pearl harbor. but as members of congress reflect on the events of januars are blasting democrats accusing them of exploiting the riot for their own political gain. we will talk with wyoming congresswoman liz cheney vice chair of the january 6th which i who along with her father former vice president dick cheney who appeared to be the only republicans on the floor of the house commemorating a moment of silence. chad pergram leads us off this evening from capitol hill. good evening, chad. >> good evening, bret. a pro-trump marred vowed for the house chamber chamber january 6th of last year. determined to stop certifying joe biden next president. one year and 302 electoral certified votes later it was president biden who stood in statuary hall he delivered the most strident speech of his presidency presidency. >> for the first time in our history, a president had not just lost an election, he tried to prevent the peaceful transfer of power as a violent mob reached the capitol. >> mr. biden never mentioned donald trump by name. >> i did not want to turn it into a contemporary political battle. >> but the specter of president biden's predecessor cast a long shadow. >> the former president of the united states of america has created and spread a web of lies about the 2020 election. >> >> mr. trump sailed president biden as the one who tried to stop the peaceful transfer with a rigged election and he said quote the big lie was the election itself. >> some of mr. trump's congressional allies pedaled their own narrative about the riot claiming the fbi played a role by encouraging pro-trump demonstrators. >> i do not believe there would have been the same level of criminal acute at this on january 6th of last year but for the involvement of the federal government. >> president biden said you can't contest reality at the capitol. he spoke beneath clio a statue depicted as document documenting. >> record who took place, the history, the real facts, the real truth. >> few republicans even showed up for the anniversary but that didn't mute their criticism. senator lindsey graham described the president's speech as brazen politicization. minority leader mitch mcconnell upgraded mob's attempts to disrupt the country's norms as a reason to change the senate filibuster for voting rights. president biden said he stands as the rear guard to another january 6th. >> i will stand in this breach, i will defend this nation i will allow no one to place a dagger at the throat of democracy. >> the house chaplain prayed that the one year mark would salve political wounds. >> to the dispiritedness and disagreement here within and around the people's house. >> but, if anything, the sides are even further apart. democrats accuse the former president of poisoning the well and the g.o.p. says president biden missed an opportunity for healing. bret? >> bret: chad pergram live on capitol hill. chad, thanks, as he was one year ago tonight. as members of congress reflect on the anniversary of the events at the capitol that night, the work of the house select committee investigating the riot continues. correspondent david spunt reports from the justice department which is also involved. >> one year after the capitol attack, someone once inside former president trump's inner circle says she is fully cooperating with the house investigation. >> there were things that i was able to cob firm and i think there were things that i was able to kind of help put together like a puzzle. >> i don't want to get ahead of the committee. >> former white house press secretary stephanie grisham leaving capitol hill wednesday after voluntarily sharing information with the committee. she joins a list of other high profile names asked to provide information voluntarily. committee members want to speak with g.o.p. congressman, jim jordan and scott perry also fox news prime time host sean hannity who is being asked to recall private conversations with then president trump and others leading up to january 6th. around 50 people have been subpoenaed, and a majority are cooperating. but a handful have not. including trump confidante steve bannon who turned himself into the fbi in november after the department of justice charged him with contempt of congress. if convicted, he could face a year behind bars. former white house chief of staff mark meadows is suing the committee. meadows has not been charged by the department of justice at this time. >> as a prosecutor, you never want to be in the position of being accused of playing favorites or giving dispirit treatment to different potential defendants, letting some go while throwing the book at others. >> others subpoenaed not fully cooperating include trump allies michael flynn, roger stone, jeffrey charge and john eastman. >> the justice department needs to proceed very, very carefully and very thoughtfully and deliberately. >> former president trump's legal team recently asked the u.s. supreme court to block release of january 6th related documents requested by the committee. the justices are expected to decide whether to intervene in the coming days. >> if the supreme court declines to get involved, the lower court decision stands, that means, bret, that those documents may be release to the committee and quickly. bret? >> bret: david spunt at the justice department. david, thank you. let's bring in wyoming republican congresswoman liz cheney vice chair of the committee. congresswoman, thanks for being here. >> thank you for having me, bret. good to be with you. >> bret: what did you make of the vice president and the president wants speeches today in statuary hall? >> well, i thought that there were a number of things that they said that i agreed with. i think when you look at what happened, the attack that happened on january 6th, i think it's different from what happened on 9/11. different from pearl harbor. obviously 3,000 americans died in each of those events. each of those attacks. but this was a mob that was summoned by and provoked by the president of the united states. in an effort to stop the counting of electoral votes, which is a constitutional process. and so i do think the attacks are very different. i think there is a grave threat, certainly, to our system, to our constitutional institutions. and i think we have to set partisanship aside and party politics aside to get to the bottom of what happened and make sure that it doesn't happen again. >> bret: well, what do you say to republicans who listen to that and obviously you are addressed the 9/11 comparison, the pearl harr bon comparison. they also listened to a pitch for voting rights bills hr 1 and hr 4 are both bills you voted against. >> that's right. >> bret: democrats are linking those to make a sales pitch for passing those pieces of legislation based on the work of your committee and this day. >> well, i have strong policy disagreements with both hr-1 and hr-4. as you noted i voted against those. i think the committee has important legislative work to do though. we need to look at things are there reforms necessary to the electoral counteract. we need to look at things like are there enhanced penalties that are necessary for a president who fails to come to the aid of congress who fails to come to the aid of any co-equal branch of government. we need to look at things like the dereliction of duty. when president trump, you know, we know he sat in the dining room next to the oval office while the attack was underway. he could have at any moment taken a few steps down the hall to the briefing room, gone on live television and urged his supporters to stop and go home. and he didn't do that. so there are real legislative questions the committee needs to answer and needs to think about. but that doesn't mean that we're going to have complete agreement or that i certainly agree with policy matters that i have not agreed with in the past. >> bret: when you hear trump supporters point to that speech that he made on the mall saying supporters should peacefully and patriotically march to the capitol, what do you say. >> look, i think you have to look at the speech and the intent to which he was urging people to fight like hell. you have to look at the extent for which he had been for months, weeks before that telling people to come to washington, it will be wild. i also think that you have to look at what he has said since. he continues to suggest that the violence on january 6th was justified. when he says november 3rd was the insurrection and january 6th was a protest, what he is doing is continuing to undermine our electoral process. you know, he has gone to war with the rule of law. i think that's also really important for people to understand. we had over 60 state and federal courts that heard his claims. many of them were trump judges. they heard the evidence in many of those cases, and they rejected them. the president of the united states has got fundamental constitutional responsibility to ensure that the laws are faithfully executed. and that is what donald trump failed to do. >> bret: what's the ultimate goal of the january 6th committee? >> we have several goals. one is obviously the legislative purpose that i have mentioned, the extent to which there may be legislation or enhanced penalties, for example that we need look at to make sure this never happens again. we also need to ensure the american people know the truth. that the american people understand minute by minute. you know, we know, for example, that president trump attempted to pressure the people in his justice department. he said he was going to name jeffrey clark to be attorney general. that he intended to do it. jeffrey clark has now told the committee he wants to take the fifth. and the entire leadership of his justice department threatened to resign. we know his white house counsel also threatened to resign. we know he threatened government officials to try overturn the election. all of those things are fundamental threat to our democracy and things that have got to be investigated. the american people need to have the truth about what happened. >> bret: but it sounds like, congresswoman, that the goal of the committee, perhaps, is to go after trump's inner circle and prevent the former president for running for president again. is that a fair assessment of the goal? >> no, the golf the committee is what i said. you know, we are a committee of congress. our responsibility is legislative purpose, to determine what laws we have in place, what additional laws we might need to prevent an attack like that from ever happening again and we need to understand what happened. we need to know what members of this body were doing. what they were engaged. in one of my colleagues, scott perry, for example, was very active in attempting to have jeffrey clark appointed as attorney general. we need to understand what happened. the peaceful transfer of power is fundamental to the survival of our republic. we all have a duty to ensure that peaceful transfer of power every four years. >> bret: what about the security failure here, the capitol police, the architect of the capitol, the senate sergeant of arms have all turned over requested documents to the house administration's committee overlooking the security aspect. the house sergeant of arms has not. speaker pelosi has said that that the house sergeant of arms requested the national guard, passed a note, there are open questions about the speaker's involvement and interactions with the sergeant of arms during that time. and, yet, chairman thompson has announced on your committee that the speaker's office is off limits and that there is no call for those documents for the house sergeant of arms. why is that if it's designed to prevent something like this from not happening again. >> well, look, the committee itself is very focused on that issue. you know, we have an entire investigative team focused on the security failures that day. focused on the response of that day. we have got investigators looking at the exactly the kinds of things that you mentioned. that is a really important set of issues. no office is off limits. no issue is off limits. we certainly need to get to the bottom of that. but it's important, bret, to remember that if you say that the security lapses at the capitol are to blame for the assault on the capitol by a mob provoked by president trump, that's the same thing as saying that the small business owners whose businesses were burned to the ground last summer by antifa and blm rioters that the small business owners are responsible for that. that's wrong. security lapses are absolutely something that this committee is looking at and focused on, and it's one piece of a much larger issue that includes the former president's efforts to overturn the results of the election. >> bret: so you would push for the house sergeant of arms to cooperate and hand over documents and the speaker's office to cooperate as well despite chairman thompson's comment? >> and they certainly are. and i think that, you know, what you are describing is chairman thompson's comments are not accurate. it's not an accurate description of what the chairman has said. and, you know, he leads the committee. and as i said, you know, we have got five investigative teams on the committee, one of those five teams is focused precisely on this. all of our teams are staffed with nonpolitical, professional prosecutors and investigators, and those security issues are going to be a focus of one part of this investigation. >> bret: what do you say to somebody sitting at home who may say listen, i think that day was horrible, what happened that day was horrible. but i'm worried about getting my kids to school. i'm worried about what's happening with covid, i'm worried about the next economic blip that i may face, and they look at the focus on 1/6 and say why is this so important that i have to -- that everything gets pushed off to the side? what do you say to them? >> that i absolutely share those concerns. you know, i voted with president trump 93% of the time. more than most republican members of the house of representatives. i'm a conservative republican. i believe that the policies of the biden administration are bad for this country. but i also know that this country must go forward on a basis of truth. we have got to be faithful to the constitution and the rule of law. and that if we aren't faithful to those things and if we don't tell the truth about history, then the institutions themselves begin to unravel. so, if we want to be in a position where we can advocate conservative policies again, we have got to tell the truth about january 6th and we have to make sure that it never happens again. >> bret: why did the wyoming republican party pass this resolution to no longer recognize you as a republican and put out this long lengthy statement about how you are closer to nancy pelosi and they have a problem with that. why? >> well, i would note the vote was 31-29. so it was a close run thing. and certainly there are people in the state party apparatus of my home state who are quite radical. and some of those same people, include people who were here on january 6th. include a party chair who has toyed with the idea of succession. so there is a very radical element of the republican party in the same way that there is a radical element of the democratic party. but we have to be in a position where we are able to come together, where we are able to focus on substance, on policy, and i look forward very much to putting my record as delivering for the people of wyoming and fidelity to the constitution up for the people of wyoming to make a decision about this election cycle. >> bret: last thing, quickly, this is kind of process. but, you are the co-chair of the january 6th committee. speaker pelosi put you in that position. who is the ranking member of the committee? as in free? just like schwab. schwab! look forward to planning with schwab. ♪ bret the biden administration is playing defense for the cdc tonight as criticism mounts over the agency's confusing and conflicting covid guidance. today white house press secretary jen psaki reaffirmed president biden's pledge to defeat the virus despite new scientific articles suggesting we as a country should be prepared to live with covid forever. here is white house correspondent jacqui heinrich. >> the white house is not ready to abandon president biden's promise to shut down the virus even as six former members of biden's health advisory board urged the administration in a series of podesta to scrap their pandemic strategy and embrace the new normal of living with endemic covid. >> does the president believe that covid is here to stay? >> again, the president's goal is to defeat the virus. the president's focus and objective now is to save as many lives as possible. >> the doctors calling the administration's previous claims about the state of the pandemic premature. the cdc director in march -- >> i know you all so badly want to be done. we are just almost there but not quite yet. >> the president, in july. >> we have gained the upper hand against this virus. >> so far no white house response to the experts formerly on biden's own team. >> it's obviously been a busy day to read these articles. i'm happy to do that, and i don't believe the president has. >> but the cdc is shifting its messaging around boosters now encouraging people to stay up to date but notably not changing the definition of fully vaccinated despite data showing primary shots alone are largely ineffective against omicron. >> what is the point of calling someone fully vaccinated with only that primary series of shots if the science is showing that that's not enough to protect us? jacqui what the cdc is advising everyone to be up to date on the shots. if you are scheduled at that point to have a booster, you should get a booster. >> and as the wait continues for the 500 million tests the administration has promised, the white house is trying to counter criticism they haven't done enough. jen psaki tweeting in part more work to be done but we have already significantly increased testing availability since this time last year. >> and the white house is also engaging in the battle with the chicago teachers union as some 300,000 plus students remain out of school. those teachers refusing to work until their covid safety concerns are met. today the white house warned about the impact on the mental health of children, also gaps in learning. and said they were constantly in touch with both schools and labor leaders, bret. >> bret: jacqui heinrich live on the north lawn, thank you. the federal reserve could start to raise its benchmark interest rate as soon as march. that's according to st. louis fed president james bollard. he says he does not need to see a raise to add more than a quarter of a point. he does not believe inflation will come down naturally. he believes the fed must act in order to handle inflation. stocks were off today. dow lost 171, the s&p 500 dipped 5. the nasdaq fell 19. this just in, we were talking about chicago schools. well, chicago schools are now canceling classes for a third straight day amid the fight with the teachers union over covid-19 safety protocols. this week more than 4700 schools either shifted to virtual learning or closed temporarily for at least one day because of the explosion in covid-19 cases. omicron cases. many critics are calling the measures political, pointing out the federal government allocated more than $100 billion with a b to keep classrooms open during the pandemic. and hundreds of millions went to many of the districts returning to online class now. correspondent gillian turner has the story. >> public schools have taken $130 billion and all from the government, money intended to keep them open and serving students during the pandemic. but a whole lot of those schools are shutting down once again. chicago school district accepted $1.8 billion. milwaukee 504 million. atlanta over 200 million. and detroit nearly 800 million. all are now closed to students. the nation's largest teachers union defends the move. randi weingarten tweeting until the surge virtually all public schools were open for in person learning. we got it right for most of this current school year. but just last year president-elect biden made reopening classrooms a centerpiece of his pandemic plan. >> we will also do everything we can to keep our educators and students safe, to safely reopen a majority of our k through 8 schools by the end of the first 100 days. >> most of the $130 billion public schools took in came directly as biden's signature legislation. the american rescue plan. now a daily wire investigation finds not only are some schools shuttering, they have been reallocating the government's funding. milwaukee, earmarked $24 million for programs including antiracism and bias professional development. california earmarked 1.5 billion for projects including restorative practices and implicit bias training. the white house insists they are totally fine with all of this. >> we did distribute that money out to states as he noted yesterday. some have spent it. others have not spent it they spent it in different ways. different schools made different decisions. >> new tonight, three massachusetts school districts are set to spend some of their covid dollars on a new program that sends trained canine dogs into schools to sniff out covid among students. bret? because it makes sure they have a healthier workplace. >> administration is requiring employers with 100 or more workers ensure their employees are fullly vaccinated. if not, businesses must test their unvaccinated workers on a weekly basis. and require they wear masks at work. it's also mandating workers at healthcare facilities receiving medicare or medicaid money to get fully vaccinated. in a court filing, solicitor general elizabeth says the government has the authority because it can regulate safety in workplaces. and quote workers are becoming seriously ill and dying because they are exposed to the virus on the job. including in widespread and well documented workplace clusters and outbreaks. a group of republican eye led states along with business associations and religious groups have challenged these rules saying congress never authorized these types of mandates. really is difficult to articulate when you are trying to step around or step on the constitution and then try to say i'm on solid ground. >> many congressional republicans say they support americans choosing to get fully vaccinated though oppose the federal government forcing them to. the administration is planning to roll these rules out over this month and next. 9 supreme court decision on whether it can is expected soon. bret? >> yeah, i thought a year ago today i heard a speech that some might find inciting and the one i heard today was pretty inciting. i think his goal was to get under president trump's skin. this is a guy that talked about unity more than any president has ever talked about it in his inaugural address and this was just another political speech, which is why i'm convinced, bret, if we are ever going to have unity in this country it's not going to come from the top down and not a speech from statuary hall or mar-a-lago it will be when the people are sick and tired of the conflict. this speech is not getting us there. >> bret: jeff, you were in statuary hall today. it was pretty remarkable some points in that speech how aggressive president biden went, mentioning the former president numerous times. >> he was. he was very aggressive against the former president. some progressives and other democrats were thinking he should have con this a lot earlier. and there was some questions about that in the briefing room today. it certainly came across as a strong statement from this president putting full responsibility for the january 6th riots and attack of the capitol on the former president and doing so in a way that though he has said so before, today really came across very strongly from him. >> bret: meantime the january 6th committee continues, mollie. you heard the interview with congresswoman liz cheney. your take? >> i thought it was interesting. i say as a former resident of wyoming how much she trashed the people of wyoming in her interview with you. even more interesting is that she said something that was not true and it has serious imply cases ranking member means the top minority party appointed person. that means that, you know, who the republicans appointed to the committee. she was actually hand selected by nancy pelosi and is not the ranking member. the reason why that's important is because the rules for this committee require consultation with the ranking member with the top republican appointed person on the committee. when you are subpoenaing people, or when you are bringing people in for testimony. and they know they are not doing that because nancy pelosi, of course, kicked the ranking member, appointed by the republican, jim banks, off the committee back in july. and so this is something that is very surprised she said something that was not true. falsely claiming that she represents the republican conference on that committee. that is simply not true and she needs to stop saying that and i have reported actually in november she was falsely presenting herself this way. she confirmed it tonight. that's a major problem for the committee. >> bret: and we will follow up on that. meantime she did say she had a problem with the comparison, the vice president made, in her speech. take a listen. >> certain dates echo throughout history, december 7th, 1941, september 11th, 202001, and january 6th, 2021. trying to compare it to thousands that died on pearl harr bon and september 11th, very clear they want this to be politicized today. >> instead of focusing onen or analyzing comparisons of moment in history, i suggest that they be a part of solving the threats to democracy that occurs today. >> bret: trey, can you look back at january 6th, 2021, that was really bad a dark day in history, is that kind of jumping the shark there in that comparison? >> yeah, bret. i mean, i thought what happened a year ago today was really, really bad. it sun necessary and actually non-persuasive to compare it to two of the seminole things that have happened in this country's history. i mean, she did leave out the civil war. i will give her credit for that she left out world war ii and the civil war. actually she did leave out world war ii. she mentioned pearl harbor. how she was successful in a courtroom, i thought her delivery was poor and the words she chose were just not persuasive. >> bret: last thing on this. jeff, clearly democrats are using this moment to really push voting rights bill -- bills, i should say, and vice president mentioned that the president mentioned that. the white house seems to be really pushing forward on that. it doesn't seem like they have the numbers. at least not yet, right? >> no, it doesn't seem like they have the numbers. that includes within their own party, with senator manchin. i do think you are going to see more of a push. we saw maybe a little bit of that starting today and the white house has said the president biden and vice president harris will be speaking in georgia next week about voting rights. so expect to see more. but the broader issue that you raised, bret, is spot on. they can talk about it and push for it, as much as they want, and they clearly are wanting to move it forward. but they don't have the numbers in congress. >> bret: i want to turn topics here, mollie, this chicago school battle seems to be really front and center, at least there. definitely for the families who have kids staying at home. but, in school districts around the country, take a listen. >> we want to teach and we want to do what's right for our students and we are prepared to do that remotely. >> they get to try to flex their power, but they do it at the expense of our children. our schools in person are the best place for our students to be. so we are drawing a line. >> bret: tomorrow we are going to hear from the cdc director apparently in a solo news conference. we haven't heard all the details of that there is some confusing messaging here politically dangerous potentially for democrats. >> it's a really big problem for democrats. they are beholden to teachers unions which spend like $700 million a year to help democrats be elected. but, teachers unions are keeping schools closed and keeping children out of school and it is a political problem as it was in virginia when republicans were elected. even more than that we have a situation where our elites are out of touch. the american people are losing confidence in their institutions in the election system. they see people aren't stupid. they see that people are weaponizing these systems against whether it's with covid closures or the hysteria surrounding today's events and what we really need is an establishment and a regime that returns again to caring about the people doing things in their best interest and until they do that, we have major problems as a country. >> bret: if you are a family and your kids are home in chicago, that's probably driving the day. >> yeah, the bars are open and the schools are closed. good luck selling that in november. i do enjoy the democrat against democrat violence that watching. already claims keeping the schools closed. bring harm to the children. good luck in november with that. >> bret: thank you. when we come back, good karma rewards a selfless act in a time of crisis. ♪ sensodyne sensitivity & gum gives us the dual action effect that really takes care of both our teeth sensitivity as well as our gum issues. there's no question it's something that i would recommend. shhh... you think she's still awake?
