>> jesse: not at hooters. >> bret: but the wings are great. gogood evening. i'm bret baier. two days to go and hillary clinton is offering advice to deal with former president trump this week's debate. government investigators issue a report on the train derailment in east palestine, ohio. "common ground" segment deals with bipartisan solution to food cost, water woes and security issues. ♪ but, first, breaking tonight former president donald trump is now free to comment on certain aspects of his new york criminal trial in which he was convicted on 34 felony counts. the judge in that case has just modified former president trump's gag order. ahead of the july 11th sentencing in that case. this comes on the third day of efforts by the former president's legal team to get rid of the classified documents case against him in florida. national correspondent jeff paul is following that effort in fort pierce, florida tonight. good evening, jeff. >> yeah, good evening. bret. and special counsel jack smith was back in court today as trump's defense team pushed judge aileen cannon to throw out the evidence that was collected at mar-a-lago during that search back in 2022. but most of the day, at least a good portion of that early hearing, judge aileen cannon spent a lot of time questioning trump's defense team and really almost seemed skeptic at times of her argument. now they say basically the search of mar-a-lago was unlawful on two main points. they say there was crucial information that wasn't given to the judge who signed off on the original search warrant and we're now getting new images out of court documents showing what agents found during that search. trump's defense also argued the search itself was impermissibly large and that fbi agents didn't have a clear grasp of what they were looking for at mar-a-lago. they accused fbi agents of taking pictures of rooms that were not permitted to be in like the first lady's room. but judge cannon challenged paper is something that can be found anywhere in the house. jack smith's team argued the search warrant covered the entire property because they knew the classified documents were there and that those documents had already been moved at least once. now on previous hearings trump's defense argued jack smith's unconstitutional. trump had said things that put both law enforcement and fbi witnesses at risk however today we are learning that the gag order in new york hush money trial has been partially lifted. merchan allow it speak freely will the trial as long as it doesn't involve court members or court staff or any of their family members. any of these series have happened over the last couple of days. the judge in case doesn't normally rule from the bench. so you can expect some sort of written order to be released in the coming days, bret? >> bret: jeff paul in florida, jeff, thanks. ♪ as mentioned, we are a little more than two days away from the first scheduled debate of the presidential election cycle. and it's a big one. president biden continues his preparation at camp david, the latest polling indicates the presumptive republican nominee, former president trump is leading in several key battleground states. advantages that could, if the election were held today, give him enough electoral votes to win. senior white house correspondent jacqui heinrich has details tonight live from the north lawn. good evening, jacqui. >> good evening, bret. today the trump campaign said president biden will probably be filled with adderall during the debate. alleging he was also on it at the state of the union. they also suggested that biden might get a boost from cnn's moderators. meantime, biden's allies put out word that trump's claims cannot be trusted or even fact checked in real time. evidence that both sides are leary the other might have a good night. >> team trump appears to recognize the pitfalls of setting a low bar for biden. >> many in the media are already prepared to give joe biden a participation trophy, if he can simply stand upright for 90 minutes. we know that joe biden, that after taking an entire week off, is he going to be ready for this. >> biden allies also setting exceptions that trump might have a good night. trump's form he debate opponent hillary clinton writing in a "new york times" op-ed mr. biden starts with a disadvantage. being president isn't just a day job it's everything everywhere all at once job. historically that has led to weaker first debate performances for the incumbent. clinton predicts voters season unhappiness about the economy. offering a counter point from moody's analytic particulars boost strategy may focus less on reason fighting his claim than character. >> is he focused on revenge and hes into plan to help the middle class. >> republicans seeing that as proof of biden's vulnerability. >> it doesn't surprise me that biden is changing strategy because bicycle bidenomics has n disaster. >> no fan of the current or former president predicts a biden loss this november two unforced errors. >> one $1.6 trillion creating inflation and the other basically. >> team biden's response amounts to a warning that trump would be worse. >> more voters think that trump did a better job in office than biden. does that concern you? >> bret: jacqui heinrich in the north lawn, thanks. tonight we continue to look at the major issues likely to play a major role in thursday night's debated. democrats hope abortion will mobilize the president's base to show up in november. former president trump is seen by many as either the hero or the villain in overturning roe v. wade two years ago. here is congressional correspondent aishah hasnie. >> donald trump and the extremist republicans are coming for access to abortion. and it is up to us to stop them! >> president biden's surrogates are attacking republicans across battleground states over abortion. hoping to mobilize voters as they did in 2022. >> this is going to be one of the most deisaac issues in the campaigns. >> democrats claim former president trump and republicans want a nationwide abortion ban. republicans allege the left supports abortion up until the moment of birth. the issue is sure to be a flash point at the first presidential debate since the supreme court overturned roe v. wade. someone who debated trump in 2016, former secretary of state hillary clinton warned in the "new york times" this week mr. trump will most likely say he wants to leave abortion to the states. he hopes that sounds moderate. but it really means he is endorsing the most extreme abortion bans already imposed by many states. >> i want to see president trump ask biden when is abortion not appropriate? the day before birth? the week before? the month before? really point out a lot of extreme measures out there. >> critics say the doesn't move the needle as much as biden would like. >> many of the swing states he need to drum up support in have already made their decision about abortion in their own statewide ballots. plus, new fox news polling shows abortion ranks sixth in issues voters consider extremely important. ranking far more urgent for democrats than independence. >> and some speculation today. that trump could announce his vp pick this week but the trump campaign swiftly pouring cold water on that. although the former president did say his vice president will be at the debate with him, bret, and we know that doug burgum will be there in atlanta. >> bret: we will see who else is there as well. aishah, thank you. >> killing us. >> stocks were mixed today the dow lost 2 # 9 the s&p 500 gained 21. the nasdaq jumped 221 today. ♪ breaking tonight, a cyber attack targeting the automobile industry is having a major impact on vehicle dealerships tonight. and it is continuing. the perpetrators are reportedly demanding tens of millions of dollars in ransom. and that's creating serious problems for the industry. fox business correspondent kelly saberi is joining us tonight from chicago. good evening, kelly. >> hi, bret. cbk global a dealer management system says it's the victim of a ransom attack and impacting nearly 15,000 auto dealerships around the country. their software is used for different tasks that's car repair orders financing customer records with. so biggest automakers, g.m., ford, mercedes binns and bmw relying on cdk. the company has not revealed what it knows about the hackers, this is typical for company in negotiation. bloomberg reports through unnamed source that the group is based somewhere in eastern europe. they are demanding tens of millions of dollars to relinquish their hold on their systems. most recently, the company told their customers it anticipates restoration won't be resolved until at least sunday june 30th, in a statement, they said, quote: our sales and customer success teams are conducting one-to-one outreach with dealers in their territories to provide alternative ways to support their sales and service efforts in the interim. john crane is one of those customers i spoken to. principal at hawk auto group. they have locations around the country. >> we process over 5,000 parts, invoice as day at our group. so, that's not being done by hand. and, you know, it's a little more time and a little more work. but, you know, we have enough guys who have been around long enough. anybody with gray hair knows how to do the math and we get it right. >> the systems went down early in the morning on june 19th, and some services were restored later that day, but then the company was hit with a second attack. the company now facing litigation over the possibility of personal information being compromised. this goes to show no one is safe from ransomware attacks. even a company as big at cdk claims 2.6% of all u.s. gross domestic sprucket transacted through their software. >> bret: i talked to auto workers trying to do work arounds. disastrous train derailment in east borderline, ohio. what happens next? >> well, look, you know, back home, even in kansas, we're not a border state. but we feel like one. we lose kansans every day to fentanyl poisoning. this is the top one or two issue is the open southern border. unfortunately we had the chinese triad. we county cartel smuggling drugs. smuggling drugs through kansas. this is a problem. we need secure the border. statement we have more jobs than we have people here as well. we have to secure the border first and then work on a broken immigration system. >> bret: senator bennet i'm sure they are going to point to the bipartisan negotiation bill that never came to be. you voted for that effort. how do you get to common ground on this issue even around the edges? >> well, i think the common ground around this issue across this country is fairly straightforward. which is the american people don't want chaos at the border. they want to make sure that the border is well-maintained. and we have got a system of lawful immigration in this country that makes unlawful immigration unnecessary or less desirable on the part of the people that are coming here. and, that recognizes that our rural economy and our urban economy desperately need us to have a functional immigration system. >> bret: senator marshall what are you doing at the field hearing? what are you trying to get. rising cost every farmer feels, really every consumer feels. >> well, in addition to colorado sharing a border with kansas, we look very much alike. we have shared this same drought for 10 of the last 15 years. then we had this aquifer under neath us. this aquifer of water. it's 200 to 300 feet of fresh water. it goes all the way from south dakota through nebraska. kansas, all the way down to oklahoma and texas. and new mexico. colorado, as well as wyoming. so we're trying to figure out how do we conserve this water because of the drought, we are using the water faster than we can replenish it. we use this water to grow our crops as well as nourish our animals. trying to best practices put the final touches on a farm bill. we want to make sure we are spending that money wisely and capture what is working good and get rid of the bad. we are out here talking to the producers and seeing what they are doing. >> bret: senator bennet drought report. severe drought contiguous u.s. at the end of may. 13% moderate to extreme drought, water is a major issue for your region. >> it is a major issue. and i have been very pleased to have the opportunity to work with senator marshall across the political aisle now for years. on legislation that recognizes that nobody is making any more water, our farmers and ranchers who are the best husbands of the land have to be the ones that are leading the way on things like how we still promote soil health in a world where we are facing this kind of drought. how we produce the kind of drops that are necessary for us to keep food prices low across the country -- across the world. and make sure that america is a leading exporter. and i think as senator marshall said, there's not a lot that divides us on these issues. you know, this border between kansas and colorado. , a drought does not recognize that water. wildfire does not recognize our borders. it's critical for us to find ways to work together. to support farmers and ranchers, by the way just like we did years and years ago when the heart of this part of our country was subjected to the dust bowl. we have got deal with it as seriously as people dealt with it back then. >> bret: one issue of common ground is concern about chinese purchase of farm land in the u.s. here is the fbi director and general jack keane. >> it's not that is anything inherently unlawful about foreign purchase of land. but, we get concerned when the purchase -- purchaser may have ties back to a government that doesn't share our values. >> china is conducting one of the most comprehensive penetrations of american society in our history. buying the farmland close military bases is part of that strategy. >> bret: agricultural land ownership is 349,442 acres. "new york post" says it's next to 19 u.s. military bases in an alarming threat, and if you look at the map, it says under the guise of farming the chinese landowners could set up a recon sants sites, use tracking technology et cetera. you both seem concerned about this. senator bennet and then senator marshall? >> thanks, i'm deeply concerned about it, i introduced a bipartisan bill with james lankford who is one of the people that negotiated immigration bill. you talk about a couple years ago. to get our treasury department and our commons department toe take seriously the chinese purchase of our land. i have deep concern about it. both in terms of its proximity to military bases but also its immigration into our economy as well. as a member of the intelligence committee. this is something that we're focused on and worried about and i think we're going to find republicans and democrats who can support -- who can support this effort together and make sure that the people people at least understand the degree to which beijing is trying to own our land in a strategic i think that helps them but may not help us. >> senator marshall? >> look, food security is national security, we take it for granted as americans but it is vitally important to our security. that's why we want to elevate the secretary of agriculture onto the cfius committee which evaluates foreign investments. it goes way beyond the land and agriculture. i'm probably more concerned about the food production. china owns about a fourth of our pork production. brazil beef production as well the processing part of that food chain it. goes way beyond just the land. very concerned about all this food security is national security. >> bret: we appreciate you both coming on common ground. we will continue to talk about the things you guys are working on. thanks a lot. >> thanks for having us. >> thanks, bret. >> see all the "common ground" segments on podcast find that all-star podcast on fox news podcast.com, spotify or wherever you download podcast. also see this discussion on the fox news youtube page. >> bret: up next, the irs settles a lawsuit over its failure to protect controversial tax data of very wealthy people. we will bring you that later the panel on the presidential race, the former president's hearings in courtrooms and debate advice from hillary clinton. ♪ when you need to prepare for unpredictable adventures... >> thanks, bret. i think the answer to that is pretty straightforward and simple. for ken, this case has always been about accountability. from the time that he and the thousands of other americans found out that their information had been leaked, the irs took the position that it wasn't them. it wasn't their issue. it wasn't their fault. and there was simply nothing that they could do about it. and that was an incredibly frustrating response for to hear from a government agency that's entrusted with americans' confidential information year after year. it's troubling, i think for all of us that have to file tax returns. and so, ken took that on. >> bret: yeah. and well thanks to him, the lawsuit went forward. and this federal contractor, charles littlejohn. 38, pleaded guilty to one count of unauthorized disclosure of tax returns. return information last october. after he admitted leaking the former president's information to the "new york times," and that of other wealthy americans propublica. this the deposition is truly amazing. question source, could theoretically access anyone's tax return in that job? answer from littlejohn, yes. >> bret: were you able to access anyone's tax return? answer, i was able to access tax returns at will, yes. >> and unlike before you actually did target certain people? answer, that's correct. we should point out that thereson apology issued today by the irs to ken griffin, and i will read from it. the irs sincerely apologizes to mr. griffin and the thousands of other americans whose personal information was leaked to the press. the irs takes its responsibilities seriously and acknowledges it failed to prevent mr. littlejohn's and mr. amr. littlejohn's actions that it has made substantial investment in its data security strengthen safeguarding of taxpayer information. are you happy with that and, in this settlement it says a third party outside monitor is that what the irs needs? extremely troubling. i think john yoo hit it right on the head. people forget because of the length of time. this has been going on for what seems to be forever. people forget what the wikileaks exposed was real time american assets, intelligence assets in a field of war. while they were there. i can't imagine a more dangerous act of espionage than that. and, you know, i don't really understand or even hope to understand how people can make a martyr out of julian assange. i think it is -- if you have any interest in protecting the well-being of men, women, wearing the american flag on their shirt, in a field of war, have you got have a huge problem with this. >> bret: there is an argument about whether it was journalism and equating it to the "new york times" and the pentagon papers. but, the leaker, chelsea manning was actually pardoned by president obama. former vice president mike pence put out a post today, he endangered the lives of our troops. julian assange endangered the lives of our troops in a time of war and should have been prosecuted to the full extent of the law. the plea deal with julian assange miscarriage of justice and dishonors the sacrifice men and women of our armed forces no. plea deals for those who endanger our military or the national security of the united states ever. so weighing in on that. but it looks like this deal is done. >> i think it's been pretty interesting to see how some of the more conservative voices and further right voices have actually been praising this decision and celebrating the fact that julian assange will finally, you know, be free and able to move past this after so many years. >> bret: there is a definite split. >> exactly there has been a split. i feels there is a marker how the republican party has maybe shifted on this issue slightly. used to be everyone was saying things mike pence saying that was clearly julian assange was a traitor, that he had betrayed his country and betrayed the u.s. now we have seen more and more of these conservative voices like rand paul, like thomas massie coming out and saying this was an important deal to have been made. >> bret: just interesting timing, francesca the choice to makes this deal and what it means big picture. >> and because there hasn't been a white house press briefing this week because the president has been in debate prep. we have not had a chance to press the white house on this in particular. with respect to the comparison to former president donald trump, it is noteworthy at this point that they are pushing back essentially on the obtaining the boxes, they are trying to get as much as they can thrown out in court at this point that's largely what we expected to do. quite litigious. but the reason that they were going after trump on this is because he was not as they said forthcoming with the documents. he did not turn them over, and that is what at the heart of the classified documents case. >> bret: 100 percent ahead of the subpoena. the supreme court decision on immunity and how that comes down could effect all of that this week. i want to turn to the debate two days away. we have a new york magazine headline, what obama is whispering to biden, president's plan to save their legacy from trump. that there is concern in the obama camp and with the former president. here is karl rove. >> my view of the obama wing of the democratic party is they had their doubts about him in 2015. remember, he was a sitting vice president. and the president of the united states said i'm not going support him in the 2016 election. i'm going to support hillary clinton there was tension already that created more tension. but, they have always had their doubts about his ability to win. >> it's hard to imagine a more of a tense run-up to one event than we are having to thursday night. >> no question about it. what i find so fascinating is thought reemember. >> jensen: of obama for one. hillary clinton for another. basically taking on a role that you would assign to a deputy press secretary to lower exceptions for joe biden in this performance. look, i think that they know that he has got a huge problem. and they think they are very concerned about his ability to deliver on that. now, i think exceptions are appropriately low for joe biden. most americans are asking themselves whether he can make it through a 90 minute on-air debate in and of itself. he gets through that there is going to be sort of a residual media fanfare for that he has got exceptions where they need to be despite obama and hillary working on all of that he also has an awful lot to lose here. because he has lost ground in the last three months. he is going to have to try reestablish himself as a confident president who is able to do the job for four more years. >> bret: "new york times" national average tied at 46. the new poll out today, 46-46. and as you look at the polling averages in the critical battleground states, again, this is "new york times." it has shifted a bit, but, still, the former president with leads. wisconsin. michigan, pennsylvania. nevada, arizona. georgia, and north carolina. some of them are narrower than the "new york times" poll but they are still leads. >> neck and neck. good sign for many people in biden world that it is getting closer than some of the past polls have shown. it does go to show that legal really anything could shake this up between now and november and interesting and points to some of the strategy likely behind trying to have this debate so early in the election year, no matter what happens on thursday. both sides will have some time to try to, you know, change those polls and get back in the lead before november. >> bret: and people forget that it was the biden team, francesca, that moved forward with this early debate. kind of taking control of this debate argument, and laid down the marker. i don't know if they thought that the former president was going to say yes. he immediately said yes. and now we are where we are, but it is a risky strategy. if it doesn't work well, you have got a long time until the next debate which is september, first and second week of september. >> right. and the president's allies see an upside for them here. they believe that the contrast that would be shown on the debate stage between him and donald trump will be in their favor. obviously, they would not have agreed to do this if they did not think that by the way both campaigns seem to think that the contrast will work for them. we will see what happens. in terms of coming out of the debate and how much americans will stay tuned into it. fourth of july is coming up. >> bret: no, no, no. i'm telling you this will be the most watched event politically that we have seen since -- we had 26 million in august of that 2015, that debate in cleveland. i'm telling you this is going to be crazy francesca. >> in terms though i'm saying of how it effects the candidates and the polls long-term in these battleground states, even if someone whoever it is does really well, in terms of capitalizing off of that. and carrying that momentum all the way through to september, october, and november, it is a long summer as we were talking about the conventions are coming up. a lot can change. >> bret: that's true. you mentioned hillary clinton. she is giving advice. in this open guest essay. it's a waste of time to try to refute mr. trump's arguments like a normal debate. starts are w. nonsense and digresses into blather she writes. exceptions for him are so low, this is trump. if he doesn't literally light himself on fire thursday evening some will say he is down right presidential. it is something. >> if anyone wants to give a tutorial how to lose a debate to donald trump. hillary clinton is an excellent candidate for that this is something that you have press secretary out to do to lower eption examines. now hillary
