new fears as the 11th hour gets underway on this tuesday night. good evening once again. i am stephanie ruhle, live from rockefeller center. we are now 154 days away from the election and president biden is sharply escalating his attacks on donald trump. so far joe biden has maintained radio silence on trumps multiple indictments and there have been reports of divisions within his campaign over whether he should publicly discuss trumps legal woes. after last week's legal verdict the president has clearly made up his mind. during a fundraiser last night, president biden called trump unhinged, blasting him as a convicted felon who snapped after he lost the election. he is not alone in taking an aggressive turn with the former president and his allies. earlier today on the hill, attorney general merrick garland defended himself and the justice department against repeated attacks from house republicans. they claim, without any evidence, that the department has a blatantly political agenda which includes targeting donald trump. my colleague hallie jackson has those details. >> reporter: a message both blunt and sharp tonight from the attorney general. >> i will not be intimidated and the justice department will not be intimidated. >> reporter: a full throated defense targeting republican attacks on the justice department and slamming suggestions the doj had a hand in the state felony conviction last week, as trump falsely claims. >> that conspiracy theory is an attack on the judicial process itself. >> reporter: but many republicans insist the biden doj is playing politics. >> many americans now believe there is a double standard in our justice system. >> reporter: the house looking to hold merrick garland in contempt of congress for defying a subpoena of the audio of the interview between president biden and the special counsel who declined to prosecute the president over his handling of classified documents, suggesting a jury would be unlikely to convict a well-meaning elderly man with a poor memory. the transcript is been released, but republicans want more. >> again, there is absolutely no evidence to support any of these allegations, but that is not stopping house republicans. earlier today house speaker mike johnson announced a new, three-part plan specifically designed to go after the department of justice. >> we have rogue prosecutors around the country that of drug president trump through this process because of who he is. we are looking at approaches to what can be done through the appropriations process, the legislative process, through bills in committee and also through oversight. all of those things will be happening vigorously. >> with that let's get smarter with the help of our leadoff panel this evening. axios political reporter hans nichols and a criminal defense attorney and former prosecutor. hans, i want to start by asking about joe biden's decision to talk openly and aggressively about trumps conviction. you mentioned a debate in his inner circle. any idea why he decided to go for it last night? >> he probably thinks the politics are good, right? this was his second opportunity to come to the cameras. the first time was last friday and if you listened to what biden said at the time, he was careful to focus his criticism on trumps response to the verdict. that seemed like that was the lily pad that the white house would put the president on, which is to say they would leave it to outside surrogates. the campaign itself might use convicted felon and in press releases, which they did friday evening. the first time the president had a public opportunity, monday night, not only did he say it but the white house or the campaign sent out a transcript at of time of what the president was going to say. it was premeditated, calculated, and the answer was obvious in front of us. they probably think that the politics cuts in their favor. >> no lily pad needed there. susan, this is biden openly calling trump a felon. does that change the campaign? is it a new phase for biden in 2024? >> i mean, yes and no. trump is a convicted felon now and he would be whether biden personally used the words or not. i do think it is an important reminder, because trump had more than a year to prepare for the moment when this might happen. you saw this premeditated barrage of statements not only in support of him, but really ripping down the justice system's effort to goose the fundraising, which has produced results for trump. democrats didn't seem to have the same kind of prepared plan for what to do in the event of a conviction. at least that is what it looked like. i think it is interesting that we are still a number of days after the event, trying to figure out what the exact strategy is. i am looking forward to the debate scheduled between the two of them and wondering what is the approach of the incumbent president of the united states to somebody who not only wants to take back the office, but biden said openly in the interview he gave that he does not believe donald trump is fit for office. regardless of whether biden was the candidate or not. that is a really tough position to be in, to be on the same stage with that person who is a convicted felon. >> we have never had a felon run for the white house. donald trump is set to be sentenced in new york one week before the republican convention in milwaukee. how does this work technically? >> what happens is he has to meet with the department of probation and they will ask him questions and he has to be honest and truthful. >> what if he is not? >> if he is not, the judge will take that into consideration. if you are convicted and do not take responsibility and attack the judge and prosecutor -- >> which is what he is going to do. >> you find yourself incarcerated. this is not for stealing $50,000 or more. if you believe the theory proven beyond a reasonable doubt, he did this to impact the election and it is not anyone but him. just because you can doesn't mean you should and i think that will be the big issue. >> republicans are trying to spin this conviction, but the group, republican voters against trump, has just launched a six-figure billboard campaign in four different swing states with former trump voters who specifically said they will not vote for him because he was found guilty. who is this campaign really aimed at? >> good question. drivers. people who drive and look at billboards. >> thank you, hans. >> campaigns progress on different frequencies and sometimes they appear to be targeting one group, but are trying to get another. this may be an attempt to give permission to independent voters who haven't quite made up their mind on donald trump. it is always hard for those of us who follow politics this closely to think people don't have opinions, but apparently 6% of americans are out there in the swing states that will decide this election. i suspect this will be one of many campaigns focusing on it. i don't think there will be many americans left at the end of the election cycle who don't know donald trump was a convicted felon. the question is, do they think it was fair? that is why you see the trump campaign and allies and congressional surrogates trying to muddy the waters, questioning the fairness of the system, and that will be part of the conversation going forward and i think we should all be bracing for that. >> just when i think i have a clever question, hans nichols it's me between the eyes. drivers. good on you for that. merrick garland, rarely do we see this, but he seemed to reach a breaking point today when republicans were going after him. what you make of how he handled the house gop? >> look, that is sort of conflict theater that is arranged by house republicans, especially, you know, jim jordan, the master of this kind of pro-trump theatrics, which is a lot of what the house of representatives has become since republicans won control of the house and the midterm elections. it is very interesting because remember that the reason republicans are going after garland now is because of the collapse of the impeached joe biden strategy. jim jordan, they were leaders in that effort and basically the key witness ended up being indicted by the justice department. turned out to be peddling a false story and essentially the effort to go after biden himself flopped. that is why you are seeing them go after the attorney general right now and you know, garland has been criticized by democrats for being too slow to go after trump. two observant of the old processes in a new political moment and i thought this was very 2024, if you finally have gotten merrick garland to punch back at you. >> susan, i apologize, i am sure our audience does not want to be said addicted to more of this at this late hour, but i want to share, for a reason, even more of house republicans today going after attorney general merrick garland, because none of what they are saying is true. watch this. >> for the first time in american history, we do have a presidential administration working to put its opponent in jail. that is a fact. >> you are intentionally allowing the department and the agents there and to engage in political prosecution. >> the lawfare weave syndicates president trump will do great damage in our time. >> does that sound like what they are saying is that donald trump and his allies are above the law, because their statements. no resemblance to facts? >> zero foundation and fax or law and it is really interesting, this is the same people that went after democrats forcing defund the police, but they want to tear down the department of justice and blame it all as a hoax to get the former president, donald trump. it is really disappointing. it is really upsetting because outside of that courtroom every second of those speeches outside the courtroom, it was an attack on the justice system. >> and outside the bubble or outside people with expertise of the justice system, people don't necessarily know better. publicly merrick garland is as un-political as they come, but given what republicans are doing, does that even matter? they are literally making things up to satisfy their base. >> the main issue that you see with garland, i think is that there has been a little bit, i don't want to lean into this too much, but a little bit of disappointment that he has not been more political. that he has not punched back harder and i think today we saw that. he was going to be on the supreme court. they ran out the clock and he wasn't actually there. solicitor general and a circuit court judge and now he is back as attorney general. i think that is really the main sort of issue that garland is punching bag. the other issue is that republicans don't have the votes for contempt. if they did that would change the conversation, but they don't appear to have the votes. that could change, but right now it doesn't look like it could happen. >> they don't need the votes, they're just looking to muddy the water and confuse the american people. susan, i want to touch on the point that hans just made. some have been frustrated that merrick garland has been unwilling to be more political and punch back harder and now here he is getting painted as super political. he is getting all of the downside of being political when he was not even doing so. should he have been? our thanks to julia down in texas. i want to welcome tim ryan of ohio, founder of the organization, we the people. and joining us, former advisor to george w. bush and john mccain. and the director for the center for politics at the university of virginia where he is a professor and presidential historian. let's talk about this because speaker mike johnson called today's executive action windowdressing and i am not saying we have been waiting a while for something aggressive, but what in the world have republicans done at all on the border, anything? >> and they had the chance. there was a comprehensive bill. senator langford, good guy. sincere guy. you heard at the end they were talking about we will not have enough border patrol to secure it. you need an act of congress to appropriate the money to hire more border patrol, which the deal included, so president biden is now forced to do the executive order with zero help from republicans. not a lot in politics is obvious what is going on. this is pretty obvious. we had a bill that was bipartisan. trump deep-sixed it. >> on what grounds can they say this is windowdressing? >> you know, go to your last segment. the truth does not matter here. it matters what they can repeat, get in the echo chamber and drive voters out. i think biden had to do this. it is not as strong as anybody wants because it is not an act of congress. >> you and i have spoken about the border a lot in recent years. what do you think about this move? is he putting republicans on defense? >> listen, it shows that the democrats, first of all, they have a plan that tim pointed out republicans did not take advantage of, because they wanted to use this issue as a weapon. the system is broken and most people would say that sounds pretty reasonable. that does not sound like it is too much and they know there is a real crisis. the problem for me with the biden approach has been the body language, through not showing up on the border, they have left an open field to republicans who talk about it every single day. donald trump has talked about it every single day since he announced the first time and biden has not talked about it that much and has not been down there that much. republicans see that advantage and have taken advantage of it. my criticism, too, is democrats have plans on the shelf. dhs has a plan to distribute funds to different localities, to take the burden off the border. to give resources to other cities willing to take migrants and it has never been executed. i just wish, democrats have a good bill. they also have good plans on the shelf. today is a good start, they just have to do more and talk about it more because it is an issue. >> they are doing more. the president is taking action. obviously you don't need me to tell you it is an election year and we know all sorts of voters, apolitical voters, democrats and republicans from all over the country are concerned about immigration. do you think the president's actions now will have an impact given how much republicans have been banging on about it for the past three years? >> it will have this impact. it finally gives democrats a complete answer. it is a short, punchy answer that will enable biden to move to issues the democrats can actually win on, because it certainly isn't immigration. they can go to reproductive rights, the presentation of the republic. now he has an answer that isn't just donald trump killed the bipartisan immigration reform. which would have been a solid way to move. he could also say we have come up with this, this is a reasonable solution and here are other issues that matter. they need to change the subject. even though it is important and people want to hear about it, they need to change the subject. >> there are a lot of reasons i'm happy you're here tonight, but this one in particular. there is one group of people who will not be happy about president biden's action and that is the more progressive members of your party in congress. what is your take on that? >> you have to understand we do have to know who is coming in and out of the country. there are real national security implications and we need to have an orderly process. i think most people in the country appreciate immigration. they know we are a country of immigrants. but they say you can't jump the line. >> there are many democrats who feel that way. >> right, including myself and many others. you can't let the tail wag the dog. that is why you want to have joe biden as president, implementing the stuff. not donald trump going through the horrific things we went through last time. and larry is a student of this stuff. the other line of attack is trump is in it for himself. >> i better write this down. one more time. you said trump is in it for himself. >> in new york, why would you know anything about that? it plays into it like it is not about the country, it is not about the border. you are full of you know what and this is one more example and then pivot to those other issues. most people, we have to have a solid border. immigration is good for the economy. it adds to the gdp. people go from not paying social security, not paying taxes, to driving the economy. having more money in their pockets. so there is a winning argument, we just have to be aggressive. >> it is stunning because former president trump who catches himself as the good guy for business. mass deportation. devastating for our economy. what is your take? some members of the democratic party, left-wing lawmakers, are unhappy with president biden for taking this turn. >> well, it is a page from bill clinton. go ahead and make some people feel some pain from the left. that suggests to people in the middle that biden is taking some tough measures that need to be taken. and the point is, where are progressives going to go? to donald trump wants to do a mass deportation? george w. bush, largely he was very compassionate about it. there is nothing compassionate about donald trump's approach. you may be unhappy with biden's approach on this issue, but it is a reasonable position. listen, you want joe biden as president next fall, not donald trump. >> larry, let's go back to your last point. you said democrats want to make this point and move on, but break down what the polling says when it comes to the border and immigration i now, because until now or a few months ago, we always heard about the border from republicans. less from democrats, the ones who have taken action in the last few months. >> i think for years now not just through biden's term, republicans have been heavily favored when you discuss the border or immigration and partly because democrats have been afraid of the issue. look, one thing that i think should be made, one point that should be made, at least in my experience, progressives in this era are not the equivalent on the other side of the far right. they are really unreasonable. they will beat party leaders to a pulp if it helps them get an amendment passed. progressives, do they have more liberal views than others? yes they do and sometimes it can hurt and tim ryan ran a great race in ohio because he was a centrist. still it is the progressives are reasonable and as mark was saying, who are they going to vote for? >> a few things stuck out. no one is above the law. it doesn't matter who you are or what your name is, because in this country the law applies to everyone equally. that makes no distinction between donald trump, hunter biden and everyone else. that is fair and right but i would argue that when you look at these cases and what we are hearing from people saying that the weaponization of the justice system, hunter biden is being prosecuted for a crime that you would rarely see. how are they getting there in part? they are taking a person who is the seller who took the wrong i.d. he did not take a drivers license. he took a passport, which is not permissible. he is now cooperating if you will, testifying against hunter biden. why would you want to go against hunter biden and not the company or the store that is unlawfully selling firearms? there is so much about this that is really off or seems to be far more born from politics than anyone can accuse in the manhattan case. >> what do you think of each sides strategy so far? >> i think the defense is doing a good job making it clear that when you are an addict, that is part of the statute. there was a great point made in the opening that when you are in aa, you are an addict. you may not be using for years and years or ever use again, but you are always a recovering addict. it is a big issue. was he an addict at that time? was he using at that time? on the flip i thought the prosecution needed to do what they did with that witness. you hear his own voice from hunter biden. you hear from his books that he was an addict and an abuser. >> so you think it is a good strategy, because it seems like the defense is spending a lot of time focusing on the fact he is an addict. >> i think that is where you have to go because you will not dispute that he filled it out. you can't deny that. what was the situation? were you an addict at the time? that is a big statute and potentially not proper. similar statutes have been challenged most recently out of louisiana about marijuana use. so it is a really interesting statute. i want to add this. marijuana is a controlled substance at the federal level. if someone is addicted to marijuana, if you wake and bake, using it three times a day, does that mean those people should all be prosecuted? clearly there is an issue here. >> where do you see this ultimately going in this trial? >> it will be hard for the defense and in that moment he was not an addict or did not believe he was an addict and did not unlawfully or knowingly fill up that forms in a way that he was lying. in that moment he was okay. >> i'm sorry, you said it will be a heavy lift for the defense. you mean for the prosecution? >> i think it will be for the defense because you are parsing that word, addict. are you now an addict? it is not whether you have been six months or two days ago or five days ago or when you last used drugs. are you an addict? make it arexvy. election day, are you ready for this? it is five months from tomorrow and the leader of the senate intelligence committee is sounding the alarm about threats that could spread misinformation and undermine our democracy. senator mark warner says the u.s. is actually, quote, less prepared to deal with those threats then it was four years ago and that is at least in part because of a.i. it matches a warning for my next guest who just published a column with the title, why this year's election interference could make 2016 look cute. i am glad to welcome my good friend, a columnist at the washington post covering artificial intelligence. josh, we really like to give our viewers horrible nightmares, so help us out. what is it that is so horrific about a.i. right now that makes the last election look like child's play? >> two things. one is the technology itself, which is by far the most capable thing humans have ever invented to replicate truth. and it can do it in text, it can do it in video, it can do it in audio and it can do it at scale. it costs very little. we can replicate what we think of as traditional information across the entire web. we can make the president look like he is saying all sorts of crazy things through deep fake, so the tech is one thing. then there is a second problem which is a complete lack of responsibility and enforcement by the parties who should be regulating how to use the technology. so it is this perfect collision. nobody seems all that interesting in doing anything about it. >> that is kind of my question. the two parties would be the a.i. companies and lawmakers. what are they doing, five months to go? >> first it is the a.i. makers. openai, run by sam altman. all of those companies are saying we are concerned. >> all those companies are saying we are very concerned about the capabilities of ai to do great things and to do negative things. we are very concerned and that is fine, but concerns don't really do anything so what i have said is that ultimately, their concern is a little bit like they might be january -- genuinely concerned but the answer they have is to make more ai which is like saying the only way to stop up bad guy with a gun is a good guy with a gun. so let's do more. which is a very american solution. let's not regulate it. let's make more commerce and eventually we will sort of commerce our way out of it so that's where they are right now. number two, the senate, which has an ai gang of senators who have really declared their interest in regulating ai, getting it right, being fast and being methodical, have done none of those things and so, their most recent statement, and a i wrote might -- road map which was 30 pages immediately got fire from democrats. what is this. this is a call for more fundraising but where is watermarking, what about having ai makers you know, have identification on things that are deep fake. none of that is in there and then there's a third party, so that is the social media makers and from 2016 as we recall, mark zuckerberg sat on the stage and said it's pretty insane. i think those were the exact words, to think that facebook had anything to do with the election. >> that's a totally in the -- insane thing to say. >> it was insane then. eight years ago we were all much more naove. we did not know the extent to which russian misinformation had an impact on that election.
