louisiana has become the first state to require the ten commandments be displayed in all public classrooms. it is facing legal challenges from civil liberty groups going after it for a violation of the separation between church and straight. lorne greene is on this for us. >> the proponents of the bill will believe the supreme court will be on their side in any of the legal challenges and predict other states will start to follow louisiana's lead. the ten commandments are part of the bedrock of judaism and christianity. jeff landry argues they have historical significance as a huge significance on america's documents and legal system. governor landry signed the bill into law alongside several other education measures. they have a poster size display of the ten commandments in large, easily readable fonting required in all public classrooms. within minutes of the signing, a group of liberty organizations said they plan to file a lawsuit as a blatant violation of separation of church and state. hb-71 will result in unconstitutional legal coercion and are thus a captive audience for school-sponsored religious message. they are confident the high court will sign with them in a legal battle as there is a new litmus test for holding up religion symbols that are part of america's founding. >> whether it is history or law or media or education, the ten commandments has been present and prevalent in all of the arenas since the founding of our country. while there is certainly a religion nature to that, the ten commandments more than anything have that rich history of tradition in american law. >> state funds will not be used to implement the mandate but through donations. >> lauren, back to you. that's kind of part of the religion part of this. i was told something fascinating last hour. there are places where the ten commandments and moses in particular, their statues and the depiction of what the tabloid said on the east of the supreme court. >> you have the ten commandments in the supreme court, library of congress, national archives, ronald reagan international trade union but, sure, it belongs nowhere near schools even though it is a foundation for secular law. gavin newsom, his tweet, louisiana has the worst crime rate in the nation but this is their priority. apparently, it is wrong to have a priority to put the ten commandments in schools. here is the priority in california, san francisco's london breed thinks the mayor top job is naming drag queens. that's the priority in california. i want to challenge what he said. it is wrong to have the ten commandments in schools and won't solve any remedies or problems. madeline murray o'hare founded american a theeists her son became a minister. baltimore schools could not pray from schools. 30 years later, that i is a baltimore police officer to deal with violence and drugs. laugh all you want. ten commandments is a better solution than naming drag queens. >> they seem to be taking a different approach. if it is about religion, it gets thrown out. if they are saying, we are going to have the equivalent of prayer in schools, state-sponsored, if you go at it from a historical standpoint, there is a much better argument. i don't want people to have false hope. i don't want to get prayer back in school for this reason. i'm afraid of every different religion throwing in their prayer and forcing someone to pray a certain religion. i get worried if it is on a solely religious viewpoint. they say, okay, in this school, we are going to have satanism or wickism. i worry about that when you have local municipalities say, we are going to start with the koran. how are you going to go at it? if they go at it in this unique way that the governor is saying, this is historical in context, something we are not paying for from the state, this is a brilliant move. there is a chance this could work out. well done. at least they thought through it before they went all in, we are going to have the ten commandments and it is religion and we are going to have a fight in the courts. >> that's where the analysis is going to lie. the court, whoo they will do is essentially determine whether, does it effectively coerce religious observation by having that poster up in the room. one of the responses is, absolutely not. it is a poster on a wall. note the proponents, the plan, it is going to be accompanied by a four-page contextual document. as they say, the ten commandment played a historical, foundational place in the state of louisiana among others. they are really saying this is historical significance. the other important thing i really want viewers to understand is that the distinction between church and state does not require the exclusion of expressions of faith from the public square. so when you hear people on the far left usually or agnostics arguing that there can be no crosshairs, it does not. it does not require the complete eradication of public expressions of faith but requires a distinction. here, as well, this will be paid for by donations, no tax dollars paid for this. >> smart move. >> one final thing, texas and oklahoma tried to do this in the back. they backed off amidst threat of litigation. bravo to louisiana. they will succeed. >> it is a conversation worth having. if it sits in a place of justice like the u.s. supreme court court. there is historical background for thou shalt not lie. that is the background for many religions, including islam. the establishment of the historical importance of the ten commandments has already been established. i wonder where you feel this will go? >> so, as the mom of two teens, as the product of public school myself, i'm more about the solutions to the problems. i find i think it is great private donors care so much about children in louisiana. if they had, louisiana is 49th in education. we have 50 states. they are one from being the bottom in education. one. two, one of the highest teen pregnancy rates. three, school lunch programs. are we feeding the children? as a former christian, one of the things i would like to see, the jesus that i know in the bible and i am not a spokesperson but i think he would care more if we really cared about the children. i looked at the ten commandments again this morning. i have already some of those areas of educational performance for the students in louisiana, if what you are saying is that they haven't tried many other things, pretty much they have tried everything else an nothing has helped. faith comes in and it comes in last in this is stance. as we pointed out and as emily did too, we have tried this in other school districts. we know we are in trouble. we know we are going to need something more than xs and os and we know it more intimately as parents than before the pandemic. we see the teaching and what's coming out of some of these classrooms. if you really want to move the needle ac dem cally, you may want to try every single option. >> the governor ran on that. he ran on this as the former ag and ran for governor. he made it very clear. i'm going to do that pieces have been snipped but the captioning that goes with it, which comes with perception and a perspective and context an all of that, which may or may not be true. it can be massaged information, a lie, a whole lot of things. i am hoping more people will watch this and watch it contemporaneously as it is happening. i don't want this to be like the robert burr report where we have to take somebody's word from it in a transcript. it is important to dial in and make a judgment based on what you experienced. >> emily, i'm not on tik tok but i would be interested to see what trump and biden are doing on tiktok live during this debate. most young people get their news from tiktok. a lot of people fighting over the news of constituents. i am sure that bind will be there with his laser eyes and who knows what trump will do. >> we know 102 million users in the united states are on tiktok. 67% of those, you guys, are age 18 and 19. then, another 56% are in their 20s. when we talk about not only the volume and its sheer size but also that laser focus into these young voters that biden has been trying to woo in forgiving student debt and playing into the small slice of the pie. donald trump gained hundreds of thousands of users in one night alone. the key is going to be two things, those viral moments that you just discussed that you said it eclipses and remaces a substantive policy argument. i personally hate that. second, the algorithms, how people are affected by the political button. we have had friends and colleagues saying, you are not seeing any of my posts, because i have been deemed political. when we think about the sheer statistics, much of it won't be seen. will a majority of the users feel a certain way about trump and will those not be magnified or seen as much. we talk about election interference, there is a significant impact on the election that the algorithm specifically for tiktok has. just remember, it is owned by the pcp. >> i am fascinated by what's going on behind the scenes. bloomberg said that biden carried his briefing book to france and he is reviewing it. >> are you sure that isn't a pillow? it could be a pillow that looks like a briefing book. >> maybe, maybe. trump is opting for more policy discussions being out on the campaign trail. i was intrigued by cbs and reporting they have on biden. >> i am told we should expect some surprises as well. this is such a critical performance for president biden not only on the don't but on his physical performance as well. >> what's the surprise they are touting? >> i have no idea. who knows. i laugh. it is a whole week. what is prep, sleep. i am guessing that's what it is. you want the guy to have no work schedule and then your response to the debate -- jimmy fall on should get a campaign check from the biden campaign. he said, they are both old and losing their minds and they showed four clips of trump, nowhere near the biden freezes of late. he says, look, they are both really low. they are already carrying water and lowering the expectations of this debate. hey, maybe he has one more in him. the guy with the aviators will come out. what's going to be interested to see how they deal with how he does screw up? are they going to claim it is fake and that the video has been edited so it should be taken down. that that didn't really happen. you have to watch for that too. >> leslie, i want to tell you what i think the challenges for trump and biden and see if you agree. these are the issues that are important. number one, is the future of democracy. our poehling shows that the top issue advances biden and advance trump, the economy, immigration. kind of a mixed bag there at the top. the challenge for trump is staying off defense. the cnn moderators will try to put him on defense to go on offense on the economy. here is the challenge from biden, from politico and a dem pollster. when voters are grouchy an angry, they don't want to hear about angry and sunshine. when they become recalcitrant, you have to shift gears for scorched earth. if biden starts yelling convicted felon, trump is going to say, these are the biden trials that play into trump's hands. >> i love when they go low, we go high but it didn't work. i am not saying get down in the mud and the weeds. you have to defend yourself if your opponent is throwing it back. how much mud do you swing back? >> looking at joe biden historically, he is going to do a mix. everybody screws up at debates. i don't care what your political label is. i think we are going to see, the challenge is biden is going to challenge him to push-ups or something like that. >> or just standing there for a while. >> i do think -- i respect my elders. at end of the day, you have to, because this is one thing my party is not doing. you have to talk b oh, crime is low and the economy is good and inflation is going down. you have to do that. you also do have to have some attacks on was friends with jewish people. he supported sexual violence on october 7th, calling it propaganda and law lies. he recounted but did not apologize. he supported lewis farrakhan who called jewish people termites. the hypocrisy is rampant. >> i am not a fan of this particular legislator for many of the reasons you cited, sexual violence against women by hamas and many other terrorist and nonterrorist organizations is a problem at epidemic levels. an apology is not enough. it is not that you are feeling sorry if you apologize after, it is not that you are feeling sorry but you got caught. it will be up to the voters if they feel that he has earned their vote. i do agree not that republicans are bullies. i think there are bullies in both parties. i think, hey, america, vote those people out if you think they are bullies on either side. i'm not going to go name-calling. some of what he says register was voters, diversity, and how that is a good thing and they don't want books ban in some things they see republicans doing in their district an this particular district. the voters will have to decide. >> for the moment, we are just talking about him and that hypocrisy the word feminism in the top, would tiktok not have taken it down. it is unfair that women can't stand up for women's sports. as a man, i find it incredibly, to tiktok, incredibly sexist that women can't defend women without you taking down their message and other women, i think, especially those on the left, should be standing up and saying, women should be able to defend women without having to have their message being taken down. that is a sexist viewpoint from tiktok. if facebook or anyone else does it, they should be called out for this. women should be able to defend women's sports. young girls should be able to defend their futures in their sports. as a former college athlete, women should never have to compete with men. she should be able to stand up on a stage with other women and not have to worry about scholarships taken away from them, because they are competing against women. they should not have to be worried about changing in a locker room with a man who is masquerading as a woman. the fact that we are in a country where this ad, not controversial in my opinion, it is common sense and women standing up for women now taken down, that's sexism 101. >> i argue it is unconstitutional. these women were standing up for their own biological right. if it was a home sexual standing up for homosexual rights, it would not be taken down. >> i agree. tiktok says they are la based and from california but we all know it is owned by beijing. the idea that biological men should compete in women's sports is an idea that china loves. i would love to explore the degree to which china has involvement in this. this was taken down on tiktok. was it taken down on twitter or facebook? >> i want to read what the founding wrote. we are unapologetic about our goal of protecting women's sports and spaces and standing up for truth. the truth is, male biological advantage is the single biggest determinate of athletic performance. to allow males who say they are women to compete in women's sports when they are stronger and faster than females is an affront to women and an erase of title nine. don't let men tell us how to be girls. >> i have two teenagers that had to educate me. i went to tiktok. there are three ways of getting band. one, a permanent ban. that would be be that you have a sexual explicit content, pornography, things against children. there are temporary bans. you can be banned just for vaping, even if you are an adult on tiktok. you can also have a shadow ban, which is when you like your own video. if you like your own video, they will place a shadow ban. the two bands, temporary and permanent, this is a temporary ban. the ban lasts two to four weeks. how does it come about? it comes about by the users complaining. >> if i put out a video an people don't like it, it may have nothing to do with the content. this one does, in my opinion. they have the right to appeal it. i am a woman, a feminist. there are two sides of this argument. i have a daughter that's a high-jumper. i think the people that complain, that's what it is about. >> is it complaining or targeting? we see that there is a lot of companies that get targeted when they have messages. >> it can be organized as well. it is absurd that people can take away your message. this is when i am so annoyed bring the excuse, it's the users that flag this for us. you got to look at it, tiktok. you decided with the users to stop young girls from saying, protect my sports. that is on the feet of tiktok. that is not at the feet of users. that's tiktok. >> i think ben is right. i think kayleigh is right on this. i think the ccp, the chinese communist party, absolutely cares. of course, they do but not for all of these cultural reasons. they care because it divides us and gets us to do things and click on things that they would rather we do and click on. it is monetary and also politically controlled. they have a goal too. why do you think there are so many chinese illegal immigrants crossing into this country, all men of a certain age. they have goals but they just don't align with ours. my question would be, in this instance, how many more -- i thought about this when the former president trump decided that he was going to get on tiktok. i thought, well, is that going to be good for him? is it going to be good for anybody else? the bigger the conservative voices are on that platform, maybe some of this targeting that ben is talking about, that we have seen not only potentially on tiktok but other platforms, maybe some of that can be shourted down by the bigger, conservative performers on the platform. i am kind of looking at this from a gestalt view, 37,000 feet. that's where china is on this. they are not all mired down by boys and girls sports and all that. they see what divides us the most and they go in on that. if you don't think we are being targeted, you are naive about that. it gives them a tremendous amount of power
