood for what fiscal responsibility just continues to blow millions and millions and millions of dollars on donald trump's lies. and on top of that, you see that other companies, you know, like smart tech are suing fox news, suing giuliani for billions of dollars for the lies they have been spewing out to the american people. so i hope that all of these things are brought out to the public this week when we see the impeachment trial. it's true! this is what donald trump has cost america. he cost american lives with his lies and he cost us tens of millions of dollars in terms of our taxpayer dollars to rebuild our capitol building. >> i'm curious to get your take on biden's counter strategy here. you heard mike there in wilmington detailing it. saying he plans to counter part to a busy schedule next week. touring a vaccination center, taking trip to the pentagon. is that a smart strategy? why not have the limelight of the impeachment play out instead of doing something else? >> it's not only smart but refreshing. having a president that is willing to do the work that needs to be done is a refreshing thing we have going on in the united states right now. donald trump needs to be held accountable. it's up to the senate right now to convict based on the legal impeachment that occurred while he was a sitting president. that's not joe biden's job. joe biden's job is to lead america to get beyond the pandemic and rebuild our economy so we can move on with our lives response we can go to the super bowl, so we can go to bars tonight. that's what we want and joe biden is leading us do that. it's not his job to look backwards at what happened on january 6th. that's up to the senate. not joe biden. >> what is a bar? >> you see the video the same way we do. after the fact. it doesn't mean we have not spoken to every single one of these business owners and they all clearly know the rules. >> reporter: nationwide the trends are finally moving in the right direction. cases are down 19% in the last two weeks. with a death toll quickly approaching half a million in the u.s., officials across the country are asking people to stay home this weekend to stop another surge. >> if you want to do a super bowl gathering, it should be just people immediately in your life. >> please do not attend in-person super bowl parties this weekend. that can be a super spreading event. >> and we should point out that was sam brock reporting. thanks to that. places like california, los angeles, they're opening bars but banning those bars from turning on their tv to try to prevent it. >> sports bars saying what's the point. >> exactly. yep. >> there's a reason why experts are warning the super bowl parties could be super spreader events. look at what we saw after the holidays. about 99,000 new coronavirus cases after thanksgiving. 175,000 cases after christmas and new year's day. dr. calvin knows firsthand. he's been treating patients in the er in new york city. doctor, good morning. it's good to see you. but, you know, when we do see -- we see videos like we saw, umm, when you see people partying and hanging out like there's no pandemic going on. what goes through your mind? >> i'm exhausted. i'm tired. i'm exhausted for now. you can hear it from my voice. i think i've given up trying to change everybody's opinion or it's not my place to. i tell people the honest truth of what could happen and the consequences. and i think the most awful thing is "not again." usually it's a rapid test it comes out positive, i usually say were you in miami in a boat on new year's and some patients go how did you know? it's flabbergasted people are surprised. actually, in my opinion, some people are not surprised and go and do it anyway. they're just fatigued by the whole crisis that has been going on. >> in four to ten days, whatever the incubation period is, are you going to be talking to the positive patients and say did you share a bowl of chips and dip on super bowl sunday? >> where were you on super bowl sunday when they come in with a positive tests. the rapid tests we have are so fast. within 15 to 30 seconds we're able to tale with good accuracy. they usually have symptoms to go with it. it's disappointing and there's nothing much i can do, you know, at this point, the tooth paste is out of the tube. and the most we can do is do better. but i think it's been a whole year now so it takes a lot to surprise me now. >> you know we hear about hospitalizations trending down, which is a good thing. we want to see that. then we see the new highly travns -- transmissble variants traveling across the country. is your hospital preparing for another surge? >> when you see things -- you came to my house, set it on fire, and now the flames are going down, but you're coming back with a can of gasoline. the bar has been set low for us to be hopeful. i'm happy things are trending down but it was really bad. so when we hear things about people having, you know, indoor gatherings for super bowl sunday, we're preparing for the worst again. we're holding our breath and hoping for the best. hopefully vaccines will kick in. at this rate with the lack of supply of the vaccines, it's anyone's guess but i think it's going to get worse. >> top of mind for everybody now, too, is kids going back to school. the cdc is going to be releasing guidelines this week showing it's safe to go back, even for teachers not vaccinated yet. we see what happens in chicago. they're expecting teachers to show up for work tomorrow. if they don't, they could get locked out of the systems. what does the data show? msnbc reporter is in the politically diverse milwaukee county. i was giggling because i was told beforehand that the real feel temperature in milwaukee is minus 20 degrees. thank you so much for doing this. you spoke with voters. start with the republicans. what are they saying about the impeachment trial, amanda? >> reporter: good morning, khendis. it shows my commitment to you. it's a story we felt was important to do. come back to this county, an area fwe tracked throughout the 2020 election. milwaukee, an area that boosted about 15,000 additional voters in the turn out for the 2020 election. as you noted, joe biden only narrowly won the state by about 20,000 votes. we wanted to talk to voters here across the political spectrum to understand ahead of this second historic impeachment trial of donald trump if it made a difference to them. and for the republican voters that we spoke with, they felt it wasn't necessary. it would further divide things. so i want you to take a listen to some of my conversation with dennis in june here in milwaukee county. take a listen. >> at this point in time, i think if they want unity, it's not a good way to get it. i think if they want unity, they should stuck with a few of trump's policies. >> they tried the first time to do impeachment, and to do it again, you know, it seems like we're coming from scott walker area where they tried to recall him. so it seems like every time a republican wins, they'll find fault and try to get after them. >> i think if they had spent more time on policies, rather than trying to destroy the republicans, they would be doing a better job. >> reporter: so they're hearing this as not trying to further unify the party or the entire country with the impeachment to hold someone accountable. they're see tk as further divisions within their own party and just people coming against them as they saw with their own areas with governor scott walker at the time. >> amanda, we spoke with some democrats. what did they have to say? >> reporter: well, as you can imagine, the democrats took a different approach. they felt there was that need to hold trump accountable, especially for inciting the violence at the capitol. without holding him into account, they felt it was something that could be setting a bad precedent for future presidents. i want you to take a listen to some of my conversation with karen and jeffrey, some of the democrats here in this county. listen. >> i think it's critical that the impeachment move forward because the only way to unity, true unity, is through truth being told and accountability. so i am very much invested and that's pretty much what i hear around me that this will forward and that the process itself have integrity. not just be a sham of a process. >> i want to see it move forward so that future presidents don't follow the same path. you know, hold him accountable for what his actions were and make sure it doesn't happen again. >> reporter: so i can attest, the sub zero temperatures here are not thawing any of the political divide moving forward. >> yeah. it's interesting to hear them speak about unity yet reflect how divided we are. amanda, thank you so much. i appreciate you braving those temperatures and conditions out there. >> aaron rodgers got nothing on you. >> not at all. the senate impeachment trial two days away and the new video shows capitol hill rioters taking cues from trump. how could it impact the case against him? >> sure. we always used to talk about the brick wall of evidence as a prosecutor and every brick matters. that one, obviously, is important. but so are so many others. i'll bet you we haven't even seen all of them. i'll bet you they have access to videos from tips and other sources and they're going to put them together in a nice montage. yeah. that's important. i think so much more is even more important trump's words in the weeks leading up to the insurrection, his words that day, his words after wards. it will be important but there's so much more. >> let me ask you about that because you mentioned his words leading up to the insurrection. the former president hasn't been criminally charged but do you get a sense these videos actually give law enforcement new evidence that could lead to charging him perhaps inciting a riot? >> you know, potentially. i think that's something we should focus on later after we see all the evidence. i think what is clear right now is that he abused his office and that's really the issue for the senate. did he take actions or inaction that were incompatible with the oath he took in 2017? so i think that's really the only question now. might they be able to? sure. as a legal matter they can, obviously, still investigate for inciting the riot. i think it's probably a closer call. i don't think it was necessary, by the way, for the house to impeachment him for inciting the riot given so many actions he took were incompatible with his oath as president. >> let's talk about the long road now, though. dan, in case trump is acquitted, can the democrats then try to censure him or perhaps use the 14th amendment to prevent him from holding future public office?
