>> well, kate, what we know is that in five hours' time, we are going to see novak djokovic go into an undisclosed location to talk once again with immigration officials. he's been asked to go for another interview. he will then be detained at that point and he will have two australia border force officials escorting him after that to his lawyer's office. at 10:15 in the morning that will be when the first hearing happens of the federal court of australia. now, it has been referred to a higher court, and this is where they will start hearing the appeal if you like, the judicial review from his lawyers. now, we have heard from the immigration minister saying that it's in the public interest he has decided to cancel this visa, the lawyers for djokovic pointing out in this hearing on friday evening that it was an argument that if djokovic stays it would, quote, excite the anti-vax sentiment in the community, something they reject. that gives you an idea of which direction this could go. we also heard from the prime minister scott morrison today saying, "i understand the following consideration action has been taken by the minister to cancel mr. djokovic's visa held on health and good order grounds on the basis that it was in the public interest to do so." australians have made many sacrifices during the pandemic and they rightly expect the result of these sanctions and sacrifices to be protected. kate? >> paula, thank you so much for your continued coverage. i really appreciate it. joining me is former pro tennis player patrick mnk enrow, an espn tennis commentator, host of the podcast "holding court" and sports analyst christine brennan. i told you both i was going to need you back. here we are. pat, where are we from yourive? as this draws on, what is the sense you're getting from other players? >> well, let me start with your second question. both are great questions, kate. the players, they've had -- i think they're in a similar situation to the australian public, which this has gone on for too long. the rules, yes, have been changed as we've moved along in this past week, with the player tsitsipas, he lost to djokovic in the french open final, number four seed. he said, look, we all knew coming into this tournament that we'd have to be vaccinated. we all played along and did our part. he said we sort of feel like fools at this point. remember, kate, in the singles draws, both men and women, novak djokovic, if he does play in the tournament, that's still up for debate, up for grabs, he will be the only unvaccinated player in the draw at the staustralian op. that's 128 men and 128 women. >> christine, you said this is all on djokovic in the end because of just what patrick was talking about. but this is just a mess, christine, for novak, for tennis, for the australian government. do you see anyone coming out of this a winner here? >> not really, kate. it's a parable for our times, though. as patrick so eloquently said, you know, this is the reality of where we are. i mean, these are extraordinary times. a pandemic, obviously once a century, so i guess i cut a little slack to everyone that leaders, government leaders, we're dealing with something new every day. i also think as we've talked before about the citizens of australia who have done everything right. 260-day lockdown in melbourne, which, of course is the host city for the australian open. novak djokovic just thought he would saunlter on in there and play. so when i say it's a parable for our times, i mean that. sports athletes get away with all kinds of stuff, high school, college, pro. well, maybe this is a time when an athlete is not going to get away with something. and no one -- djokovic has no one to blame but himself. get vaccinated, as patrick was saying. everyone else is. and i just find -- and i also think, you know, the key point is governments are allowed to control their borders and australia is allowed to make this decision. that said, who the heck knows what's going to happen next? >> i'm definitely not going to ask either of you to guess ow this one ends. patrick, putting health and politics aside, because it is actually quite hard to, as an athlete, what does this do -- i was thinking as we were seeing him back on the practice court -- what does this do to your head knowing it's an extraordinary case, you could either be in detention, you could either be kicked out of the country, or you could be heading back to centre court anytime now? >> let's start with what i've seen over the years from novak djokovic. it's an honor to be on with christine brennan, who i've admired far long time. novak djokovic is the toughest player mentally i believe i've ever seen, and i put him up there with jimmy connors, rafael nadal. this guy shrugs things off. he's come back from the brink of defeat numerous times, always played with that chip on his shoulder, me against the world mentality, which has served him well as he's chased down nadal and federer. he's tough. but this is another level, something we've never soon before. as christine said, these are very, very unusual times in the world, and it's affecting the tennis world. but i'm told from my sources down there at the tournament, players, coaches, and so on, that novak djokovic got into the locker room after his practice session in the last day or two and broke a couple of his racquets. that's pretty unusual for players to do the week before the tournament, although they get frustrated with the practice session. but this has to be wearing on him. this has to be taking its toll. that being said, he's arguably the toughest player i've ever seen on a tennis court. >> you mentioned, christine, patrick mentioned nadal. this puts him in a strange place, too, meaning he could become -- he could make history and become the winningest men's player of all time at this tournament but maybe because his rival got kicked out of the country. what position does that put him in? >> it's a tough within. we've all been through this. patrick, right back at you. for two years now. we know those are not normal times. i think the record books will show whoever wins the men's tournament, whether it's djokovic is allowed back in or nay da or med ve dech or anyone else, that they won the australian open. there will be no asterisk. these are djokovic's decisions potentially coming back to haunt him, so far definitely haunting him, and you move on. but i think, you know, we're seeing the class of some of these athletes and the way they speak out, and i hold these athletes to a very high standard because they're pillars of the community. so djokovic, we're getting a wonderful window into his personality and the decision making that he is doing at the prime time of his career. get the vaccine and play. what are you doing, pal? with paycom, employees enter and manage their own hr data in one easy-to-use software. visit paycom.com for a free demo. hon? first off, we love each other... developing this morning, a watershed moment in the yearlong justice department investigation into the capitol insurrection. for the first time, doj has charged 11 oath keepers with seditious conspiracy in the violent siege. they include stewart rhodes, the lead over the far-right extremist group, who will be arraigned in a texas federal court this afternoon. whitney wild has more on this big move by federal prosecutors in what is the largest investigation in the fbi's history. >> reporter: stewart rhodes, founder and leader of the far-right group the oath keepers, arrested in texas on charges including seditious conspiracy. >> i hope that this arrest and this prosecution will shut up those of our colleague who is keep saying, well, if it was a conspiracy, how come there are in no conspiracy charges? no sedition charges? >> reporter: the justice department charging ten others with seditious conspiracy as well. >> this is such a powerful statement by the justice department. >> reporter: it's the first time federal prosecutors have used the sedition charge after bringing in more than 700 cases related to the insurrection. but prosecutors have long signalled that they were considering using the rarely applied section of federal law. and it was just last week in a speech commemorating the capitol attack where attorney general merrick garland said this. >> the actions we have taken thus far will not be our last. >> reporter: rhodes is the most high-profile individual charged in the investigation so far. court documents released thursday lay out a wide-ranging plot to storm the capitol and disrupt the certification of the 2020 election. two days after election day, rhodes allegedly urged his followers to refuse to accept the election results, writing in a signal message, we aren't getting through this without a civil war. according to federal prosecutors, on his way to d.c. on january 3rd, rhodes allegedly bought an ar platform rifle and other firearms equipment with sights, mounts, trigger, slings, and other firearms attachments in texas. the next day he allegedly bought more firearms equipment in mississippi. rhodes, a former army paratrooper, who went on to earn a law degree from yale, said he did not enter the capitol on january 6th, but video captures other oath keepers wearing military gear, forcing their way into the building in a military stacked formation. >> they were highly organized groups who were exploiting the chaos of that day. >> reporter: the new indictment also alleges the group had quick reaction forces from three states -- arizona, north carolina, and florida -- to rush into d.c. if needed. according to court documents, oath keeper thomas cold wealth arrested last january claim head took reconnaissance trips to d.c. prior to the insurrection. prosecutors say rhodes was planning for violence well beyond january 6th, allegedly referring to the capitol attack as nothing compared to what's coming. in the weeks after the attack on the capitol, he allegedly spent around $17,500 on weapons, equipment, and ammunition. then around inauguration day, prosecutors say rhodes told his associates to organize local militias to oppose the biden administration. another member allegedly said after this, if nothing happens, it's war, civil war 2.0. >> whitney wild, thank you so much. joining me now, former deputy director of the fbi andrew mccabe and former d.c. metropolitan police officer steve banone. mike, seeing this attack was months in the making according to prosecutors, months of planning by the oath keepers, not just spontaneous, does this change how you see that bat that will day? >> you know, honestly, it doesn't. i think that these charges just confirm what many of us who were on the ground that day witnessed first hand. we saw elements of highly organized groups and, you know, what the fbi has now uncovered is the leaders of these groups were intimately involved in planning, preparation, and training of their members and that those groups' intentions that day were clear. they were there to impede congress from certifying the 2020 election, and that directly contradicts that january 6th was some kind of wholly spontaneous event. >> and you could see that on the day of. you don't nies these charges to confirm that for you. >> correct. >> yeah. andy, what do you think of these charges? how big of a deal is this? >> it's a huge deal, kate. it's a major statement by the justice department that they are prepared to take the next step to go up the chain to levy charges of greater responsibility and greater condemnation of what happened that day. that's something that many of us have been really concerned about is the last year has been mostly lower level charges and less culpable people. the indictment itself is broad and incredibly detailed in its account of the level of planning and coordination that went into this. but, you know, like the officer just said, it doesn't take a genius to look at 12 people who show up at the same riot wearing the same clothes and the same gear working together in a coordinated way to be able to guess that these people planned this, they trained for it, and this is not something that just sprung up that day. >> you know, mike, the indictment lays out not only planning ahead of time for an attack but also that they were preparing for future operations and violence. one oath keeper sent a message to this group that they should adopt tactics similar to the north vietnamese army during the vietnam war. he wrote, "we've been organizing a bugout plan if the usurper is installed." something like 20-plus oath keep rs going to kentucky mountains on hundreds of acres apparently. like the north vietnamese army and network tunnels. suggesting that this wasn't and maybe isn't over, what worries you when you see this kind of plotting? >> yeah. i'm concerned about future attacks. but what i think is most troublesome is the fact that these groups, they now enjoy a level of mainstream legitimacy afforded to them by donald trump and many of his political supporters. these are groups enjoying support from members of law enforcement, the military, and they're extremely anti-government ideology is misrepresented as patriotism by many of our elected leaders. it's this distorted belief that they're the ones upholding and defending the constitution. and i think that mixed with firearms and a basic understanding of how to use them is extremely dangerous. but one of the other things i thought was very telling was i was skimming through indictment and i found a statement made by stewart rhodes, the founder of the oath keepers, to be incredibly telling. the statement was president pence is doing nothing as i predicted. all i see trump doing is complaining. i see no intent by him to do anything. so the patriots are taking it into their own hands. they've had enough. and what this tells me is that, you know, while donald trump may have opened this pandora's box by inviting this group into, you know, the political conversation, that they have their own goals and their own intention, and if donald trump is not going to live up to, you know, his promises to them, that they're going to continue to fight with or without him. >> that is really interesting because, andy, i was going to ask you about what impact you think these serious charges have on this extremist group and those like it. what does it do to what matters most to them, which is recruitment? >> well, kate, let's start with those overnight launches by north korea. now we have seen several launches of suspected ballistic missiles by the regime in the last several days, some saying it's the highest pace of activity by them since 2017. not a clear understanding of what is going on, another usual statement from the administration, they're watching it, condemning it. but behind the scenes a lot are worried what is kim jong up to and why is he doing this. and perhaps no more laser focused than as you say, earlier this week on an incident when they launched a missile believe'd to be by the u.s., an advance missile going at super high speeds, that the u.s. would have trouble defending against, and initially the trajectory they calculated was aimed square at the west coast of alaska. that led to an faa ground stop for a short period of time. now, the u.s. military is saying it was all a big mistake because they very quickly calculated that that was not the trajectory. in fact, the missile only flew about 400 miles and dropped harmlessly into the ocean, thank goodness. but nonetheless, it led to a ground stop. if it was a mistake by the faa, it was the most significant ground stop of commercial traffic perhaps since 9/11. so the u.s. military and the faa certainly have a lot to talk about if north korea keeps launching these missiles and how the u.s. is going to defend itself. kate? >> absolutely. barbara, thanks so much for that reporting. i appreciate it. also developing that the hour, u.s. intelligence indicating that russia has prepositioned a group of operatives to conduct a false flag operation in eastern ukraine, one that of course then the kremlin could use as a false pretext for an invasion. an official telling cnn that the u.s. has evidence that operatives have been trained in urban warfare and in using explosives to carry out acts of sabotage against russia's own forces. this intelligence echoes claims made by ukraine's defense ministry, and it also follows a cyberattack revealed today on a number of ukrainian government sites by unknown hackers. more to come on that. let's turn to the pandemic and the u.s. supreme court's decision to block president biden's vaccine or test mandate for large businesses. in a 6-3 decision, the court ruled against the administration's order mandating vaccines or weekly testing for all employers with more than 100 employees. the decision comes at critical time in the pandemic in the middle of a nation wild surge with states facing record-breaking cases and hospitalizations. joining me now for more on this is a the democratic governor of kentucky, andy beshear. thanks for being here. what is your reaction to this supreme court decision? what impact do you think it will have on your state? moo when we looked at this issue, it's not just as a state but also as an employer. state government would have been bound by that decision as well. in the end, we've had ups and downs in this pandemic. we have to find a way to move forward. with the level of omicron and the huge demand for testing, it would have been a real challenge to put into place, but there's no question we need to find the right motivations to get more people vaccinated. we are seeing, though, a steady increase. it's not nearly what we need. but people do seem to be waking up and seeing the danger that's out there. >> because you've got an interesting kind of perspective on this supreme court fight that happened, governor. your republican attorney general joined in that lawsuit fighting the biden vaccine requirement. is there anything you can do now in place of this? >> well, in certain parts of state government as an employer, we do have something like this. think about corrections officers, given the congregate setting that's there. in our psychiatric hospitals and in certain nursing homes. we work with our hospitals to support them and their requirements on vaccinations, and there's certainly the ability every single day to talk to kentuckians about what's out there. but, listen, this thing is rapidly increasing at a rate we've never seen before. our hospitals are filling up. i've had to call out the national guard now for second time to help our hospitals. this is one where we need people to understand they are going to be exposed to this. how protected they are depends on whether they're vaccinated and whether they're boosted. >> you mentioned the national guard. the president announced yesterday he's deploying the u.s. military to hospitals in six states. kentucky is not one of those states. but as you just said, you've been deploying the national guard to health facilities around the state to help because of what you're facing. do you think you will need to request the president send the u.s. military to your state as well? >> we'll see. in the surge from delta, the federal government did send medical teams to help us out and we are grateful for that. and they sent teams to us because we were one of the hardest hit during that time. right now, there are states that are hit harder than us. and we understand that this is one nation, really one world, dealing with this pandemic, and so we fully understand and support those teams being where they're needed the most. we're going to see in the next couple weeks exactly how full our hospitals get. it's a real concern because when we don't have any more staff to take care of any more patients, it's that person in a car wreck who has a heart attack, who has a stroke that may not get the care they need and can't get the bed they need. so please to everybody out there, get vaccinated, get boosted, even if you are somebody that doubts covid and its seriousness by doing that, you'll ensure that that person in some different way the can get the care they need. >> it does look like it may get worse before it gets better in your state as this wave washes over the nation for sure. it's been just over a month since the tornadoes raefaged the western part of your state. over 70 deaths, entire neighborhoods flattened. the first lady, jill biden, is traveling there to dhekcheck in the recovery, and i promised you we would stay on top of this. what is the latest? how is it going? >> we are digging out, and we are working to not just repair buildings but to ultimately rebuild lives. the outpouring of love and support has been incredible, and it continues. we're going to need that help. just cleaning the debris in mayfield is going to take through the end of april. >> wow. >> it's almost the entire town that's gone. that's not even the rebuilding effort. right now we still have people in hotels that have been there for 30 days because there's nowhere else for them to go. i mean, when a whole town is destroyed, it's not like you can find other housing nearby. so right now we're working on two things, one, getting all the students back in school and providing wraparound services to these traumatized kids, and two, getting medium-term housing, noncongregate shelter, where we can get these people out of hotels, get them into travel trailers, conveniently located where they can work to rebuild their house, and ultimately we can save these towns. you know, after the death and after the devastation, we've got to make sure we have jobs in these towns waiting for these people. we have to make sure that there is a reason for people to stay. one of the towns hit was my dad's hometown at dawson springs. it's about 2,700 people. we don't do this right, that town may only be half what it used to be or even less. we can't let that happen. >> governor, thank you very much for coming on. really unbelievable, just clearing the debris is going to take until april. you will believe it when you see the devastation, but still unbelievable. thank you very much. >> thank you. coming up for us, a major blow to president biden's push to get voting rights legislation passed. how the president managed to be at odds with republicans and democrats now in his fight to get it done. that was quick. and rewarding. i earn 3% cash back at drugstores with chase freedom unlimited. that means i earn on my bug spray and my sunscreen. you ready to go fishing? (robert) thank you. subaru. more than a car company. announcer: tired of pain radiating down your leg and lower back? get relief finally, with magnilife® leg and back pain relief. and get living. available at your local retailer. joe biden rounding out the week with another setback. joe manchin and kyrsten sinema dashing democrats' hopes and making it clear they will not support changing senate rules to pass the voting rights bills without republican support, making it a very tough week for president biden. a series of defeats for president. joining me now anchor of "inside politics sunday," abby phillip. axios put it this way today, they put it this way, it's rare for a president to be at odds with republicans, moderate democrats and liberal democrats all at the same time. and there's where biden is right now. i'm wondering kind of, you know, what he is facing in this moment now. >> yeah. this is what happens when you have basically a zero-seat majority in the senate. it has to be done with a tie-breaking vote. and when you have a very, very narrow majority in the house and on top of that, i mean, this is a president going into a midterm election at a low point in his own approval rating. so there is so little leverage available to joe biden to move anyone, even in his own party, that that is why everything seems to be stalled right now. you know, kate, we have to remember, though, that this is a president, joe biden, who basically campaigned as a transitional figure. he got liberals on board in part because they believed he was the best option for winning, and now they are facing the reality of a president who is not able to kind of make all of the wish list come true in his first year in office. it's a tough spot. >> yeah. i mean, when it comes to the voting rights bills, i mean, every reporter on capitol hill could have told team that the voting rights bills were going nowhere and nothing had changed, no prospect really that it would change. but still the white house and the president really threw everything at it this week. do you have a sense of why? >> you know, president biden when he was in atlanta this past week, said, you know, keep hope alive, basically, but it came to the voting rights bill, and i think this is really hoping against hope about something that has been clear for a long time. joe manchin, kyrsten sinema, and others in the senate are not willing to get rid of the filibuster, but the white house is making a calculus that they have got to try. they have to show their base that they are working at it, that they are trying. the problem is that i think the base actually does not just want effort. they want actual things getting done. and so it's a bit of a lose-lose situation, but i think perhaps they felt like there was no other option available to them. they couldn't go into this year, you know, presenting voting as a fait accompli, as something that was never going to happen. i think they would have had a more significant revolt on their hands in the liberal wing of the party. >> in response to this, the president's chief of staff is responding, kind of the whole take of the president being hit with a series of setbacks, which is from scotus to voting rights to a testing crisis to inflation rising to build back better just dead at this point. and what ron klain sent out is here some other facts about the last 30 days, which is unemployment has dropped 3.9%, and vaccination rate has topped to 200 million at this point and a record number, all-time record number of americans are out there with health insurance thanks to the rescue plan. i saw that and thought, yes, there is good news among the bad, that's for sure. but does this come back to, though, people don't feel that, it doesn't matter? how do you describe this as going? >> good morning, kate, and thanks for having me on the show today. i appreciate the opportunity. we're in day four, and i think we -- everything that we're seeing is not unexpected as far as the numbers. what we knew going in was that schools are the safest environment because of all the safety protocols that we put in place over -- over the past three semesters, so this is our third semester working with covid protocols in place, whether it's the filtration or whether it's the kind of the vaccine mandate or whether it's actually the testing protocol. i think that los angeles, we have really one of the strongest testing protocols around, so even those positivity rates you just described, you know, today we're seeing lower numbers. it's about 13% for our students, 11%, just under 12% for our employees, so having people in school is safer for them and we think that's what's going to be shown as people return to our campuses. >> look, i know a lot of parents are appreciating you to fight to keep student in class as much as possible. we're seeing examples in, you know, minnesota and indiana, many other places, of schools having to pull back already from what they are seeing. for you, what is your measure at this point that would force you to have to shut a school down temporarily again? >> well, i think we're guided by our local, you know, county public health and the state and all of the experts. this is real guided by the science, and they will tell us when we need to shut something down. i think that would be the one avenue. the benefits of in-person learning, you just mentioned it, and we've seen it loud and clear. it's not just about being in person or online. really it's about kids wanting to be around their friends. it's about all those socioemotional supports by having counselors and, you know, health counselors and nurses and people around the children that give them supports on every aspect of their lives. it's about food insecurity, so, again, not only can we see from the past two semesters how schools actually we had three to seven times less positivity than the general police, and we know that to be true, then our measures work, so, again, i think it's about kids being in the safest place possible but also safe not just from covid but safe for their well-being. >> yeah. you know, the biden administration announced that each month now they are going to distribute 5 million free rapid tests to school, 5 million free pcrs and i'm curious does that change anything for you? you have a robust testing situation already, and considering you have 640,000 kids in your district and you're trying to test them weekly. >> well, i think, you know, again, our positivity rates are lower than the overall county. that's a great indicator. there's a different need for pcr tests and rapid tests. we tested every single employee and student before they came on campus, and if anyone had a positive test, we said please stay at home, test back in a week and come back to campus when you're no longer testing positive, so there's numbers you quoted, again, were a preventive measure before we even started our schools. i think when -- once we're in school we have weekly pcr testing for all of our employees and all of our students, and when they want to test back into school, we use the rapid antigens. the rapid antigens are really effective for giving greater access and ease so that people can take their own test at home to see am i still infectious, and, again, there's differences that i know the scientists can go into, but we at schools need to use it strategically, you know, because there is a limited resource out there and the biden administration and the state have been wonderful about basically trying to help schools, but there is a limited supply and we need to get more tests. >> yeah. you can't wait for tests to come. you've got to figure it out in realtime, at the very same time. thanks for being here, sooumpt really appreciate it. >> thank you. >> thank you all so much for being here. i'm kate balduan.
