resides here but today and tomorrow it's all about the guy who's campaigning to come back. the high court expected to rule on whether a president has immunity from criminal prosecution in his official duties. now, before the verdict, though, already the former attorney general eric holder is rendering a verdict. listen. >> wait a minute. a president can violate the american criminal law if he or she is doing something in their official capacity. that is an absurd and dangerous conclusion. >> reporter: the possible outcomes are pretty clear here. they could rule a president has complete immunity and his prosecution goes away. they could reject trump's claim of immunity and the prosecution moves forward or they could render a i split decision which would really draw out the issue. trump is weighing in on trues social saying this. without presidential immunity a president will not be able to properly function or make decisions in the best interest of the united states of america. presidents will always be concerned and even paralyzed by the process, prospect of wrongful prosecution in retaliation after they leave office. this could actually lead to extortion and black mail of a president. and, steve, you mentioned the other cases. they have more than 20 cases to be decided by friday with issues ranging from abortion, a gun rights case and other regulatory measures. finally, however they rule in this immunity case, one thing we may see is for this to come up on the debate stage next week when trump and biden face each other for the first time since 2020. guys? >> they're going to be releasing stuff tomorrow at 10:00 and next weekend -- rather next thursday and more days if needed >> lawrence: what's interesting is the former attorney general taking the position of no immunity and saying it's crazy when you listen to the oral arguments from both sides the more liberal justices as well as the conservative justices, it seems like there was some sort of consensus about immunity in general. just not what type of immunity and if it's official capacity. he's saying no immunity at all so doesn't seem like he's in line with the conservative or -- eiwhether it's partial or full. >> brian: if you allow murders to yom this country will rachel morin's family be able to sue president biden when he leaves offices? that's what they're talking. i don't see a big yes or a big no. if the president decides to do an aaron burr and shoot somebody that would be a problem. he can't say i'm immune i can start killing people. but obviously if some of your policies or your programs or a war you get into or a conflict you subscribe to, it costs somebody their life for their freedom, do you sue the president. >> ainsley: which is probably why it's taking them a little longer because they have to go through it with a fine tooth comb and say yeah, a president can't shoot someone but if you don't like a president's policy you're not going to be saying, okay, if you guys are going to do it against our guy we're going to do it against your guy, do they feel a special obligation to once again check both sides and say this is what the law says. >> steve: well when we were listening to the arguments a couple of months ago it was very clear they weren't looking just at the trump case, they were looking at presidents in the future. because whatever they decide, it's going to be the law of the land and how things go forward. speaking of the law of the land and going forward, coming up, first tuesday in november there's going to be an election, and we will figure out who's going to be president for the next four years. we had released, fox news did, some brand new polls. if the voting were held today and it was just two people, you know, don't dial in bobby kennedy jr. as you can see right there, right now joe biden at the top is actually beating donald trump, but it's within the margin of error and this is the first time, as you can see, going back through october, where biden has -- since october, where biden is actually ahead. >> ainsley: yeah, they're just neck and neck. our country is clearly just divided on the issues. people who like the issues of abortion or are worried about that or climate change, they're more in line with joe biden. if it's the border issues, if it's the economy, then those voters favor donald trump >> lawrence: to your point ainsley, it's really going to come down to the issues, donald trump is up by nine points when it comes to immigration, five points when it comes to the economy. brian, when it goes to the israel hamas war, he's up by four points but then you flip the issues and you go to some of these -- you go to abortion, biden's up by 13, climate change 20 points, healthcare 10 points. so, i mean, it's just where you place yourself on the issues how you're going to vote i guess. >> ainsley: look at that last full screen, can we put this back up. this is if you approve or disapprove of joe biden and this says the economy, 58% disapprove almost 60%. inflation, 62% disapprove. immigration 63% disapprove and israel and hamas war 63% disapprove. >> steve: the lead story on the new york times right now on politics is about how joe biden's support with women is the weakest lead that a democrat has had since 2004. right now he leads donald trump by 8, but back in 2020 it was 13. so, you know, that's one of the things they're going to try to address when biden versus trump square off one week from today in atlanta. >> brian: if you want to know how they go head to head and what describes each candidate better. for trump he's a stronger leader by 10, honest and trustworthy it's biden by 10. care about you biden by 6, mental soundness trump by seven. so we'll see what matters to most of the american people. it's up to these campaigns to go inside these numbers and say where can i improve. obviously joe biden's got the best chance because he's got the keys to the oval office and right now most of the country is dissatisfied. 34% of the country dissatisfied about how things are going but it is up two points from last year. still extremely low for a guy that wants four more years >> lawrence: steve, you brought up the poll, the sudden change with women, the lowest ever. ainsley, i'm curious, why the change right now? what are you hearing? >> ainsley: well i think when you talk to the far far left it's the abortion issue. obviously i'm a woman for me it's national security, it's the economy. >> steve: the cost of stuff. >> ainsley: i want lower groceries and gas prices. i am worried about what's napping israel and other countries, with russia invading ukraine i don't want them to continue to invade we talked about that a lot. what other issues, the border obviously a big issue for me. in new york city, crime is an issue for me. those are my biggest issues. but for abortion, i mean, it's not an issue for me but a lot of women it is. >> brian: so here on the issues fox news did a poll and they said what's the difference on immigration trump by nine, on the economy trump by five, israel hamas trump by four, guns trump by two. sos those are top issues. where biden does better the future of democracy, abortion is by 13, climate change by 20. but climate change is really at the bottom of usually a top 20. >> steve: in our new poll it was toward the end. one of the things that we have been talking about is the biden campaign feels that there are so many people who are not paying attention. a lot of people, we had bill mcgurn on in the first hour, a lot of people don't pay attention to the presidential horse race until after labor day so they're not engaged so what the biden camp hopes is there are a lot of low-information voters who they're not watching right now. they're looking at their phone every once in a while. and what they're banking on essentially is they're hoping for a viral moment during the debate, which is going to be on cnn a week from today and you'll see it here on fox as well, some moment that goes viral so that it will be like, oh, look what joe biden did there. by the same token, if he freezes up like we've seen, that's going to become a thing. it's a double edged sword but that's what they're thinking. finally they' get some tracks with the people who are not engaged >> lawrence: steve don't you think that's a terrible strategy? i would contend this is not an election of information, it's an election of reality. people are concerned about what they live on a day-to-day basis and what impacts -- you don't have to watch the news to see what's happening in your community whether it's the gas prices, the grocery store price or the illegal immigration issue which is our next story. >> steve: i see it as an election of memes almost. over the last couple weeks we've been talking about look at what joe biden's doing looks like he's freezing up and suddenly the white house is coming out saying this is being manipulated. we're not manipulating the video, it's just the raw video and he's just standing there. >> ainsley: and also these polls are right after trump is convicted. i'm wondering how the polls are going to show all these freeze moments for joe biden and then them trying to spin it and say these videos are doctored or edited which we know is not true. so i'm curious if that's going to affect any of the polls in the coming weeks. >> steve: well a week until show time. >> ainsley: new york city prosecutors say the illegal migrant charged with raping the 13-year-old girl at knife point with a machete confessed to recording the attack. >> brian: we are learning disturbing new details about the crime that happened that night in broad horrific rain of a 13-year-old girl. christian inga londi a 25-year-old illegal immigrant from ecuador is accused of using something resembling a machete to threaten and restrain two 13 year olds a boy and a girl and then allegedly raped the girl all happening in a park in broad daylight t new york posts this morning report he confessed and told police he actually recorded the attack before heading off to buy more drugs. now here are the charges that he now faces. it's everything from predatory sexual assault and rape to kidnapping and endangering the welfare of a child. the district attorney is crediting the victims, the kids, for providing a solid description of this guy. >> i'd also like to take a moment to talk a little bit about the bravery of these two 13-year-old children. it is amazing from what they went through, their identification, their, you know, their memory of the tattoo, the braces, all which was right on point. >> reporter: so they had the description, they had some dna evidence and that all helped them identify the assailant but it was this determined group of neighbors, community members, who recognized this guy on the street and they took him down and held him there until police arrived. he is now being held without bail awaiting his next court date. back to you guys. >> brian: wow thanks. appreciate that. they got him in a head lock. the woman got him in a head lock. they were waiting for him they say he always goes to this bodega they recognized the sketch and a few of them got him. this clown was crying, ran under a car and he got beat up the issue is spinning out of control in new york. i will remind people, if you haven't been looking at these city conway meetings in new york, they are erupting. in brooklyn on monday a lot of the residents came to the city conway meeting and said why are all these males hanging outside of the hotel. we know they're snatching purses and everything and this guy is just the latest offender to cause damage to a young girl that's 13. >> ainsley: when he was in court he had scratches on his face, not sure if that was from when they got him or if it's from the little girl >> lawrence: it's from the guys that got him in the street. >> steve: from under the carmen man exactly right. >> ainsley: the judge ordered him held without bail until the next court appearance on july 1st so when is paycheck to paycheck prices up 20%, they look at what happens with the open border, fentanyl crisis 4,000 people in pennsylvania last year died, violent crime we see these horrible incidents of rape and murder from illegal migrants. and the war on fossil fuels. pennsylvania's the fourth largest natural gas reserves in the world. this pause and this regulation that stopped pipeline production and drilling us a big deal for pennsylvania. >> brian: i think you should emphasize that. pennsylvania is directly affected by the president's pause and he told speaker johnson it's not a pause it's a study. they said no mr. president you paused everything which not only affects you guys it affects lithuania japan is for i can't all the ones getting natural gas for us because they got off russia issue almost besides abortion and others, but how do you take that and get a good ground game and get people to show up and always voting. >> two pieces of the story. first is you have to get out the vote among republicans. we have to get out our voters. 67 counties in pennsylvania 55 are red. president trump helps with the turnout but you have to go vote and explain to people why their future depends on it and that will be a good part of the success. >> ainsley: what are the voters in pennsylvania saying about joe biden's cognitive decline and what we've seen the last week or two. >> we're all worried about it as americans, this isn't even partisan. you look at him stumbling around on the stage and seemingly not know what's going on. as an american my heart breaks for it. we need leadership that's competent to take on the crises we face. we are at a precarious -- i'm 58. i've never had a more precarious moment in our country's history that i'm aware of. >> brian: saturday night president trump will be live saturday at 9:00 will be speaking around 7:30 in pennsylvania in philadelphia. you said you'll be there. again he goes to detroit, he goes to the bronx, he's going to philadelphia. he lost by 19 points. what's the game plan? what's the message to win some of those voters. >> the key is these problems talking about inflation, violence, crime, these are not republican problems, they're not white problems black problems, they're everyone's problems so we need leadership. we need a coalition, president trump's trying to do that i'm certainly trying to do that that supports leadership. >> brian: but going to urban environments. >> because those voters are affected by anybody by this fentanyl crisis or by what's going on. that's why the campaign that i'm running and president trump's running, i think it's going to win because we see this growing recognition that our country's in deep deep trouble and we need leadership. >> steve: thank you for getting to know me. so right now the polls have closed dramatically since i started the campaign and the more people know me the more they close so i have about 55% of the voters in pennsylvania know who i am and by election day it has to be close to a hundred. >> ainsley: you were so successful in business before you got into politics, you have jd vance who's a vp possible pick and also doug bur am both very successful in business and the tech world and billionaires and two other politicians marco rubio and tim scott tim scott is close to those donors. who do you like out of those four? >> i like them all. >> ainsley: you know them all. >> yeah, i know them all and i think any of them would be very fine choices. i think the most important thing is we get somebody who can take on the responsibilities of the president if, god forbid anything would ever hoop the president and that is the most important issue for an vice-presidential pick and, frankly, we don't have that with president biden when you see his cognitive decline and then you also see kamala harris, i don't think anybody looks at her as our vice-president and says that gives us confidence if a tragic situation
