get over it. >> there are dumb days on capitol hill and there are dumber days on capitol hill and this is one of the dumbest i've seen in a long time. >> house republicans reacting to a chaotic and at times childish day on capitol hill. we'll take you through what happened straight ahead. plus fulton county district attorney fani willis responds to leaks of video statements from three of donald trump's coconspiratorter in the georgia election interference case. and also ahead we'll preview the high stakes meeting taking place today between president joe biden and chinese president xi jinping. good morning, and welcome to "way too early" on this wednesday, november 15th. i'm jonathan lemire, and thanks for joining us. it is a busy day and we've got a lot to get to. a potential government shutdown in just two days is now looking a lot less likely this morning after the house passed new speaker mike johnson's unconventional stop gap funding bill yesterday largely with the help of democrats. the two-step plan was approved on a bipartisan vote of 336-95. that means 209 democrats as opposed to just 127 republicans voted in favor of it. 93 republicans and just two democrats voted against. the move essentially punts the republican spending fight until after the holidays. speaker johnson told reporters he was pleased with the outcome. >> your first big bill, sir, how does it feel? >> we just had to get the job done. we'll do it day by day. >> any concern about the number of republican defections there were? >> we'll get our team together and we're ready to do this. >> how do you get your team together from here? >> you'll see. >> so the measure does not include any spending cuts or any additional conservative policy add-ones. but importantly, it also does not include a supplemental package covering things like aid for israel and ukraine or additional u.s. border security. the bill now heads to the senate, which is expected to then pass it onto president biden's desk by friday night for his signature to keep the government open. joining us now congressional reporter for politico and lead writer for the huddle newsletter, which you should all be reading, daniela diaz, thanks for being with us. let's start there with the unusual vote totals, that this bill passed the house larjly with the help of democrats, far more democrats voting for it than republicans. how did that come about? >> well, it came about because this legislation to keep the government funded until january doesn't include any funding cuts. i spoke to republicans this week, jonathan, republican house members who are telling me they wanted to see some sort of spending cuts include in this package. of course a lot of conservatives giving speaker johnson this leeway right now. of course he's in this tricky position where he just became speaker two weeks ago i'm losing track, and he had to figure out out how to fund the government pretty quickly. a lot of his own conference doesn't want to support a continuing resolution to fund the government unless it has cuts. and if it does have cuts, that's going to we a problem in the senate because it's a democrat majority, and president joe biden probably wouldn't sign that, so this is how he had to do it, and that's how we saw that happened yesterday -- i want to say last night because it happened around 5:00 p.m. where more democrats supported this than republicans, which we're going to see is a talking point from a lot of these conservatives in the coming days. >> let's drill on that a little bit. of course it was a vote to keep it open and cost kevin mccarthy his speakership. now we've got speaker johnson doing the same, getting democrats onboard. how angry are some of the hard line republicans? are any of them trying to oust speaker johnson from his job? >> you know what's interesting, jonathan, these conservatives, these house caucus members i'm speaking to are giving speaker johnson some room. they're furious, of course, as you note. but they understand speaker johnson came into this job two weeks earlier. he never ran a committee, never an appropriator. as he noted he feels like he's drinking from niagara falls, that's how oesh whelmed he is in this role. so we're seeing them give him some grace. however, he did lose some grace with these guys yesterday with this cr package and most of them supporting this and they say it only goes so far. he's only committed to doing this once, keeping the government funded without any cuts once. he says he won't do this again, and they're going to be working for the next couple of months to keep passing these appropriations bills that will fund the government and cut spending. that's what he's committed to. >> i'm not quite sure the political wisdom of kicking a government shutdown fight into an election year, but we'll come to that when it happens. right now what this bill does not have money for ukraine, israel, the border. what happens next? when might if at all the congress supply this aid to u.s. allies in need? >> well, and while this continuing resolution, this stop gap measure to fund the government was happening yesterday, meanwhile in the senate, some senators were actually trying to passidseral-only funding, trying to get that house bill they passed in the senate. that obviously did up happening, there was not enough support for that, but republican senators do not want ukraine -- conservatives i should say do not want ukraine aid. they want to pass the israel aid without ukraine aid. that's what we see from a lot of the house gop conference, but democratic leadership in the senate is committed to creating a huge supplemental package, that request coming from the white house, and they're waiting to see if they can include some sort of border measures, jonathan, and that's why we haven't seen that measure passed in the senate yet, and they're hoping does if it does include bipartisan measures right now, ukraine aid, israel aid, they can pass that with bipartisan support in the senate and kind of force the house's hand on that issue, however right now it doesn't look like they're anywhere close to doing that. it's going to take a while. >> it certainly will. we'll be watching every step of the way. terrific reporting from politico's daniella diaz. you'd think that vote would be the top headline among house republicans yesterday. well, maybe not. tensions among the gop spilled over when former speaker kevin mccarthy allegedly elbowed one of his colleagues who voted to remove him from his position last month. while being interviewed after a conference meeting tennessee republican tim burchett said he'd been elbowed by mccarthy. he initially thought he'd been in the wrong, but then he chased mccarthy down a hallway to confront him. audio captured the altercation. take a listen. >> i think it went all right. >> yeah. >> sorry, kevin didn't mean to elbow -- why'd you elbow me in the back, kevin? hey, kevin, you got any guts? jerk. >> has he done that before? >> no. >> huh, that's a new move. >> i'm going to go talk to him. hey, kevin, why'd you elbow me in the back? the reporter said it right there. you're pathetic man. you are so pathetic. >> later on mccarthy denied giving his tennessee colleague a, quote, shot to the kidneys. that's what burchett said. the tennessee republican, though, wasn't backing down from his version of events. >> i did not run and hit the guy. i did not kidney punch him. >> you didn't shove him? >> no. if i would hit somebody, they would know i hit them. >> come on, i'll take a polygraph test and have kevin take a polygraph test. >> what did you say to him? >> look, it ain't no big deal, it's just a little different the way people react in tennessee than they do in california. in tennessee if you got to talk to somebody you take it to them face-to-face. i guess in california you take a cheap shot at someone behind. you have $17 million in security detail and still be a bully. >> this is not the first time mccarthy has been accused of hitting a fellow republican from behind. former illinois congressman adam kinzinger says mccarthy did the same thing to him twice. meanwhile, a brawl nearly broke out on the other side of congress yesterday, too. during a hearing of the senate help committee. there oklahoma republican mark wayne mullen challenged one of the hearing's witnesses, the president of the teamsters union to a fight right then and there. >> this is a place you want to run your mouth we can be two consenting adults and we can finish it here. >> i'd love to do it now. >> stand your butt up then. >> you stand your butt up. >> stop it. no, no, sit down. sit down. no, you're a united states senator. it's funny how you're backing out. >> i don't back out of anything. you're the one -- should be the most influential people in this country and making changes. and you're focused on a debate that's not even relevant. you're an embarrassment. >> bad blood had been brewing between the two men since june when mullen who's a former mma fighter first challenged the teamsters president to a fight. that was in response to a tweet where the union boss referred to him as a clown and a fraud. after the exchange yesterday, mullen defended his behavior and even suggested congress should start allowing duals and canings again. >> could you guys go bare knuckle if you wanted to? >> we looked into the rules and used to be able to cane. you've got to remember president andrew jackson challenged nine guy tuesday a dual and won nine time. in a whois dinner one time jackson jumped up and literally ran across the table and knocked the guy out. and so at the end of the day there is precedence for it. >> how is this real life? and credit to senator bernie sanders for being peacemaker there and bringing thins under control. now, let's turn to a far more important story than the nonsense on capitol hill as tens upon tens of thousands of people gathered yesterday on the national mall in washington to show their support for israel. amid a rise in anti-semitism and anti-muslim rhetoric worldwide, organizers say yesterday's demonstration, was meant to underscore the right of jewish communities around the world to be able to live free from hate. it comes, of course, as hundreds of hostages are believed to still be inside gaza, held by hamas, as the war between the terrorist group and the israeli military grinds through its sixth week. the rally featured speakers from both sides of the aisle as well as family members of hostages taken on october 7th during the initial attack on israel. >> right now we -- how we are living is hard to describe to you. we hostage families have lived the last 39 days in slow motion torment. what the world needs to start thinking about today is what will your excuse be? describe his political rivals in a speech over the weekend. biden made the comparison while speaking to donors at a campaign event in san francisco last night. trump made the controversial remark during a veteran's day speech in new hampshire. take a listen. >> we pledge to you that we will root out the communist, marxist, fascists, and the radical left thugs that live like vermin within the confines of our country. the threat from outside forces is far less sinister, dangerous, and grave than the threat from within. >> biden last night blasted trump saying vermin is in part, quote, a specific phrase with a specific meaning. >> it echoes language you heard in nazi germany in the 30s, and it isn't even the first time. trump also recently talked about, quote, the blood of america is being poisoned. the blood of america is being poisoned. again, it echoes the same phrases used in nazi germany. biden warned donors that a second trump term in office would amount to a presidency of revenge and retribution. elsewhere in california that state's governor gavin newsom says part of interstate 10 near downtown los angeles that was damaged in a massive fire over the weekend could reopen to traffic in about a month's time. newsom said yesterday the critical section of highway will not have to be torn down and rebuilt. the fire on the 10 broke out shortly after midnight on saturday in a storage yard beneath an overpass. engineers inspected about 100 support columns that had burned in the blaze. investigators say the fire was likely an act of arson. no suspects have been meteorologist angie lassman who's been studying up on college football but also watching some storms out there. >> yeah, and i think the sunshine state not living up to its name. we've got flood alerts up for florida for 7 million people. we've got heavy rain expected over the next day or so, but the heavy rain isn't just across florida. it's also into portions of of the southeast. along the gulf coast we've been unsettled for days, and it's going to stay that way. but specifically the heaviest of that rain, the most impressive rainfall will likely be the southern tier of the state of florida. we keep it in the picture for tomorrow, too. and then we start to see a new coastal low develop offshore and then eventually move up the east coast impacting folks from the outer banks all the way to maine with wind and rain. but specifically florida we could see rainfall totals over the next day or so anywhere from 1 to 3 inches per hour. localized amounts when it's all said and done being with us. fulton county district attorney fani willis' office is requesting an emergency protective order after parts of videos from the four defendants who accepted plea deals were leaked in that trump case. the d.a.'s office said the release of the interviews, quote, was clearly intended as a witness intimidation. each legal team for the remaining codefendants was provided a copy of the videos as part of the required discovery process. willis says going forward any counsel who wants to view them would have to come into the d.a.'s office. at an event for "the washington post" yesterday she insisted that it was not her own office that was responsible for the leaks. >> surprising, no.disappointing. in fact, today from here i made sure i wasn't late for this event, but i was with my team making sure that an emergency motion got filed. absolutely not. my office -- all the records requests we got for that. yes, from you and every other outlet. no, we're not going to release information. >> an emergency hearing on the matter has been scheduled for this afternoon. now, turning to another trump legal case, special counsel jack smith is urging the d.c. circuit court of appeals to reinstate the gag order in the federal election interference case. in a new court filing smith's office argued the order should be upheld because, quote, there has never been a criminal case in which a court has granted a defendant an unfettered right to right to try his case in the media. but former president trump is getting some backing in his appeal. 18 state attorneys general have filed an amicus brief with the court requesting the gag order be remove. they order the order violates trump's first amendment right and the wording is too vague. oral arguments for the gag order are scheduled for monday. a three-judge panel from the d.c. circuit court will decide. trump will have until noon on friday to reply to that filing. joining us now msnbc legal analyst danny cevallos. danny, good to see you this morning. thanks for being here. so let's talk georgia first. time line in terms of this case, the d.a. said yesterday that she doesn't expect to be completed until after the election, which, i think is what we all assume despite her sort of aggressively scheduling it to start early next year. >> i feel so vindicated, jonathan. i've been saying for months now this case will not start -- it's a little different from what she said. it won't begin until 2025. if high profile rico cases in fulton county take eight months for jury selection and the one pending right now or just before took eight months for jury selection, then your first witness isn't getting called until 2025. i've said it before 2025 is the date for the fulton county case. >> quick follow-up on this, in terms of time lines for all these cases, do you agree with the conventional wisdom it's the federal election case, the january 6th case since it's short-handed. is that the "o" one going to concur and conclude? >> it's the most likely because jack smith designed that case for speed. not a lot of complex issues unlike the documents case which i think has multipliers of documents that are not classified, documents that are. you've got to go to a skiff to review documents with the clients. in terms of the d.c. election interference case, jack smith clearly indicted one person. the purpose there was to get this case to trial. if you're in federal court, things move faster than they do in state court. if you're a betting man, then the d.c. election interference case is the most likely to go first. >> on that let's talk about smith's effort to reinstate the gag order. if discussed the panel is going to take a look. >> this is a jump ball. it really is because we've never had a case like this with these kinds of balancing of the first amendment against say the defendant's right to a fair trial. but more than the defendant's right to a fair trial because you could argue he's kind of waiving it by making these statements, it is the public's right to a fair trial. and that fair trial is one where you minimize the amount of prepublicly that could cause harm. this goes back decades to a case which was the genesis of the tv show and later the movie "the fugitive," but it is the idea sometimes pretrial publicity can so taint a trial it can ruin that right to a fair trial, which is shared by the public. the question is how do you fashion an order that threads the needle in a case like this? there is going to be the most pretrial publicity that there has ever been in any american criminal case for all of these cases. these are the most important criminal cases of all-time. so there's no way to minimize some of the pretrial publicity, and what do you need to show and how do you fashion an order that narrowly tailors and balances those protections between the safety of the court and integrity of the trial and the defendant's right to speak? >> really at the end of the day, what needs to happen for the u.s. to feel good about the meeting today? >> i think the number one thing that the administration would really like to see is an agreement on opening the military to military communications channels. after all this talk about fentanyl, a.i., nuclear, climate, all that's well and good, everyone wants that. but the big concern is that while tensions between the u.s. and china grow, while china continue tuesday be aggressive in the south china sea and elsewhere in the region, it'd be very important for that military to military communication channel to be open and regularly used. i think that's sort of the big things they're looking for. and personally i'll be looking for as i talked to officials from countries in the region, you know, they're not very optimistic there's going to be some great deliverable in this meeting, but they are looking for signs that the tensions you mention between the u.s. and china do calm down, and so while they think this is mostly a photo-op and mainly optic, they are looking for at least the optics be, hey, everything's better than it was before this meeting. >> right, that would be mission accomplished right there. alex, what do we think the president is going to say to his chinese counterpart about the situation in the middle east particularly iran? because waging has some sway there, and of course the u.s. has been watching iran warily to see if they would step up actions in the fighting there with israel. >> yeah, he's basically -- biden is basically going to tell xi, hey, you do have leverage here. you are a major importer of iranian oil. if you effectively decided to not take in that oil or if you've decided to curb your other businesses with iran, then maybe iran would have to listen. part of the issue here is that the u.s. doesn't have that much lev with iran other than a couple of financial deals that are in the works. and so china being of course arguably the second most powerful country in the world does have sway over iran, and it's very important to iran. biden is basically going to tell xi, you know, china could be on the right side of history here. it could be a responsible player in the world order if you could just use what you have tell and iran to, hey, knock it off a bit because of course iran being a major backer against hamas in its fight against israel. >> further segment from the middle east news breaking late last night israel has reached in gaza city. they breached the walls of that main hospital complex, which of course has been in the news so much in recent day. israel saying the u.s. backing them up that hamas has, you know, headquarters underneath the hospital. this was deemed a targeted raid. what more do we know about it? and just tell us -- give us a sense as to where we are right now in that battle in gaza. >> so, what we are seeing right now is they are -- the israelis are saying this is a targeted operation as you noted. they're trying to go into the hospital room by room, clear every room. they say they're not trying to harm civilians although you have doctors in the hospital basically saying that they are attacking civilians. it's hard to know. there's a communications blackout. information is hard to come by in gaza, but this is one of the big operations if not the biggest operation so far in israel's retaliation against hamas and gaza, and it's sort o show the world what hamas has been doing in gaza by having tunnels and military operation centers in the hospital. for hamas and for those sympathetic to the palestinian cause in general, it's a sign of how israel does not mind, you know, going into civilian areas and causing more damage than perhaps the military should. so, this is going to be somewhat of a narrative turning point as well as a military turning point. as you asked, look, this is israel at this point, you know, showing what it has been able to do. it has bulldozed through gaza, through the north to get to the hospital. and it is, in effect, followed somewhat of the u.s. and western advice to not harm as many civilians as it could. there have been intense bombing raids, of course. there have been civilian casualties, of course. but they are going at a slower, more deliberate pace and officials in the u.s. and elsewhere in the west attribute that to the pressure that they've been putting on netanyahu. >> yeah. does feel like an important and frankly fraught moment in the conflict. thank you for all the analysis this morning. we will speak to you again soon. up next here on "way too early," president biden has a message to the families who have -- of hostages held in gaza. hang in there, the president says. we'll discuss where negotiations now stand as the israel-hamas war continues to intensify. then, coming up on "morning joe," we'll speak with house minority leader hakeem jeffries after speaker mike johnson was forced to rely on democrats to help pass a bill to avert a shutdown. plus, elbows, childish insults and near fistfight. what's behind the rising tensions among republican lawmakers on the hill? >> yeah. this has been a problem that has been a thorn in the white house's side for months now. these poll numbers. and we've seen a little bit of a change of strategy in terms of the biden campaign, at least, in the past few days where we have seen them really focus on the positive sides of biden and not really go negative. that's starting to shift a little bit. starting to point out a little more down sides of trump and more aggressive and overt manner than they have been in the past. definitely a recognition that this is an issue that needs to be addressed. i think we're in a phase now where they're trying to rework, trying to see how they can sort of new england these poll numbers a bit. at the same time, we're a year out. there's a sense of, you know, as they like to say, don't wet the bed. very artful term. there's time. it would be surprising if voters were giving the president higher marks in the sense that it's a referendum right now on the president, not a choice. >> yeah. no question it will be about who this race is about, it seems. if it's about trump, it's good for biden. if it's about biden, might be good for trump. lauren, you hit something important there, the campaign has absolutely stepped up their attacks on trump in recent weeks. really trying to draw sharp contrast. now we have the new speaker of the house, mike johnson also backing trump. we know how deeply conservative he is. tell us how the white house is going to frame these men? >> that's right. we just saw this yesterday with the biden campaign and the white house really pointing out, you know -- trying to go after trump for his abortion records. the campaign was sending out emails about this yesterday. making sure that they cannot walk away from these records that they have and tying the whole republican party together as this maga extreme party. that's something they've done in the past. it's something we expect them to continue to do in the future. and hoping that they have more, you know, votes and comments from johnson and other members of the republican party to tie them to and to run those ads in the coming months. >> all right. politico's lauren egan, important reporting there. thank you for joining us this morning. and thanks to all of you for getting up way too early on us on this very busy wednesday morning.
