president zelensky went inside congress on capitol hill. he is there pleading with lawmakers for more money for the war, republicans will not sign off on that until they get security on the border. negotiations have stalled. zelensky's visit seen as a hail mary. joint news conference with the president and cover that live for you. first i want to get to this. breaking news also. moments ago harvard's governing body announced its unanimous decision, he said, not to oust the school's embattled president. a week after she appeared to testify in defense of students calling for jewish genocide. it was weak testimony at that. good morning, everybody. a big two hours. i'm bill hemmer. good morning and morning to you, partner. >> dana: great. i am dana perino, this is "america's newsroom." we do have a hopping two hours for you. claudine gay will remain in office despite her hesitancy to condemn calls for the mass murder of jews calling it a matter of context. >> bill: we're told the meetings went late into the night. the board saying in part our extensive deliberations affirm our confidence that president gay is the right leader to help our community heal and to address the very serious societal issues we're facing, end quote. >> dana: that statement is likely to ring hollow with students say their jewish classmates don't feel safe on campus. >> if the university has a double standard when it comes to free speech and the university don't enforce conduct so there are so many things happening on campus. if you are restricting movement and calling shame that is conduct. that's not speech. there is also potential title vi violations and the university isn't using their own speech until they're on the hot seat. >> bill: that's a reaction and now the report from bryan llenas. >> harvard's governing body after extensive deliberations they believe president claudine gay is the right leader to help the community heal. they released a statement that gay apologized for how she handled her congressional testimony last week and points out the university's initial statement following the october 7th attack should have been an immediate, direct condemnation. in this difficult time, we unanimously stand in support of president gay at harvard. we champion open discourse and academic freedom and united in our strong belief that calls for violence against our students and disruptions of the classroom experience will not be tolerated. this comes despite pressure from donors, alumni and students claiming she allowed the campus to become unsafe for jewish students. all of this culminating with her widely criticized congressional testimony last week. >> calling for the genocide of jews violates harvard code of conduct, correct? >> again, it depends on the context. >> it does not depend on the context. the answer is yes and this is why you should resign. >> the critics claim there is a double standard at harvard. curious how a school ranked dead last nationwide in a 2024 college free speech ranking has allowed anti-semitic protests to go virtually unchecked. >> talk to jewish students and see what our experience has been the past three months and ask them what if this was a different minority? what if she had said that about gays, black, and asian-americans? would you be as defensive? >> as to allegations they pledge areized her dissertation and other boards the board initiated an independent review of her work. it revealed a few instances of inadequate citation while the analysis found no violation of harvard's standards. she is requesting four corrections? two articles. she keeps her job. >> bill: that is that for now, right? nice to have you, bryan, thank you. a couple more things we can put up on screen to get reaction here from the crimson harvard student groups face intense backlash for statement calling israel entirely responsible for hamas attack. "wall street journal" harvard shrugs at jew hatred and on it goes. >> dana: "new york post" saying jewish students facing death threats, assault back to 1939. they do not feel like they were heard and i think the other thing is that because they are actually really concerned about their safety and even having to walk through the protests to get from one place to the next and feeling that way, we'll see if there are other actions that claudine gay takes. her job is safe for now. >> bill: see how students react. bryan's last point about the citation. the statement says they became aware of the pledge areism charges. if you have are a student applying for harvard and caught for that you don't get in that school. but the president of that school still has her job. >> dana: bill, even more. in 2021 harvard expelled 27 students for plagiarism. >> dana: president biden has stated his support for israel but whether he thinks these university presidents should keep their jobs isn't so clear. we're live at the white house with the latest. >> that's not such a surprise as pressure was mounting karine jean-pierre declined to say whether the university presidents should resign citing status as private institutions and after liz mcgill resigned they didn't weigh in on personnel matters. >> i won't weigh in on personal matters directly. you saw our response last week to the hearing. we were full throated. the president believes it is a moment to put your foot down and to insure we have moral clarity. i saw that she issued a statement withdrawing those comments. that was the right thing to do. >> the president did not mention mcgill's resignation when he was in philadelphia yesterday. it looked possible he might address it at the hanukkah reception in the east room with more than 800 people were gathered to celebrate. he spoke with israel's war against response. >> president biden: we have to be careful. we have to be careful. the whole world's public opinion can shift overnight. we can't let that happen. >> elise stefanik who questioned the school leaders one down, two to go. mit and harvard, do the right thing. the world is watching. president gay was asked by me 17 times whether calling for the genocide of jews violates harvard's code of conduct and speak her truth 17 times and the world heard. stefanik called on president biden not to remain silent and to address these university leaders at the reception last night. it never happened. but also missing reportedly from last night's reception were the families of several u.s. citizens believed to be held hostage by hamas. reportedly they asked the white house for invitations but they never got them. dana. >> dana: jacque heinrich at the white house. beautiful day. >> bill: kayleigh mcenany is with us. you graduated from harvard. what about this going down now? >> it is incomprehensible to me. i graduated in 2016. the radicalism was alive and well. very passionate student groups, some of which wanted to censor other student groups. to think that seven years later i would hear from a man, jonathan, who spoke on capitol hill, harvard law school and he on his walk to class hears calls for genocide from the river to the sea, you are outnumbered. he sits in the library and 200 protestors run into and another student is hiding under the table. they run to the dei office. diversity, equity, inclusion, the doors are locked. no student in america should face calls for genocide. yes, you have a first amendment right in this country but you don't have a first amendment right to an ivy league education or a first amendment right into polite society and first amendment right into a cushy job at a law firm or finance. >> dana: one of the things "the new york times" suggested is the decision whether to fire her was tied up in race. the dilemma over the future of dr. gay is fraught forcing the school to wreckon with difficult questions with race, religion and tolerance. do you think it had something to do with it? >> it could. the center of dei celebrated across the country so many prove oars have attained their jobs because they believe in dei. the statement i got it in my inbox this morning calls for genocide are despicable. your president days ago said context matters. the initial statement she put out not even calling the hamas attack a terrorist attack. i read her statement in the wake of the murder of george floyd and resolute and firm and correct. i wish we would have seen that same passion come out in the wake of a terrorist attack. >> bill: such a wimpy backup to appear before congress and rely on the same statements from the same law firm that told them what to say. lauren michaels was born in a kibbutz in southern israel and he allowed that snl script to play out the way it did. it is mind blowing. i'm sure jewish americans are shaking their head in disbelief. can we talk politics? new cnn polling. head-to-head watch-ups if it were trump versus biden. look at this number in michigan. trump is up by ten. here is the number in georgia, trump is up by five. a lot more data within this polling but on its face what do you say? >> this comes after the early november "new york times" poll where trump won in five of six swing states. alarms are going off in the biden campaign. there are some undercurrents to the poll i would look at. a lot of support comes from non-2020 forties. you have to get them to the polls. a get out the vote operation. third party candidates when they are put in the mix they help trump in georgia but hurt him in michigan. that's a potential x-factor. if i'm biden looking at this and losing young people, a quarter of democrats or democrat leaning voters don't approve of my presidency. i have a base issue. to me if i'm either candidate that's the one issue that would disturb me the most. >> dana: hypothetical election against biden. haley up 17 over biden. trump up over biden by four. desantis 0. haley reportedly will get -- we don't have it confirmed but will get the endorsement of governor chris sununu in new hampshire. the second state to vote. i know that she is going the say look at my electability argument is really strong. any primary voters in the republican party be persuaded by that? >> electability has been a key argument. it has unconvincing to a republican electorate. nikki haley is 20% in some polls in new hampshire in a clear second place. sununu is very popular. endorsements haven't seemed to matter. we saw it with kim reynolds in iowa. this puts a lot of pressure on chris christie. we've seen the reports of fundraisers saying look, it's time to drop out and support nikki haley. it puts pressure on chris christie. >> dana: if christie were to drop out supposedly his voters would go to healy. if desantis pulled out his voters would go to trump, right? because republicans, as you know, have attached border security and border policy reforms to any more ukraine aid and last night, guys, talks over border really hit a stalemate here. republican negotiator came out and told reporters they aren't going to get a deal on this by thursday or friday of this week. that's important because it's when both of these chambers are set to recess for the holidays. now langford is complaining the white house is talking to democrats but not talking to republicans. he blasted democrats last night on x writing this. it is great that the white house and dems have been talking all weekend about border security but republicans need to be involved. folks are frustrated on all corners of this. >> senator schumer has put this at the end of the year right before the holidays so we've simply are running out of time. >> let's get something done and before we leave for the holidays let's get disaster relief and israel and ukraine aid. >> president zelensky will sit down with house speaker mike johnson later this morning. by all signs, they are allocating now both chambers are headed home without a deal. guys. >> bill: thanks. aishah hosni on the hill. >> dana: florida congressman michael waltz and green beret commander who serves on several committees as well. let me ask you about joe biden, the president inviting zelensky hoping that he will be able to convince congress to do something. at what point do you think -- i know maybe he can't do this publicly. but zelensky has to be frustrated with president biden because of the slow walking of the aid initially that has led us to this moment. >> yeah, dana, i think he is enormously frustrated. biden has essentially slow walked us back pedaled us, incrementally provided just enough to keep zelensky from losing but not enough to help him win. i could spend the rest of the hour talking about the tanks, long range munitions, aircraft, you name it, that would have us in a very different place. now we're in a stalemate because biden again has incrementally provided just enough, not enough to win. how can we in good conscience and tell our constituents they need to dig deeper in their pockets for tens of billions of dollars more when we have no strategy, we're stuck in a stalemate that is going to take we don't even know how long and how much money and our own border is out of control. so i hope president biden can explain that to zelensky because he hasn't explained it to us. >> dana: right. let me show a couple statistics that you know well. audience at home. u.s. aid to ukraine versus other. financial aid is most ofist coming from the e.u. military aid as well. call for number two, global aid to ukraine the united states is right up there. ukraine is getting a lot of it compared to other countries. so a question for you. president biden's team is the one that put in the funding request some border money, right? the biden administration opened the door to allowing this conversation to be had about the border. we just showed the audience, i don't know if you had a chance to see it, the drone shot from eagle pass. this is not necessarily new but still shocking. you have lukeville, arizona, the same type of thing. americans are seeing these images across the board. the biden administration is in terrible straits when it comes to polling on immigration. they have an opportunity here to help zelensky as well as to help themselves, and what do you think will happen when they finally put some pen to paper to get a deal done? >> the outlines of the deal are there, dana, that's what is so frustrating. i bet a lot of senate democrats up for re-election are quietly wishing we would get our border under control because of the bad polling numbers, right? look, here is what's so frustrating. his own -- biden's own f.b.i. director is banging the drums. some people want to say we've introduced politics into this. but this is about national security and his own f.b.i. director is saying over 300 people that are on the terrorist watch list are running around america's cities that the f.b.i. is trying to track down. this is clearly a national security issue. we have to secure our own border first. politically it would be to the benefit of the democrats and yet at the same time i would like to invite zelensky, blinken, biden to one of our town halls to our teachers and talk to our first responders and explain to them how we're sending billions of dollars to pay ukrainian first responders. you take care of our border, strip out all the humanitarian stuff, the europeans can do that. you provide just the munitions that we need to backfill our military and help ukraine stop putin and you have the outlines of a deal and finally we have to have a strategy. this really matters. speaker johnson just had our ambassador to ukraine tell him that the ultimate end state is the 1991 borders, which would mean taking all of crimea. i don't think that's realistic. i don't know that anyone does. so their strategy is all over the place. either they can't articulate one or made a deliberate decision not to. but without a strategy we won't vote for another dollar. >> dana: quickly based on your experience and what you know based on the committees you are on, do you think that zelensky and ukraine can still prevail even if it's not 1991, can they push putin back? do you believe that's still possible? >> i do not from what i've seen believe it is possible to take every inch of ukrainian territory back. i will just be candid. nor i think we had a hard conversation do i know that it is in the u.s. national interest. i know what president zelensky wants and should want. does he have the capability to do so? the numbers suggest inflation might be cooling. gas prices are down, food prices, however, are up. probably don't need us to tell you that, right? you just look at the bill. that should stave off another federal rate hike, we're told. investors like it. markets are moving a bit higher today. stand by, more on that coming up in a little bit. >> dana: as we await a house vote to approve the impeachment inquiry into president biden the long and winding legal saga for his son rolls on. initial court appearance expected soon after his indictment on federal tax charges. jonathan hunt live in los angeles with the details. hi, jonathan. >> from a summer plea deal that would have ended hunter biden's legal troubles to a winter fight on multiple fronts. it has been quite a reversal of fortunes for the president's son. first to his east coast battles. legal team arguing in delaware this week that his federal gun possession case should be dismissed because even if a judge balked at the previous plea agreement prosecutors and biden signed it. his attorneys argue as part of that agreement he sacrificed valuable rights in exchange for the prosecution's agreement not to prosecute the very sort of indictment that it has brought here. and the lawyers accuse prosecutors of bowing to political pressure to pursue charges against hunter biden, which is the same argument they continue to make over his west coast legal fight where he faces the most serious charges, nine tax-related counts including three felonies. >> he was late in filing and pay taxes in certain years. that's a given. as are millions and millions of americans who do the same thing. the difference is millions and millions of americans who do the same thing are not confronted with a 56-page nine-pound indictment. >> hunter biden could make his first appearance on the tax charges this week. he has a pretty full calendar already, dana. given that republicans in congress are demanding he show up on capitol hill tomorrow for a deposition related to potential impeachment charges against president biden. shaping up to be a very busy week for the younger mr. biden. >> dana: see if it's wheels up to d.c. >> bill: jonathan turley. first on the bidens here. this is what i find interesting. that republicans in the house are coalescing together and the example i give you is this gentleman by the name of mark garcia representing a heavily biden district in california. republican. he won, however, in his quote was they've made it clear they won't cooperate unless we formalize it. let's formalize it. if and when they do what changes, what powers would they have in congress? >> well, the real question, i think, is whether a single democrat will walk across the aisle and say i'm voting not for impeachment but for answers. these committees have shown millions of dollars coming from dozens of shell companies and accounts to various biden family members. there is references and emails including from hunter biden of revenue going to the president. the president stands contradicted on long assertions made to the public. it does appear that he has lied about his lack of knowledge and involvement with these dealings. so the weird thing is that democrats are facing that and saying okay, let's stop. let's go no further to get these answers by voting for the inquiry. it is sort of like don't ask, don't tell policy for influence peddling. you are right at the point where these committees need to compel testimony to get these answers and there is a good chance not a single democratic member will say the public is entitled to the answers. >> bill: an interesting answer. really something to watch, too. i got it on that. i want to squeeze in this other thing. i want our viewers to see what the calendar looks like for donald trump politically and legally coming up in the new year. everything you see in blue deals with politics. everything you see with red deals with the courtroom. so jack smith has asked the u.s. supreme court to fast track a decision. so here are the dates i'm looking at, right? march 4th is the day before super tuesday. march 4th is when the trial is expected to be started. the justices have asked trump's lawyers to give them an answer by the 20th of december, about nine days from now. the court will meet again on the 5th of january. what is the question before the court, professor? >> well, what the special counsel is trying to do is leapfrog over the d.c. circuit which just got this issue of presidential immunity. normally, the court wants to hear from not one, but multiple court of appeals. what smith is saying is let's skip that. i need an answer now. and the priority for smith is clearly to get trump tried and in his view hopefully convicted before the election. it sort of flips the d.o.j. policy long to avoid having these trials before elections. smith is fighting to make sure that he can shoe horn this in to that schedule. you know, the supreme court may not have the same priority. they may look at this and say we don't understand why this is such an urgent rush rather than to have a court of appeals make its decision and let us all try to get this right. >> bill: we'll see what they do. wow. i mean, there is drama in that decision. thank you, sir. jonathan turley for shaking that out with us today. nice to see you. >> dana reads sports. >> dana: well, i didn't know this but monday night football gave fans a rare double feature. titans stunned the dolphins with a late rally winning 28-27. that's close. dolphins falling short on their final drive ending with a quarterback sac on fourth down. the giants creating their own drama beating the packers 24-22. another close one on a last-second field goal and locking in their third straight win. is that true? hello. >> bill, good morning. from a very cold madison. that's about ten, 12 miles to the northwest of the music city here in nashville. my gosh, you see look at the debris field of this neighborhood. just unbelievable. six people have lost their lives. two of them children. a 10-year-old and a toddler. absolutely devastating just before the christmas holiday and during hanukkah. take a look at some of the video of last evening here in madison. i arrived from the north from the kentucky/tennessee border and covering the other tornado up there and when i got down here i could not believe my eyes. people literally picking up the pieces of their lives. trying to salvage whatever they possibly could. a mangled mess in this area. brick structures destroyed, the roadways being -- trying to be cleared out. the power lines, heavy machinery and workers. and then mangled steel and homes that you just can't even recognize because of the debris fields. let's listen, if we can, to one gentleman i was talking to, a pastor who survived but his church is gone. >> my heart was heavy at the time we found out the church had been damaged by the tornado. and at night it is hard to make an assessment. we realized the walls were gone. and we came back, of course, sunday morning about 10:00 a.m. and found the devastation that you see. but we still have faith in god. >> and bill, there are thousands still out of power this morning as electrical crews are trying to restore. they hope they can get it done as quickly as possible. in the meantime, mourning the loss of the six people that have lost their lives from this terrible tornado that came in on saturday. two of them children, right before the holidays. >> bill: robert ray, thanks. thank you, robert. good to have you back there today. to our viewers, download that app. >> dana: home sweet home. monthly home payments have nearly doubled under president biden and making it one of the least affordable markets in recent history. this topic is a big one. you try to get people to understand how they should budget but with homeownership, for example. the average monthly new home payment was 1787. today it's 3300. how are people supposed to cope? >> thank you for having me back again. you know, i always say we don't look to the economy. we don't look to the government to decide when it's the best time to buy a house. we look at can we afford to buy a home? of course, we always want to buy a 15 year fixed mortgages where the payment is not more than 25%. >> dana: a lot of people are paying upwards of 50%. >> homeownership is a journey. it's a ladder. we have to readjust our expectations. all of us won't get that father of the bride home or the home from home alone, right? we have to look at our expectations and say what can i actually afford? maybe the area i live in is too expensive for me and i need to move. just remember, you may be starting at a place like an apartment, condo and working up the ladder over time still building equity. >> bill: here is the problem on the greater economy. a lot of these people are locked into a loan at a pretty good rate and some of those loans will adjust whether it's two years, or five years. depending on where they are. they will have to make big decisions and a lot of these people will stay in their homes because they can't afford what you are describing now, jade. >> when you look at this over the long haul we think back to pro-covid looking at 1% and 2% interest rates. then you look back to the 80s where in the 18 and when we look at that we go okay, five, six, seven% when we look at the grand scheme of things it is not that bad. we got used to these super low rates that honestly aren't normal. >> dana: you got yourself out of debt and a lot of it was student loan debt. for people -- i know you wrote a book about this. you can plug that if you would like. i wonder what you would say to people, is it better to rent or to buy? if you look at this call for number one, the cost of renting versus owning. the average monthly new home payment way up there. is it okay to rent? is there a stigma against renting? >> my husband and i rented for ten years before we bought while we paid off our debt and had a fully funded emergency fund. what i want people to understand is renting should be a short-term solution. we know that homeownership is such a big part of long-term wealth building and it is the biggest item on most people's budgets, right?
